【摘要】：人工智能技術(shù)的發(fā)展昭示著數(shù)字時代的到來。網(wǎng)聯(lián)網(wǎng)+、三網(wǎng)融合、web2.0、3D打印、MOOC、大數(shù)據(jù)等一系列新興名詞應(yīng)運(yùn)而生。數(shù)字藝術(shù)作為計算機(jī)技術(shù)支撐下的藝術(shù)新形式,在短時間能便得到了社會大眾的認(rèn)可,迅速取代原子藝術(shù)成為當(dāng)今藝術(shù)的主流形態(tài)。相較于傳統(tǒng)的藝術(shù)形態(tài),數(shù)字藝術(shù)具有更加多元化、個性化、交融性和便捷性的特點(diǎn)。然而,由于數(shù)字藝術(shù)的這些新特點(diǎn)遠(yuǎn)遠(yuǎn)超出了傳統(tǒng)藝術(shù)監(jiān)管的實(shí)施范疇,致使數(shù)字藝術(shù)系統(tǒng)內(nèi)無章可循、亂象叢生,因監(jiān)管不力造成的生產(chǎn)、銷售暴力網(wǎng)絡(luò)游戲;抄襲、剽竊他人數(shù)字藝術(shù)版權(quán);通過新媒介傳播淫穢色情信息等危害性極強(qiáng)的案件愈演愈烈,不僅侵害了公民的合法權(quán)益,還嚴(yán)重威脅著社會的公共安全。為找到監(jiān)管上述侵權(quán)行為的可行辦法,文章以“數(shù)字藝術(shù)哲學(xué)觀”、“低碳美學(xué)”與“低碳藝術(shù)觀”為理論基礎(chǔ),綜合運(yùn)用了思辨研究、個案分析法和比較研究相結(jié)合的研究方法。首先,從藝術(shù)監(jiān)管權(quán)利和藝術(shù)監(jiān)管義務(wù)出發(fā),演繹推理出數(shù)字藝術(shù)監(jiān)管權(quán)利和數(shù)字藝術(shù)監(jiān)管義務(wù)的概念及本質(zhì);接著,在與傳統(tǒng)藝術(shù)監(jiān)管模式進(jìn)行比較之后,歸納總結(jié)了當(dāng)今數(shù)字藝術(shù)監(jiān)管的新特征及新變化;隨后,結(jié)合國內(nèi)外典型的數(shù)字藝術(shù)侵權(quán)案例,對數(shù)字藝術(shù)監(jiān)管非義行為的構(gòu)成要素進(jìn)行闡述;此外,文章還結(jié)合“十三五”規(guī)劃,在我國“文化強(qiáng)國”的大戰(zhàn)略背景中探討數(shù)字藝術(shù)監(jiān)管的機(jī)遇與挑戰(zhàn),為我國數(shù)字藝術(shù)監(jiān)管法制規(guī)范出謀劃策;最后,提出數(shù)字電視藝術(shù)“分級監(jiān)管”的建議,旨在切實(shí)有效的保障公民權(quán)利,初步確立權(quán)責(zé)明晰、公平公正、透明高效的數(shù)字藝術(shù)監(jiān)管新秩序。
[Abstract]:The development of artificial intelligence technology indicates the arrival of the digital age. A series of new nouns, such as web2.0 / 3D printing, big data and so on, emerge as the times require. As a new form of art supported by computer technology, digital art has been recognized by the public in a short time, and has rapidly replaced atomic art as the mainstream form of art today. Compared with the traditional art form, digital art is more diversified, individualized, intermingled and convenient. However, because these new features of digital art go far beyond the scope of traditional art regulation, resulting in no rules to follow in the digital art system, chaos, the production and sale of violent online games caused by inadequate supervision, plagiarism, Plagiarizing other people's digital art copyright; spreading obscene and pornographic information through new media is becoming more and more serious, which not only infringes the legitimate rights and interests of citizens, but also seriously threatens the public safety of society. In order to find out the feasible way to supervise the above tort, this paper, based on the "philosophy of Digital Art", "Low-carbon Aesthetics" and "Low-Carbon Art", makes a comprehensive use of speculative research. Case analysis combined with comparative research. First, the concept and essence of digital art regulatory right and digital art supervisory obligation are deduced from the rights and obligations of art supervision, and then, after comparing with the traditional art supervision mode, The paper summarizes the new features and changes of digital art supervision. Then, combined with the typical cases of digital art infringement at home and abroad, it expounds the elements of digital art supervision unjustified behavior. The article also discusses the opportunities and challenges of digital art supervision in the context of the "cultural power" in the context of the "13th Five-Year Plan", and provides suggestions for the regulation of the legal system of digital art supervision in China. This paper puts forward the suggestion of "hierarchical supervision" of digital TV art, which aims at ensuring citizens' rights effectively and establishing a new order of digital art supervision, which is clear, fair, transparent and efficient.
