【摘要】：發(fā)展混合所有制和對國企分類進行監(jiān)管是以國有資本投資、運營公司為基礎的,是深化國有企業(yè)改革的關鍵。一方面國有資產授權經營制度解決了國資委職能定位的二重性,另一方面國有資本投資、運營公司可以將行政權力轉化為經濟權力。當然國有資本投資、運營公司的作用并不會伴隨其組建自然而然地實現,要以法律的形式明確其獨特的企業(yè)法人地位、治理機制和國資機構的監(jiān)管權力清單。
[Abstract]:The development of mixed ownership and the classification of state-owned enterprises are based on the investment and operation of state-owned capital, which is the key to deepen the reform of state-owned enterprises. On the one hand, the authorized management system of state-owned assets solves the duality of the function orientation of SASAC, on the other hand, the state-owned capital investment, the operating company can transform the administrative power into economic power. Of course, the role of state-owned capital investment, operating company will not be naturally realized with its formation, it should be clear in the form of law its unique corporate status, governance mechanism and regulatory power list of state capital institutions.
