21世紀(jì)是能源的世紀(jì),能源問(wèn)題是關(guān)乎一個(gè)國(guó)家的安全與發(fā)展的重要問(wèn)題。當(dāng)前,隨著經(jīng)濟(jì)全球化的廣泛發(fā)展,國(guó)際能源合作的廣度和深度都不斷擴(kuò)展,國(guó)際能源合作出現(xiàn)了一些新的形式,主要有貿(mào)易式合作、協(xié)議式合作以及投資式合作。為了進(jìn)一步促進(jìn)國(guó)際合作的發(fā)展,在全球以及區(qū)域范圍內(nèi)也涌現(xiàn)出一些能源合作的法律機(jī)制,全球性能源組織的國(guó)際法律機(jī)制,例如國(guó)際能源署、石油輸出國(guó)組織、能源憲章組織、國(guó)際能源論壇等;區(qū)域性的能源國(guó)際法律機(jī)制包括歐盟的國(guó)際能源法律機(jī)制、上海合作組織能源合作機(jī)制等等。對(duì)金磚國(guó)家來(lái)說(shuō),金磚國(guó)家作為新興國(guó)家崛起的代表,能源資源各具特色,能源發(fā)展需求極為相似,具備較好的合作基礎(chǔ)。此外,能源合作正逐漸成為金磚各國(guó)合作的一個(gè)主要內(nèi)容,構(gòu)建能源合作的法律機(jī)制也成為部分金磚國(guó)家的訴求。因此,隨著金磚國(guó)家能源合作的深入合作的內(nèi)容也將會(huì)發(fā)生深刻的變化。要保證金磚國(guó)l家能源合作能夠有序規(guī)范運(yùn)行,就有必要借鑒國(guó)際能源合作法律機(jī)制形成之經(jīng)驗(yàn),構(gòu)建符合金磚國(guó)家能源特點(diǎn)和要求的能源合作法律機(jī)制框架,從制度上保障金磚國(guó)家能源合作的進(jìn)一步發(fā)展。本文采取案例研究的方式,對(duì)五個(gè)主要的國(guó)際和區(qū)域能源合作的法律機(jī)制進(jìn)行研究,包括...
