【摘要】：“土地征收”是我國現(xiàn)階段“城市化”進(jìn)程的重要環(huán)節(jié)。然而,我國土地征收和補(bǔ)償?shù)南嚓P(guān)法律制度在實(shí)體和程序上都存在著不同程度的缺陷;并且,由于區(qū)域經(jīng)濟(jì)發(fā)展的不平衡,征收補(bǔ)償制度在各地的實(shí)施也存在著差異。被征收主體的各項(xiàng)合法權(quán)益保障、糾紛發(fā)生后的救濟(jì)制度,以及由此引發(fā)的一系列社會(huì)問題,都是直接關(guān)系到社會(huì)公平和穩(wěn)定的亟需解決的問題。本文采用實(shí)證分析等方法,考察我國農(nóng)村土地征收和與之配套的補(bǔ)償和救濟(jì)制度在實(shí)踐中存在的問題,探索問題背后的成因,并通過借鑒國外制度和分析國內(nèi)不同地區(qū)代表性做法的利弊,特別是介紹“廣州開發(fā)區(qū)”土地征收實(shí)施過程的先進(jìn)做法和成功經(jīng)驗(yàn),對完善我國現(xiàn)行土地征收制度提出了改進(jìn)建議。
[Abstract]:Land expropriation is an important link in the process of urbanization. However, the relevant legal system of land expropriation and compensation in China has some defects in substance and procedure, and because of the imbalance of regional economic development, there are also differences in the implementation of expropriation and compensation system in various places. The protection of the legal rights and interests of the subject, the relief system after the occurrence of the dispute, and a series of social problems caused by it are all the problems that need to be solved urgently, which are directly related to the social equity and stability. In this paper, the empirical analysis is used to investigate the problems existing in the practice of rural land expropriation and the corresponding compensation and relief system in China, and to explore the causes behind the problems. And through drawing lessons from foreign systems and analyzing the advantages and disadvantages of different regional representative practices in China, especially introducing the advanced practices and successful experiences in the land expropriation implementation process of "Guangzhou Development Zone", Some suggestions are put forward to improve the current land expropriation system in China.
