【摘要】：基于合同參照點效應(yīng),以建設(shè)項目發(fā)承包雙方締結(jié)的合同作為參照點,來識別和確認其中能誘發(fā)承包人公平感知的公平關(guān)切點。研究以國內(nèi)典型地鐵工程項目為例,采用兩階段內(nèi)容分析對其合同進行編碼,確定了承包人3個公平維度下的7個公平關(guān)切點。研究表明,合同中的風(fēng)險責(zé)任、風(fēng)險補償、風(fēng)險收益等條款是引發(fā)承包人分配公平感受的關(guān)切點;參與決策權(quán)及權(quán)利約束等條款是誘發(fā)承包人程序公平感受的關(guān)切點;而信息雙向溝通與協(xié)調(diào)配合等條款是引起承包人互動公平感受的關(guān)切點。
[Abstract]:Based on the contract reference point effect, the contract concluded by both parties of the construction project is taken as the reference point to identify and confirm the fair concern point which can induce the contractor's fair perception. Taking typical subway engineering projects in China as an example, this paper uses two-stage content analysis to encode the contract, and determines seven fair concerns of contractors under three dimensions of fairness. The research shows that the terms of risk responsibility, risk compensation and risk return are the concern points that trigger the contractor's fair feeling of distribution, and the terms of participation in decision-making right and right restriction are the concern points to induce the contractor's fair feeling of procedure. The terms of information communication and coordination are the concerns of contractors.
