我國(guó)土地承包經(jīng)營(yíng)權(quán)抵押融資的相關(guān)制度構(gòu)建

【摘要】:改革開放以來,我國(guó)經(jīng)濟(jì)發(fā)展迅速,當(dāng)前已發(fā)展成為世界第二大經(jīng)濟(jì)體,特別是國(guó)家在工業(yè)、科技事業(yè)上的發(fā)展更是有了質(zhì)的飛躍。然而,農(nóng)村農(nóng)業(yè)的發(fā)展嚴(yán)重滯后,一直制約著我國(guó)由一個(gè)經(jīng)濟(jì)大國(guó)向經(jīng)濟(jì)強(qiáng)國(guó)的轉(zhuǎn)化。近年來,中央強(qiáng)調(diào)了這個(gè)方面,在各方民眾的支持下,一定要處理好三個(gè)核心問題,所以就發(fā)布了一些規(guī)定,要徹底的告別“三農(nóng)”問題。促進(jìn)農(nóng)村經(jīng)濟(jì)的發(fā)展,提高農(nóng)民的生活水平,農(nóng)業(yè)發(fā)展的關(guān)鍵無非兩點(diǎn),一是農(nóng)業(yè)資金的投入,二是農(nóng)村土地的利用,特別是農(nóng)民土地承包經(jīng)營(yíng)權(quán)的利用。當(dāng)前,我國(guó)正處于全面深化改革的階段,而農(nóng)村土地經(jīng)營(yíng)權(quán)的抵押貸款的試點(diǎn)改革也全面展開。然而,基于理論和實(shí)踐的土地抵押貸款融資模式仍處于探索階段,尚未形成成熟的制度;谝酝难芯,結(jié)合相關(guān)理論和我國(guó)現(xiàn)狀,實(shí)際上再吸取國(guó)外研究經(jīng)驗(yàn),分析中國(guó)目前的土地抵押融資問題制度,并按照目前的原則,結(jié)合土地抵押融資創(chuàng)新,為農(nóng)村土地抵押融資制度創(chuàng)新提出了相關(guān)制度構(gòu)想。本文除引言和結(jié)語(yǔ)外,分為五個(gè)部分:第一部分,介紹農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押融資的相關(guān)概念;第二部分,對(duì)我國(guó)農(nóng)村土地承包經(jīng)營(yíng)權(quán)的抵押融資實(shí)施的相關(guān)法律規(guī)定和政策的變革予以評(píng)述;第三部分,分析我國(guó)土地承包經(jīng)營(yíng)權(quán)融資的試點(diǎn)現(xiàn)狀,并且探討農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押實(shí)施中遭遇的困境和問題;第四部分,結(jié)合外國(guó)和臺(tái)灣地區(qū)的農(nóng)村土地按揭融資實(shí)踐,筆者在美國(guó),德國(guó),臺(tái)灣地區(qū)的這一部分作為對(duì)照和我國(guó)加入了一些介紹,具體的就是一些在實(shí)際里面的做法,希望可以為咱們國(guó)家的抵押主要是關(guān)于農(nóng)村土地方面的一些問題提供一點(diǎn)借鑒;第五部分提出了農(nóng)村土地承包履行法定制度等抵押融資權(quán)的措施,確認(rèn)了農(nóng)村土地抵押制度的合同管理;完善中國(guó)土地登記制度的承包權(quán);完善承包土地流轉(zhuǎn)監(jiān)督機(jī)制;完善中國(guó)農(nóng)村社會(huì)保障制度;完善我國(guó)農(nóng)村土地糾紛解決機(jī)制;建立中國(guó)市場(chǎng)土地流轉(zhuǎn)合同經(jīng)營(yíng)權(quán)支持體系;制度上要搞好完善,農(nóng)村土地承包經(jīng)營(yíng)很是重要,另一個(gè)就是要提高一下評(píng)估體系的時(shí)評(píng)能力,當(dāng)然是指土地承包經(jīng)營(yíng)權(quán)上的一個(gè)價(jià)值,最后一個(gè)就是一個(gè)流通模式要謹(jǐn)慎的完善,這個(gè)很重要,是關(guān)鍵,要做好強(qiáng)化,為實(shí)施農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押融資提供依據(jù)。
[Abstract]:Since the reform and opening up, China's economy has developed rapidly, and has developed into the second largest economy in the world, especially the development of the country in industry, science and technology has made a qualitative leap forward. However, the development of rural agriculture lags behind seriously, which restricts the transformation from a large economic country to an economic power. In recent years, the Central Committee has emphasized this aspect. With the support of the people of all quarters, we must deal with the three core issues, so we have issued some regulations to bid farewell to the issue of "agriculture, countryside and farmers." To promote the development of rural economy and improve the living standard of farmers, the key to agricultural development is the input of agricultural funds and the utilization of rural land, especially the use of farmers' right to contract and manage land. At present, our country is in the stage of comprehensive deepening reform, and the pilot reform of mortgage loan of rural land management right is also carried out in an all-round way. However, the land mortgage financing model based on theory and practice is still in the exploratory stage and has not yet formed a mature system. Based on the previous research, combined with the relevant theories and the present situation of our country, and drawing on the foreign research experience, this paper analyzes the current system of land mortgage financing in China, and according to the current principles, combining with the innovation of land mortgage financing, For the rural land mortgage financing system innovation, put forward the related system concept. In addition to the introduction and conclusion, this paper is divided into five parts: the first part introduces the related concepts of the rural land contractual management right mortgage financing; the second part, This paper reviews the relevant legal provisions and policy changes in the implementation of mortgage financing of rural land contractual management right in China. The third part analyzes the status quo of the pilot projects of land contractual management right financing in China. And discusses the difficulties and problems encountered in the implementation of rural land contractual management right mortgage. Part IV, combining with the foreign and Taiwan rural land mortgage financing practice, the author in the United States, Germany, This part of the Taiwan area as a comparison with our country joined some introduction, specific is some in the actual practice, hoping to provide some reference for our country's mortgage is mainly about the rural land aspects of some issues; The fifth part puts forward the measures of the right of mortgage financing, such as carrying out the legal system of the rural land contract, confirming the contract management of the rural land mortgage system, perfecting the contract right of the land registration system in China, perfecting the supervision mechanism of the contracted land circulation; To perfect China's rural social security system, to perfect the rural land dispute resolution mechanism in China, to establish a supporting system for the contractual management of land circulation in the Chinese market, and to improve the system, it is very important for rural land to be contracted and operated. The other is to improve the current evaluation capability of the evaluation system. Of course, it refers to a value in the right to contract land management. The last one is that a circulation model should be carefully improved. This is very important, it is the key, and we must do a good job of strengthening it. For the implementation of rural land contractual management right mortgage financing to provide the basis.
