南沙區(qū)文化市場(chǎng)綜合行政執(zhí)法體系的構(gòu)建研究

【摘要】:我國(guó)改革開放后,文化作為商品進(jìn)入了市場(chǎng),從而逐漸形成了文化產(chǎn)業(yè)和文化市場(chǎng)。具有精神屬性的產(chǎn)品進(jìn)入了市場(chǎng),賦予了文化市場(chǎng)精神性、知識(shí)性、時(shí)效性等特性,它的特性注定了政府對(duì)其管理,不能按照物質(zhì)市場(chǎng)模式進(jìn)行。隨著改革開放的不斷深入,文化大發(fā)展、大繁榮戰(zhàn)略的提出,加速了文化市場(chǎng)的發(fā)展,這就要求我國(guó)文化管理部門要不斷轉(zhuǎn)變管理職能,不斷探索實(shí)踐,大力推進(jìn)行政執(zhí)法制度創(chuàng)新,才能維護(hù)文化市場(chǎng)經(jīng)營(yíng)秩序的穩(wěn)定。推行文化市場(chǎng)綜合執(zhí)法改革是國(guó)家推進(jìn)宏觀行政管理體制改革的重要組成部分,它對(duì)于確保意識(shí)形態(tài)領(lǐng)域安全、轉(zhuǎn)變政府職能、加強(qiáng)市場(chǎng)監(jiān)管、繁榮文化市場(chǎng)等具有重要的現(xiàn)實(shí)意義。為了給適應(yīng)日漸繁榮的文化市場(chǎng),2004年,我國(guó)開始文化市場(chǎng)綜合行政執(zhí)法的改革,各地相繼成立了綜合行政執(zhí)法機(jī)構(gòu)。 2005年廣州市南沙區(qū)按照文化市場(chǎng)執(zhí)法機(jī)構(gòu)改革的要求,完成了改革任務(wù),成立了文化市場(chǎng)管理和執(zhí)法機(jī)構(gòu)。執(zhí)法隊(duì)在推進(jìn)綜合行政執(zhí)法工作過程中,緊密結(jié)合本地經(jīng)濟(jì)社會(huì)發(fā)展實(shí)際,圍繞中心,按照建設(shè)法治社會(huì)和首善之區(qū)的要求,通過整合執(zhí)法隊(duì)伍、規(guī)范機(jī)構(gòu)設(shè)置和管理體制,提高了執(zhí)法效率,降低了執(zhí)法成本,提升了綜合行政執(zhí)法水平,取得了較好的成效。但隨著城市化速度不斷加快,文化市場(chǎng)改革的不斷深入,文化綜合行政執(zhí)法工作遇到一些突出問題,主要是行政審批、執(zhí)法沒有完全剝離;文化市場(chǎng)執(zhí)法的機(jī)構(gòu)和責(zé)任不統(tǒng)一;多頭管理、管理缺位;執(zhí)法力量嚴(yán)重不足、執(zhí)法成本高等。這些問題的存在不利于南沙文化市場(chǎng)進(jìn)一步的發(fā)展。 針對(duì)文化市場(chǎng)執(zhí)法存在的問題,本文以廣州市南沙區(qū)文化市場(chǎng)為研究對(duì)象,,結(jié)合權(quán)力的分立與制衡理論,在廣泛調(diào)研的基礎(chǔ)上,借鑒國(guó)內(nèi)外的先進(jìn)管理經(jīng)驗(yàn)和行政執(zhí)法模式,對(duì)南沙區(qū)文化市場(chǎng)綜合行政執(zhí)法體系提出了相關(guān)構(gòu)想。建議先從完善體系中一方面入手,設(shè)立南沙區(qū)文化市場(chǎng)綜合行政執(zhí)法局,獨(dú)立行使區(qū)體育局、旅游局、文廣新局、城市管理執(zhí)法分局監(jiān)管和行政處罰權(quán)以及公安分局、工商分局、衛(wèi)生局部分職權(quán);同時(shí)對(duì)執(zhí)法局的職權(quán)范圍、組織架構(gòu)、運(yùn)行機(jī)制,以及組織人員保障、經(jīng)費(fèi)保障等進(jìn)行規(guī)劃,并設(shè)計(jì)有關(guān)監(jiān)控機(jī)制。本論文的研究希望能對(duì)我國(guó)文化市場(chǎng)的有效管理以及綜合行政執(zhí)法體系的完善做出有益的探索。
[Abstract]:After China's reform and opening up, culture as a commodity entered the market, thus gradually forming cultural industry and cultural market. The products with spiritual attributes enter the market, and endow the cultural market with the characteristics of spirit, knowledge, timeliness, etc. Its characteristics doomed the government to manage it and cannot be carried out according to the material market model. With the deepening of reform and opening up, the great development of culture and the development of the strategy of great prosperity, the development of cultural market has been accelerated, which requires the cultural management departments of our country to constantly change their management functions and explore the practice. Only by vigorously promoting the innovation of administrative law enforcement system can we maintain the stability of the management order of the cultural market. The promotion of comprehensive law enforcement reform in the cultural market is an important part of the country's efforts to promote the reform of the macro-administrative system, which can ensure the safety of the ideological field, transform the functions of the government, and strengthen the supervision of the market. The prosperity culture market and so on has the important realistic significance. In order to adapt to the increasingly prosperous cultural market, in 2004, China began the reform of comprehensive administrative law enforcement in the cultural market. In 2005, Nansha District of Guangzhou completed the reform task and set up the cultural market management and law enforcement agencies in accordance with the requirements of the reform of the law enforcement agencies in the cultural market. In the process of promoting comprehensive administrative law enforcement, the law enforcement team closely combines the reality of local economic and social development, revolves around the center, and in accordance with the requirements of building a society ruled by law and the first and best areas, standardizes the setting up and management system of institutions through the integration of law enforcement teams. Improve the efficiency of law enforcement, reduce the cost of law enforcement, improve the level of comprehensive administrative law enforcement, and achieve better results. However, with the acceleration of urbanization and the deepening of cultural market reform, the comprehensive administrative law enforcement of culture has encountered some outstanding problems, mainly administrative examination and approval, law enforcement has not been completely stripped, the cultural market law enforcement agencies and responsibilities are not unified; Long management, management absence; serious shortage of law enforcement, high law enforcement costs. The existence of these problems is not conducive to the further development of Nansha cultural market. Aiming at the problems existing in the law enforcement of cultural market, this paper takes the cultural market of Nansha District of Guangzhou as the research object, combines the theory of separation and balance of power, draws lessons from the advanced management experience and administrative law enforcement mode at home and abroad on the basis of extensive investigation. Put forward the related conception to the comprehensive administrative law enforcement system of the cultural market in Nansha district. It is suggested that, on the one hand, we should set up a comprehensive administrative law enforcement bureau for the cultural market in Nansha district, and independently exercise the district sports bureau, the tourism bureau, the Wen Guangxin bureau, the urban management law enforcement bureau, the supervision and administrative punishment authority, and the public security bureau. At the same time, it plans the terms of reference, the organizational structure, the operational mechanism, the organizational personnel guarantee and the fund guarantee of the law enforcement bureau, and designs the relevant monitoring mechanism. The purpose of this paper is to explore the effective management of Chinese cultural market and the perfection of comprehensive administrative law enforcement system.
