【摘要】：農(nóng)村宅基地作為我國(guó)獨(dú)有的一個(gè)概念，其制度內(nèi)容在過(guò)去幾十年不斷演變，最終形成了今天的宅基地制度安排，即農(nóng)村集體經(jīng)濟(jì)組織擁有宅基地的所有權(quán)，而農(nóng)戶只擁有宅基地的使用權(quán)。這種制度安排在過(guò)去我國(guó)計(jì)劃經(jīng)濟(jì)體制以及優(yōu)先發(fā)展重工業(yè)的條件下，確曾發(fā)揮了積極的作用。但近年來(lái)，這種制度安排逐漸暴露了其不足或者說(shuō)不能與時(shí)俱進(jìn)的一面。因?yàn)殡S著我國(guó)經(jīng)濟(jì)發(fā)展方式的轉(zhuǎn)變，國(guó)家明確提出要提高農(nóng)村地區(qū)農(nóng)戶的收入水平，然而農(nóng)村宅基地作為增加農(nóng)民收入的一種途徑，，由于國(guó)家明確禁止宅基地自由流轉(zhuǎn)而不能實(shí)現(xiàn)，造成了一方面農(nóng)村宅基地大量的出現(xiàn)空閑，另一方面在經(jīng)濟(jì)發(fā)達(dá)的農(nóng)村地區(qū)和城鄉(xiāng)結(jié)合部出現(xiàn)了宅基地大量非正常流轉(zhuǎn)的現(xiàn)象。因此進(jìn)行宅基地制度改革是實(shí)現(xiàn)社會(huì)全面發(fā)展的客觀要求。 本文通過(guò)理論結(jié)合實(shí)際的分析方法，運(yùn)用新制度經(jīng)濟(jì)學(xué)理論，對(duì)我國(guó)的農(nóng)村宅基地制度進(jìn)行分析。首先詳細(xì)介紹了本文要使用到的理論包括產(chǎn)權(quán)理論、制度變遷理論、博弈和制度創(chuàng)新理論以及契約理論。其次指出目前法律法規(guī)對(duì)農(nóng)村宅基地的具體安排以及揭示出目前宅基地制度存在的問(wèn)題。然后運(yùn)用上述新制度經(jīng)濟(jì)學(xué)理論來(lái)分析宅基地制度存在的問(wèn)題以及導(dǎo)致問(wèn)題的原因。最后針對(duì)存在的問(wèn)題提出具體的解決措施，從而拓寬以后的宅基地制度改革道路。
[Abstract]:As a unique concept in our country, the content of rural homestead system has evolved continuously in the past several decades, and finally formed the arrangement of homestead system today, that is, the rural collective economic organization owns the ownership of the homestead. Farmers only have the right to use the homestead. This kind of system arrangement has played an active role under the condition of planned economy system and giving priority to developing heavy industry in the past. But in recent years, this kind of system arrangement gradually exposed its insufficiency or cannot keep pace with the times. Because with the change of economic development mode in our country, the government has clearly proposed to raise the income level of farmers in rural areas. However, the rural homestead is a way to increase the income of farmers. Because the country explicitly forbids the homestead free circulation but cannot realize, has caused on one hand the countryside homestead to appear a large number of idle, on the other hand in the economically developed rural area and the urban-rural joint part appeared the homestead massive abnormal circulation phenomenon. Therefore, the reform of homestead system is the objective requirement to realize the overall development of society. This paper analyzes the rural homestead system in our country by using the theory of new institutional economics. Firstly, the author introduces in detail the theories to be used in this paper, including the theory of property rights, the theory of institutional change, the theory of game and institutional innovation, and the theory of contract. Secondly, it points out the specific arrangement of the current laws and regulations to the rural homestead and reveals the existing problems of the current homestead system. Then it analyzes the existing problems and the causes of the problems in the homestead system by using the above mentioned new institutional economics theory. Finally, the paper puts forward concrete measures to solve the existing problems, thus widening the road of the reform of the homestead system in the future.
