【摘要】：在我國(guó),由征地拆遷引發(fā)的失地農(nóng)民與政府之間的矛盾愈演愈烈,近年來(lái)失地農(nóng)民群體性事件在各地頻發(fā),究其原因主要是部分失地農(nóng)民的合法土地權(quán)益受損,社會(huì)保障需求得不到滿足,失地農(nóng)民問(wèn)題已經(jīng)引起社會(huì)越來(lái)越多的關(guān)注。在毫州經(jīng)濟(jì)開發(fā)區(qū),部分失地農(nóng)民對(duì)征遷補(bǔ)償安置標(biāo)準(zhǔn)及社會(huì)保障待遇不滿意,可持續(xù)生計(jì)壓力增大,由此造成信訪案件逐年增加、暴力沖突事件時(shí)有發(fā)生,這嚴(yán)重影響了毫州經(jīng)濟(jì)開發(fā)區(qū)的經(jīng)濟(jì)發(fā)展和社會(huì)穩(wěn)定,阻礙了經(jīng)開區(qū)城鎮(zhèn)化的步伐。因此,筆者本著為解決經(jīng)開區(qū)失地農(nóng)民問(wèn)題提供對(duì)策,采取問(wèn)卷調(diào)查的方式,圍繞與失地農(nóng)民社會(huì)保障相關(guān)的問(wèn)題,對(duì)經(jīng)開區(qū)內(nèi)部分農(nóng)民失地后的生存和發(fā)展現(xiàn)狀進(jìn)行了調(diào)研。調(diào)查結(jié)果顯示部分失地農(nóng)民對(duì)土地、房屋補(bǔ)償標(biāo)準(zhǔn)以及目前的養(yǎng)老、住房、就業(yè)等社會(huì)保障待遇的滿意度較低,失地農(nóng)民再就業(yè)以及城市生活融入上存在困難。經(jīng)過(guò)深入分析,筆者認(rèn)為造成經(jīng)開區(qū)失地農(nóng)民問(wèn)題的原因除了相關(guān)法律、制度設(shè)計(jì)不完善外,還有政府在失地農(nóng)民政策制定上的短視,基層社區(qū)組織對(duì)失地農(nóng)民治理和服務(wù)的滯后,以及失地農(nóng)民自身能力受限等因素。結(jié)合調(diào)研結(jié)果和經(jīng)開區(qū)的實(shí)際,筆者提出了以科學(xué)制定征遷補(bǔ)償標(biāo)準(zhǔn)為前提,以提高基本社會(huì)保障待遇為基礎(chǔ),以完善就業(yè)保障政策為支撐的模式,在解決失地農(nóng)民問(wèn)題的過(guò)程中要強(qiáng)化政府的作用,充分發(fā)揮社區(qū)治理服務(wù)和社會(huì)組織幫扶的功能,并且要重視引導(dǎo)失地農(nóng)民轉(zhuǎn)變觀念。
[Abstract]:In our country, the contradiction between the landless peasants and the government caused by the land expropriation and removal is becoming more and more intense. In recent years, the mass incidents of the land-lost peasants have occurred frequently in various places, the main reason is that the legitimate land rights and interests of some land-lost farmers have been damaged. Social security needs are not met, and the problem of landless farmers has attracted more and more attention in the society. In the Mizhou Economic Development Zone, some landless farmers are not satisfied with the standard of compensation for expropriation and relocation and social security treatment, and the pressure of sustainable livelihood is increasing. As a result, the number of cases of letters and visits has increased year by year, and violent conflicts have occurred from time to time. This has seriously affected the economic development and social stability of the economic development zone of Mizhou, and hindered the pace of urbanization in the economic development zone. In order to provide countermeasures for solving the problem of land-lost farmers in the economic development area, the author adopts the method of questionnaire investigation, and revolves around the problems related to the social security of land-lost farmers. A survey was conducted on the survival and development status of some farmers in the open area after losing their land. The results showed that some landless farmers were less satisfied with land, housing compensation standards and current social security benefits such as pension, housing, employment, etc. There are difficulties in re-employment of land-lost farmers and integration of urban life. Through in-depth analysis, the author believes that the reasons for the problem of land-lost peasants in the open areas are not perfect except the relevant laws and system design. There are also factors such as the government's shortsightedness in the formulation of land-lost farmers' policies, the lag of grass-roots community organizations in the governance and service of landless farmers, and the limited ability of landless farmers themselves. Combined with the results of research and the reality of the economic development areas, The author puts forward a model based on the scientific formulation of compensation standard for expropriation and relocation, on the basis of improving the basic social security treatment, and on the improvement of employment security policy, so as to strengthen the role of the government in the process of solving the problem of land-lost farmers. We should give full play to the functions of community governance services and social organizations, and attach importance to guiding land-losing farmers to change their concepts.
