【摘要】：我國(guó)農(nóng)村土地承包經(jīng)營(yíng)權(quán)確權(quán)工作開(kāi)展以來(lái),確權(quán)客體、確權(quán)效力和確權(quán)期限等方面規(guī)則模糊問(wèn)題逐漸顯現(xiàn):確權(quán)客體應(yīng)維持亦或變更"二輪"承包土地不明;確權(quán)效力究竟是登記生效模式亦或登記對(duì)抗模式待定;確權(quán)期限延續(xù)"二輪"承包期限亦或"長(zhǎng)久不變"未定。土地承包經(jīng)營(yíng)權(quán)確權(quán)規(guī)則的厘清,確權(quán)客體應(yīng)堅(jiān)持確地以"二輪"承包土地為主,適度微調(diào),靈活確股;土地承包經(jīng)營(yíng)權(quán)變動(dòng)應(yīng)向登記生效模式理性回歸,為完善土地承包經(jīng)營(yíng)權(quán)抵押、流轉(zhuǎn)等處分權(quán)能提供必要的基礎(chǔ);應(yīng)明晰承包期限與"長(zhǎng)久不變"的本質(zhì)區(qū)別,"長(zhǎng)久不變"政策指向在于明確土地家庭承包經(jīng)營(yíng)制度與經(jīng)營(yíng)方式的長(zhǎng)久不變和賦予集體成員完整而有保障的土地承包經(jīng)營(yíng)權(quán),土地承包經(jīng)營(yíng)權(quán)仍應(yīng)有期限。
[Abstract]:Since the work of confirming the right of the contracted management right of rural land in our country has been carried out, the vague rules of the object, the effectiveness and the time limit of the confirmation of the right have gradually appeared: the object of the confirmation of the right should maintain or change the "second round" of the land contract; Whether the validity of the confirmation is the registration effective mode or the registration confrontation mode is yet to be determined, and the term of confirmation for the renewal of the "second-round" contract period or the "long-term invariance" has not been determined. To clarify the rules of confirming the right of the land contractual management right, the object of confirming the right should adhere to the "second round" of land contracting, moderate fine-tuning, flexible determination of shares; The change of the land contract management right should return to the registration effective mode rationally, which can provide the necessary basis for perfecting the land contract management right mortgage, circulation and other disposition rights. The essential difference between the term of contract and the "long-term invariance" should be clarified. The policy of "long-term invariance" is aimed at clarifying the long-term invariance of the land household contract management system and mode of operation, and giving the collective members a complete and secure right to land contract management. There should still be a time limit for the contractual management of land.
