【摘要】:自改革開放以來,蘊(yùn)藏量豐富的稀有資源在我國的對外貿(mào)易中扮演著十分重要的角色。然而,盡管我國是稀有資源大國,但我們實(shí)際上已深深陷入惡劣的貿(mào)易環(huán)境中。當(dāng)美國和日本在進(jìn)一步加強(qiáng)國內(nèi)資源儲備的時(shí)候,我國才開始逐漸意識到資源儲備的重要性,因此采取了一系列政策措施來限制資源性產(chǎn)品的出口。但是這一戰(zhàn)略舉措?yún)s刺痛了美、歐、墨等國敏感的神經(jīng)。2009年,美、歐、墨相繼就中國的9種原材料出口限制措施向WTO提起了貿(mào)易訴訟。2012年WTO裁決結(jié)果為我國原材料出口限制措施的實(shí)施不符合國際貿(mào)易規(guī)則。這一資源性產(chǎn)品貿(mào)易訴訟更加使我們認(rèn)識到保護(hù)資源的重要性與加快資源戰(zhàn)略儲備的急迫性。目前,我國稀有資源長期的盲目、無節(jié)制的開采與低價(jià)賤賣造成了我國在國外市場上沒有真正的話語權(quán)。這反映出我國的資源性產(chǎn)品出口管理政策還存在缺失之處。因此,我們應(yīng)當(dāng)針對我國目前稀有資源的出口管理政策做一些相應(yīng)的調(diào)整,從而能夠更加有效地保護(hù)我國的稀有資源。 本文以資源性產(chǎn)品的出口管理政策為主題,分為五個(gè)章節(jié)來撰寫。其中,第三、四、五章是本文的重點(diǎn)。第三章運(yùn)用AHP模型分析我國資源性產(chǎn)品出口管理政策選擇。第四章對目前我國資源性產(chǎn)品出口管理政策發(fā)展歷程以及具體政策措施進(jìn)行梳理,結(jié)合WTO規(guī)則分析我國資源性產(chǎn)品出口管理政策實(shí)施問題。第五章先比較美、日等國資源性產(chǎn)品管理的先進(jìn)經(jīng)驗(yàn),從而得出一些啟發(fā),最后從法律法規(guī)、出口關(guān)稅、出口配額以及其他方面提出我國完善資源性產(chǎn)品出口管理政策的對策和建議。 本文的主要觀點(diǎn)是:我國最應(yīng)該采取強(qiáng)有力的措施,如頒布相關(guān)法律法規(guī)以及行政政策,來規(guī)范資源性產(chǎn)品的出口管理,因此要完善我國的相關(guān)法律法規(guī)。在WTO框架下,出口關(guān)稅是一個(gè)合法的手段,因此還存在較大的運(yùn)用空間,可以在實(shí)施出口關(guān)稅的同時(shí)實(shí)施與之相配套的國內(nèi)稅費(fèi)措施。考慮到WTO有關(guān)條款的約束,我們要慎重采用出口配額和出口許可證制度。但是在滿足WTO規(guī)則的“一般例外”規(guī)定的情況下,我們可以選擇使用出口配額和出口許可證制度。 本文的主要創(chuàng)新在于:在研究方法上,本文結(jié)合定性分析和定量分析,賦予影響政策目標(biāo)的元素不同的權(quán)重,來分析我國的資源性產(chǎn)品出口管理政策工具;在研究視角上,本文研究的對象是各類可耗竭資源的出口管理政策,并將其納入WTO框架之下,從而使本文較之前的研究更加具有普遍應(yīng)用性,力爭從多方位、多角度分析我國的資源性產(chǎn)品出口管理政策,從而形成科學(xué)合理的研究框架,區(qū)別于之前學(xué)者主要針對我國礦產(chǎn)資源的國內(nèi)管理政策進(jìn)行的研究或?qū)iT就2009年的原材料出口限制案件進(jìn)行的分析。本文也提出了創(chuàng)新的觀點(diǎn):我國資源性產(chǎn)品出口政策的制定首先要考慮的是科學(xué)制定和實(shí)施法律行政政策,其次是完善出口關(guān)稅以及出口稅費(fèi)措施,在符合WTO一般例外的情況下,我們可以選擇使用出口配額以及出口許可證制度。
[Abstract]:Since the reform and opening up, the rich rare resources have played a very important role in the foreign trade of our country. However, although China is a country of rare resources, we have actually been deeply in a bad trade environment. Recognizing the importance of resource reserve, a series of policy measures have been taken to restrict the export of resource based products. However, this strategic move has pricked the sensitive nerve of the United States, Europe and Mexico for.2009 years, America, Europe, and Mexico, in succession to China's 9 export restrictions on raw materials to WTO the.2012 WTO decision of trade litigation for our country The implementation of the export restrictions on raw materials does not conform to the rules of international trade. This resource oriented product trade lawsuit makes us realize the importance of protecting resources and the urgency of speeding up the strategic reserve of resources. At present, our country's rare resources are blind for a long time, uncontrolled exploitation and low price sale have caused our country in the foreign market. This reflects the lack of the export management policy of our country's resources. Therefore, we should make some corresponding adjustments to the export management policy of rare resources in our country so that we can more effectively protect the rare resources of our country.
This article is divided into five chapters on the theme of the export management policy of resource based products. The third, fourth and five chapters are the focus of this article. The third chapter uses the AHP model to analyze the policy choice of China's resource oriented product export management. The fourth chapter is on the development process of China's resource oriented product export management policy and the specific policy measures. In the fifth chapter, the fifth chapter compares the advanced experience of the resource based product management in the United States and Japan, and then draws some inspiration. Finally, it puts forward the policy of improving the export management policy of our resource based products from the laws and regulations, export tariffs, export quotas and other aspects. Suggestions and suggestions.
The main point of this article is that China should take strong measures, such as the promulgation of relevant laws and regulations and administrative policies, to standardize the export management of resource products, so we should improve the relevant laws and regulations of our country. Under the framework of WTO, the export tariff is a legal hand, so there is still more space to be applied. At the same time, we should use export quotas and export license systems carefully in consideration of the provisions of WTO, but we can choose to use export quotas and export licenses under the circumstances of "general exceptions" of the WTO rules.
The main innovation of this paper is: in the study method, this paper combines qualitative analysis and quantitative analysis to give different weights of the elements affecting the policy objectives to analyze the export management policy tools of our country's resource based products; in the perspective of research, the object of this paper is the export management policy of all kinds of exhaustible resources and will be included in the research. Under the framework of WTO, this paper makes this paper more universal than previous research, and tries to analyze the export management policy of our country's resource based on multi direction and multi angle, thus forming a scientific and rational research framework, which is different from the previous scholars' research on domestic management policies of mineral resources in China or 2009. This article also puts forward an innovative point of view: the formulation of the export policy of resource based products in China is first to take into consideration the scientific formulation and implementation of legal administrative policies, and the second is to improve export duties and export tax and fee measures, and we can choose to make a choice under the general exception of the WTO.
