【摘要】：近年來,中國農(nóng)產(chǎn)品安全問題頻發(fā),公眾不僅將矛頭指向違法犯罪生產(chǎn)企業(yè)或個(gè)人,更在質(zhì)疑中國食品安全監(jiān)管部門的執(zhí)法力度。本文從法律法規(guī)層面展開探討,闡述國外農(nóng)產(chǎn)品法律法規(guī)制定的先進(jìn)經(jīng)驗(yàn),總結(jié)國外農(nóng)產(chǎn)品質(zhì)量安全源頭監(jiān)管具有明確的法律監(jiān)管目標(biāo)和實(shí)施措施、建立完善協(xié)調(diào)的法律法規(guī)體系、行政法規(guī)和技術(shù)法規(guī)相互支撐、行政立法與經(jīng)濟(jì)立法相互補(bǔ)充、法律法規(guī)的穩(wěn)定性與適時(shí)調(diào)整、執(zhí)法程序簡單清晰,可操作性強(qiáng)等優(yōu)勢,提出國外農(nóng)產(chǎn)品質(zhì)量安全監(jiān)管對中國的啟示,即建立和完善相關(guān)法律法規(guī)體系,確定明確的立法監(jiān)管目標(biāo)和實(shí)施手段,堅(jiān)持法律法規(guī)的適時(shí)調(diào)整和修訂,建立和完善農(nóng)產(chǎn)品農(nóng)藥殘留監(jiān)控體系,推進(jìn)農(nóng)產(chǎn)品認(rèn)證的發(fā)展和監(jiān)管,加強(qiáng)農(nóng)產(chǎn)品質(zhì)量安全風(fēng)險(xiǎn)分析和防控。
[Abstract]:In recent years, the Chinese agricultural product safety problem frequently occurs, the public not only points the spearhead at the illegal criminal production enterprise or the individual, but also questions the law enforcement strength of the Chinese food safety supervision department. This paper probes into the laws and regulations, expounds the advanced experience of the establishment of the laws and regulations of foreign agricultural products, and sums up the clear legal supervision objectives and implementation measures of the source supervision of the quality and safety of foreign agricultural products. Establishing a sound and coordinated system of laws and regulations, supporting each other between administrative regulations and technical regulations, complementing administrative legislation and economic legislation, adjusting the stability and timing of laws and regulations, simplicity and clarity of law enforcement procedures, strong maneuverability, etc. The enlightenment of foreign agricultural product quality and safety supervision to China is to establish and perfect the relevant laws and regulations system, to determine the clear legislative supervision target and implement means, to insist on the timely adjustment and revision of the laws and regulations. We will establish and improve the pesticide residue monitoring system for agricultural products, promote the development and supervision of agricultural products certification, and strengthen the risk analysis and prevention and control of agricultural products quality and safety.
