【摘要】：“三農(nóng)”問題關(guān)系著我國社會(huì)發(fā)展的全局,其核心問題便是土地問題。自建國以來,我國的農(nóng)村土地制度幾經(jīng)更迭,當(dāng)前的家庭聯(lián)產(chǎn)承包責(zé)任制雖然發(fā)揮了其優(yōu)越性,也暴露了一些弊端,亟待創(chuàng)新。在此情況下應(yīng)運(yùn)而生的土地股份制合作社,首先在一些地區(qū)成立,而后逐漸擴(kuò)展到全國,并且發(fā)展?fàn)顩r良好、前景廣闊,但在運(yùn)行過程中,也存在著許多問題制約其發(fā)展。據(jù)此,需要設(shè)計(jì)一個(gè)良好、高效、有序的土地股份制合作社內(nèi)部體系以促進(jìn)其發(fā)展。本文主要內(nèi)容包括六部分:第一部分為導(dǎo)論部分,對(duì)吉林省土地股份制合作社研究的立題依據(jù)、國內(nèi)外研究現(xiàn)狀進(jìn)行介紹,并闡述文章的研究?jī)?nèi)容、研究方法、技術(shù)路線及研究創(chuàng)新點(diǎn);第二部分是概念界定與理論基礎(chǔ),對(duì)吉林省土地股份制合作社的相關(guān)概念進(jìn)行界定,并對(duì)委托代理理論、股份制理論、合作經(jīng)濟(jì)理論等相關(guān)理論進(jìn)行闡述,為全文設(shè)定研究對(duì)象和研究范圍;第三部分對(duì)吉林省土地股份制合作社的現(xiàn)狀進(jìn)行分析,并提出其在建設(shè)發(fā)展中存在的問題;第四部分則是對(duì)吉林省土地股份制合作社內(nèi)部進(jìn)行合理有效的設(shè)計(jì),從股權(quán)結(jié)構(gòu)、代理人員結(jié)構(gòu)、土地資產(chǎn)保護(hù)結(jié)構(gòu)、治理結(jié)構(gòu)和經(jīng)營業(yè)務(wù)結(jié)構(gòu)五個(gè)方面出發(fā)。第五部分提出相關(guān)對(duì)策建議,促進(jìn)吉林省土地股份制合作社的發(fā)展。第六部分為結(jié)論,對(duì)本文進(jìn)行總結(jié)。本文的研究結(jié)論:第一,吉林省土地股份制合作社的發(fā)展勢(shì)頭良好,但基礎(chǔ)相對(duì)薄弱。第二,吉林省目前已經(jīng)具備建立土地股份制合作社的各項(xiàng)條件,主要包括法律法規(guī)與政策制度條件、市場(chǎng)條件、人才條件和技術(shù)條件、流通條件和銷售條件等。第三,本文在查閱資料與實(shí)地調(diào)研的基礎(chǔ)上,具體分析了吉林省土地股份制合作社的現(xiàn)狀與存在問題以及問題的成因,存在問題主要有以下五點(diǎn):一是土地確權(quán)進(jìn)展緩慢,二是存在“政社不分”的現(xiàn)象,三是組織管理制度不規(guī)范,四是專業(yè)型人才緊缺,五是治理機(jī)制缺失。第四,根據(jù)吉林省的政策制度和經(jīng)濟(jì)實(shí)力,以及吉林省土地股份制合作社的發(fā)展?fàn)顩r,借鑒了以往的經(jīng)驗(yàn),運(yùn)用創(chuàng)新的視角對(duì)吉林省土地股份制合作社體系進(jìn)行設(shè)計(jì),并提出了切實(shí)可行的對(duì)策建議。
[Abstract]:The issue of "agriculture, countryside and farmers" relates to the overall situation of social development in our country, and its core problem is the land problem. Since the founding of the people's Republic of China, the rural land system in our country has changed several times. Although the current household contract responsibility system has brought its advantages into play, it has also exposed some disadvantages and needs to be innovated. In this case, the land joint-stock co-operatives were first established in some areas, and then gradually extended to the whole country, and the development situation is good, the prospects are broad, but in the process of operation, there are many problems restricting its development. Therefore, it is necessary to design a good, efficient and orderly internal system of land stock cooperatives to promote its development. The main content of this paper includes six parts: the first part is the introduction part. It introduces the basis of the research of the land stock cooperative in Jilin Province, the present situation of the research at home and abroad, and expounds the research content and research methods of the article. Technical route and research innovation; The second part is the definition and theoretical basis of the concept, the definition of Jilin Province land joint-stock cooperative related concepts, and the principal-agent theory, joint-stock theory, cooperative economic theory and other related theories are expounded. Set up the research object and research scope for the full text; The third part analyzes the present situation of the land joint-stock cooperatives in Jilin Province, and puts forward the existing problems in the construction and development of the cooperatives. The fourth part is to carry on the reasonable and effective design to the Jilin Province land joint-stock cooperative from five aspects: ownership structure, agent structure, land asset protection structure, governance structure and business structure. The fifth part puts forward the relevant countermeasures and suggestions to promote the development of Jilin Province Land Stock Cooperative. The sixth part is the conclusion, carries on the summary to this article. The conclusions of this paper are as follows: first, the development momentum of the land stock cooperatives in Jilin Province is good, but the foundation is relatively weak. Second, Jilin Province now has all the conditions for the establishment of land joint-stock cooperatives, mainly including laws, regulations and policies, market conditions, talent and technical conditions, circulation conditions and sales conditions and so on. Thirdly, on the basis of consulting data and field investigation, this paper concretely analyzes the present situation, existing problems and the causes of the problems of Jilin Province's land joint-stock cooperatives. The main problems are as follows: first, the progress of land ownership is slow. Second, there exists the phenomenon of "political and social affairs do not distinguish", third, the organization management system is not standardized, the fourth is the shortage of specialized talents, and the fifth is the lack of governance mechanism. Fourthly, according to the policy system and economic strength of Jilin Province, and the development situation of Jilin Province's land stock cooperative, and drawing lessons from the past experience, the paper designs the system of Jilin Province's land stock cooperative from the perspective of innovation. And put forward practical countermeasures and suggestions.
