區(qū)域行政協(xié)議研究

【摘要】:行政協(xié)議作為一種新型的行政行為,是區(qū)域經(jīng)濟一體化的產(chǎn)物,在解決跨區(qū)域,跨行業(yè)的行政事務(wù)方面發(fā)揮著重要的作用與價值。但是由于行政協(xié)議應(yīng)用歷史較短,所以在很長的一段時間內(nèi)被國內(nèi)學(xué)者所忽視,所以當(dāng)大量的行政協(xié)議在實踐中出現(xiàn)時,沒有形成健全完善的理論體系,部分方面還存在理論盲點。這種盲點不僅僅體現(xiàn)在理論方面,同時在制度上也存在缺位現(xiàn)象。正是因為存在制度上與理論上的缺陷,當(dāng)前我國法律在此方面也存在較大的漏洞。理論與制度上存在著較大問題,導(dǎo)致行政協(xié)議制度化的難度大大增加。之所以進行本文的研究,就是為了構(gòu)建成熟完善的行政協(xié)議制度。本文在研究時堅持理論與實際相結(jié)合,綜合分析了現(xiàn)階段中國長三角地區(qū)行政協(xié)議制度的運行情況。同時,將這一發(fā)展現(xiàn)狀與美國以及西班牙相關(guān)制度進行對比研究,進而對中國行政協(xié)議制度的發(fā)展提出更多具有建設(shè)性的指導(dǎo)意見。本文大致分為五個部分: 在緒論部分,筆者主要介紹本文的選題緣由,研究的理論基礎(chǔ),研究的意義與價值,使用的研究方法、本文的主體框架、特色以及不足。 緊接著,就是行政協(xié)議的基本理論部分。重點對行政協(xié)議的定義進行界定,本文在界定行政協(xié)議的定義時,運用了相近概念對比分析的方法,主要辨析了行政協(xié)議與公法契約、行政協(xié)議與行政契約、行政協(xié)議與行政合同的概念異同,最終對行政協(xié)議的概念做出了界定:本文所述之行政協(xié)議主要指行政協(xié)的是兩個行政主體之間,為實現(xiàn)某種公務(wù)或者行政目的,經(jīng)協(xié)商一致而簽訂的有關(guān)雙方權(quán)利義務(wù)關(guān)系的協(xié)議。在這一部分筆者還闡述了行政協(xié)議的特點:制度性、協(xié)調(diào)性、自愿性和區(qū)域性。行政協(xié)議之所以會出現(xiàn),是由我國的基本國情決定的,我國是單一制國家,地方政府隸屬于中央政府管轄,然而,我國是一個幅員遼闊的且地區(qū)發(fā)展極不平衡的國家,中央政府無法控制地方政府一切,放權(quán)是不可避免的。事實上,為了促進地方政府的積極性和主動性,中央政府已經(jīng)下放了行政權(quán)力,在這樣的現(xiàn)實條件下,地方政府相對獨立并且掌握了大量的實權(quán)。因此,地方政府與地方政府之間,可以根據(jù)自己掌握的實權(quán)進行利益交換與合作,行政協(xié)議自然應(yīng)運而生。 現(xiàn)實中大量行政協(xié)議的出現(xiàn),還有一個重要原因——區(qū)域經(jīng)濟一體化。隨著區(qū)域一體化進程的不斷推進,地方政府勢必會參與到這一進程,如果地方政府不能夠適時的調(diào)整管理方法與方式,一定會導(dǎo)致新的區(qū)域公共問題層出不窮。因此,以何種方式應(yīng)對區(qū)域一體化成為地方政府面臨的重要問題。現(xiàn)實實踐中,地方政府往往將區(qū)域行政協(xié)議作為他們的首選。 但是現(xiàn)實實踐中大量區(qū)域行政協(xié)議的出現(xiàn),也導(dǎo)致了大量問題的出現(xiàn),實踐中區(qū)域行政協(xié)議存在合法性危機、締結(jié)主體的范圍和資格、必備條款嚴(yán)重缺失、效力不確定、缺少履行性規(guī)則的約束、沒有有效的糾紛解決機制等問題。 為了解決上述問題,筆者試著就完善我國區(qū)域行政協(xié)議制度,提出了若干對策建議。但是由于我國行政協(xié)議出現(xiàn)的歷史較短,學(xué)界對其研究也不是特別完善,因此筆者首先通過分析美國和西班牙的行政協(xié)議制度,以供我國參考借鑒。接著針對我國區(qū)域行政協(xié)議制度實踐中存在的亟待解決的問題,提出了幾點針對性的對策和建議。
[Abstract]:As a new administrative act, administrative agreement is the product of regional economic integration. It plays an important role and value in solving cross regional and cross industry administrative affairs. However, because of the short history of the application of administrative agreement, it is ignored by scholars in the country for a long time, so when a large number of administrative agreements are in In practice, there is no sound and perfect theoretical system, and there are some theoretical blind spots. This blind spot is not only embodied in the theory, but also in the system. It is because of the defects in the system and theory that there are also large loopholes in the current law in this respect. There is a big problem, which leads to the difficulty of the institutionalization of administrative agreement. The reason why this article is studied is to build a mature and perfect administrative agreement system. This paper combines theory with practice in the study and analyzes the operation of the administrative agreement system in the Yangtze River Delta region at the present stage. The development status and the United States and Spain related systems are compared, and then put forward more constructive guidance to the development of China's administrative agreement system. This paper is divided into five parts:
In the introduction part, the author mainly introduces the origin of the topic, the theoretical basis of the study, the significance and value of the study, the research method used, the main frame, the characteristics and the shortcomings of this article.
Then, it is the basic theory part of the administrative agreement. The definition of administrative agreement is defined. In defining the definition of the administrative agreement, this paper uses the method of comparison and analysis of similar concepts. It mainly distinguishes the agreement between administrative agreement and public law, the agreement of administrative agreement and the agreement of administrative agreement, the similarities and differences between administrative agreement and administrative contract, and finally to the concept of administrative agreement and administrative contract. The concept of administrative agreement is defined. The administrative agreement described in this article mainly refers to the agreement between the two administrative bodies of the Political Consultative Conference and the agreement on the rights and obligations of the two parties signed by negotiation for the realization of a certain official or administrative purpose. In this part, the author also expounds the characteristics of the administrative agreement: institutional, coordination, and the characteristics of the administrative agreement. Voluntary and regional. The emergence of the administrative agreement is determined by the basic national conditions of our country. Our country is a single country and the local government is under the jurisdiction of the central government. However, our country is a country with a vast territory and extremely unbalanced regional development. The central government can not control all the local governments, and the decentralization is inevitable. In fact, in order to promote the initiative and initiative of the local government, the central government has laid down the administrative power. Under such realistic conditions, the local government is relatively independent and has a great deal of real power. Therefore, the local government and the local government can exchange and cooperate with the local government according to their own real power. However, it came into being.
In reality, the emergence of a large number of administrative agreements, there is an important reason - regional economic integration. With the continuous progress of regional integration, local governments will inevitably participate in this process. If local governments can not adjust the management methods and methods in a timely manner, the new regional public problems will emerge in endlessly. The way to cope with regional integration has become an important issue for local governments. In practice, local governments often take regional administrative agreements as their first choice.
However, the emergence of a large number of regional administrative agreements in practical practice also leads to the emergence of a large number of problems. In practice, the regional administrative agreements have the crisis of legitimacy, the scope and qualification of the main body, the lack of necessary provisions, the uncertainty of effectiveness, the lack of constraints of the performance rules, and the lack of effective dispute settlement mechanism.
In order to solve the above problems, the author tries to put forward some countermeasures and suggestions on improving the system of regional administrative agreement in China. However, because of the short history of the administrative agreement in our country, the academic circles are not particularly perfect for its research, so the author first analyzes the administrative agreement system of the United States and Spain to provide reference for our country. In view of the problems that need to be solved in the practice of regional administrative agreement system in China, several pertinent countermeasures and suggestions are put forward.
