【摘要】：我國(guó)林業(yè)碳匯交易制度發(fā)端于日漸嚴(yán)重的溫室效應(yīng)背景下,起源于聯(lián)合國(guó)氣候變化大會(huì)中所構(gòu)建的情節(jié)發(fā)展機(jī)制下,伴隨著人們對(duì)于生態(tài)環(huán)保的重視逐步確立和發(fā)展。目前,國(guó)際上已經(jīng)發(fā)展了不少林業(yè)碳匯項(xiàng)目來(lái)對(duì)抗溫室效應(yīng),間接減少二氧化碳的排放量,謀求本國(guó)經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展。我國(guó)作為世界上最大的發(fā)展中國(guó)家,并擁有廣闊的無(wú)林地及少林地,是林業(yè)碳匯交易的重要參與者。而我國(guó)目前的林業(yè)碳匯交易制度還不完善,但是在實(shí)踐中林業(yè)碳匯交易確積極的發(fā)展著,這種缺少法律制度保障的發(fā)展模式必然在實(shí)踐中引發(fā)了許多難題,因此,在法律層面對(duì)林業(yè)碳匯交易制度進(jìn)行研究和探討是十分必要的。筆者以法學(xué)角度對(duì)其進(jìn)行思考,運(yùn)用比較分析以及實(shí)證分析等研究方法來(lái)探討林業(yè)碳匯交易法律關(guān)系的主體客體以及內(nèi)容,并對(duì)我國(guó)林業(yè)碳匯交易法律制度的構(gòu)建提出了建議。
[Abstract]:China's forestry carbon sink trading system originated from the background of increasingly serious Greenhouse Effect, originated from the circumstances of the United Nations Climate change Conference under the circumstances of the development mechanism, along with the importance of ecological environmental protection has been gradually established and developed. At present, many forestry carbon sequestration projects have been developed in the world to fight against Greenhouse Effect, indirectly reduce carbon dioxide emissions, and seek sustainable development of national economy and society. As the largest developing country in the world, China has a wide range of forest land and forest land, which is an important participant in forestry carbon sink trading. However, the current forestry carbon sink trading system in China is not perfect, but in practice, forestry carbon sink trading is developing positively. The lack of legal system will inevitably lead to a lot of difficulties in practice. It is necessary to study and discuss the trading system of forestry carbon sink on the legal level. The author thinks about it from the angle of law, discusses the subject, object and content of the legal relationship of forestry carbon sink trading by means of comparative analysis and empirical analysis, and puts forward some suggestions on the construction of the legal system of forestry carbon sink trading in China.
