【摘要】：我國的市場經(jīng)濟在改革開放后得到了前所未有的迅猛發(fā)展,伴隨其發(fā)展涌現(xiàn)出了許多的區(qū)域經(jīng)濟現(xiàn)象,它們的快速發(fā)展促進著國民經(jīng)濟的提升,呼喚區(qū)域經(jīng)濟立法的保障與助推。立法的缺失勢必會影響區(qū)域經(jīng)濟法發(fā)展,我們必須加快區(qū)域經(jīng)濟立法的步伐。 區(qū)域經(jīng)濟的發(fā)展不是與市場經(jīng)濟相伴隨產(chǎn)生的,它是在市場失靈、政府干預的形勢下產(chǎn)生的,它的產(chǎn)生對傳統(tǒng)的立法提出了挑戰(zhàn),它在無形中影響著立法理念、立法模式、立法內(nèi)容等。一些資本主義國家區(qū)域經(jīng)濟較發(fā)達,區(qū)域經(jīng)濟立法也比較完善,有著許多成功的區(qū)域經(jīng)濟立法案列。我們可以在借鑒國外先進經(jīng)驗的基礎(chǔ)上,對我國現(xiàn)有的區(qū)域經(jīng)濟立法進行反思與重構(gòu),以使我國的區(qū)域經(jīng)濟立法能適應區(qū)域經(jīng)濟法發(fā)展,為區(qū)域經(jīng)濟的發(fā)展提供制度支持。 本文在此基礎(chǔ)上以國外先進的立法實踐為借鑒,探討我國區(qū)域經(jīng)濟立法重構(gòu)的問題。本文主體部分共分為引言、正文、結(jié)語三個部分。 引言主要介紹了我國在區(qū)域經(jīng)濟迅速發(fā)展的背景下,區(qū)域經(jīng)濟立法相對滯后,在借鑒國外一些良好的立法實踐經(jīng)驗的基礎(chǔ)上開始我國區(qū)域經(jīng)濟立法的重構(gòu)。 正文部分分為三章： 第一章,區(qū)域經(jīng)濟的產(chǎn)生及對立法的影響,區(qū)域經(jīng)濟不是伴隨著市場經(jīng)濟的發(fā)展從開始就有的,而是在市場失靈,政府進行一定的干預基礎(chǔ)之上形成的。它的出現(xiàn)對傳統(tǒng)的立法提出了挑戰(zhàn),體現(xiàn)在立法理念、立法模式、立法內(nèi)容等方面。 第二章,世界區(qū)域經(jīng)濟立法成功的案例,通過對一些區(qū)域經(jīng)濟立法成功的案例介紹,總結(jié)出了美國、德國、韓國、日本等資本主義發(fā)達國家在區(qū)域經(jīng)濟立法中相同的實踐經(jīng)驗。 第三章,我國區(qū)域經(jīng)濟立法的反思與重構(gòu),我國區(qū)域經(jīng)濟立法不是完全缺失,區(qū)域經(jīng)濟立法的模式、結(jié)果等比較混亂,未能充分發(fā)揮區(qū)域經(jīng)濟立法對區(qū)域經(jīng)濟發(fā)展的助推作用。在借鑒國外先進經(jīng)驗的基礎(chǔ)上提出對我國區(qū)域經(jīng)濟立法進行重構(gòu),分主體分步驟實施重構(gòu)方案。 結(jié)語部分主要對全文研究主題的總結(jié)概況。
[Abstract]:After the reform and opening up, the market economy of our country has got unprecedented rapid development. With the development of the market economy, a lot of regional economic phenomena have emerged, and their rapid development is promoting the promotion of the national economy. Call for the protection and promotion of regional economic legislation. The lack of legislation is bound to affect the development of regional economic law, we must speed up the pace of regional economic legislation. The development of regional economy is not accompanied by market economy. It is produced under the situation of market failure and government intervention. Its emergence challenges the traditional legislation. Legislative content, etc. Some capitalist countries have developed regional economy and perfect regional economic legislation. On the basis of drawing lessons from foreign advanced experience, we can reflect on and reconstruct the existing regional economic legislation in our country, so that our regional economic legislation can adapt to the development of regional economic law and provide institutional support for the development of regional economy. On the basis of this, this paper discusses the reconstruction of regional economic legislation in China based on the advanced legislative practice in foreign countries. The main part of this paper is divided into three parts: introduction, text and conclusion. The introduction mainly introduces the background of the rapid development of regional economy in our country, the regional economic legislation is relatively lagging behind, on the basis of drawing lessons from some good legislative experience of foreign countries, the reconstruction of China's regional economic legislation is started. The text is divided into three chapters: the first chapter, the emergence of regional economy and its impact on legislation, regional economy is not accompanied by the development of market economy from the beginning, but in the market failure. Formed on the basis of certain government intervention. Its appearance challenges the traditional legislation, which is embodied in legislative idea, legislative model, legislative content and so on. The second chapter, the successful cases of world regional economic legislation, through the introduction of some successful cases of regional economic legislation, summed up the United States, Germany, South Korea, Japan and other capitalist developed countries in the same practical experience in regional economic legislation. The third chapter, the reflection and reconstruction of our country's regional economic legislation, our country's regional economic legislation is not completely missing, the pattern of regional economic legislation, the results of relatively confused, and failed to give full play to the role of regional economic legislation to promote the development of regional economy. On the basis of drawing lessons from foreign advanced experience, this paper puts forward the reconstruction of regional economic legislation in China, and carries out the reconstruction plan step by main body. The conclusion part mainly summarizes the research topic of the full text.
