【摘要】：在我國人多地少的國情下,在工業(yè)化、城鎮(zhèn)化快速發(fā)展中建設(shè)用地需求與供應(yīng)矛盾日益凸顯的背景下,在農(nóng)村地區(qū)宅基地大量閑置和低效利用的現(xiàn)實(shí)情況下,農(nóng)村宅基地退出是將建設(shè)用地外延擴(kuò)張轉(zhuǎn)變到內(nèi)部挖潛軌道、促進(jìn)宅基地集約高效利用、緩解耕地保護(hù)壓力的重要手段之一。但由于當(dāng)前的宅基地管理制度中宅基地退出機(jī)制的缺失,農(nóng)村宅基地退出可操作性不強(qiáng),運(yùn)行效果不佳。因而,改革現(xiàn)行農(nóng)村宅基地管理制度,構(gòu)建農(nóng)村宅基地退出機(jī)制,對(duì)引導(dǎo)農(nóng)村宅基地有序退出具有重意義。本文首先系統(tǒng)分析了現(xiàn)行宅基地管理制度層面上宅基地退出機(jī)制的缺失及表現(xiàn);再通過問卷調(diào)查和座談等方式對(duì)貴州省農(nóng)村宅基地利用及退出狀況進(jìn)行實(shí)地調(diào)研,從實(shí)際操作層面上分析了由于退出機(jī)制的缺失所引起的宅基地利用和退出存在的諸多問題;從工業(yè)化和城鎮(zhèn)化發(fā)展、宅基地退出平臺(tái)、宅基地管理需求、保障農(nóng)民宅基地財(cái)產(chǎn)權(quán)利等方面分析了構(gòu)建農(nóng)村宅基地退出機(jī)制的必要性�；谝陨涎芯�,本文提出在明晰農(nóng)村宅基地產(chǎn)權(quán),明確宅基地退出的條件、模式以及程序的前提下,構(gòu)建合乎貴州省實(shí)際的農(nóng)村宅基地退出機(jī)制。主要包括合理補(bǔ)償退出農(nóng)戶、規(guī)范宅基地退出后節(jié)余指標(biāo)利益分配和獎(jiǎng)勵(lì)主動(dòng)放棄合法宅基地申請農(nóng)戶在內(nèi)的激勵(lì)措施;包括有償使用農(nóng)村宅基地使用權(quán)、收取建新拆舊履約保證金在內(nèi)的約束措施;以及包括構(gòu)建農(nóng)村宅基地流轉(zhuǎn)市場、管理退出后宅基地的置換與整治在內(nèi)的配套保障措施。
[Abstract]:In our country's national conditions, in the industrialization, the urbanization contradiction of land supply and demand has become increasingly prominent in the background of the rapid development of the construction of rural homestead area, in the reality of a large number of idle and inefficient use, the rural homestead exit is the extension and expansion of construction land changes to the internal potential of rail homestead, promote the efficient and intensive use, an important means to alleviate the pressure on cultivated land protection. But due to the lack of exit mechanism of current homestead homestead management system in the rural homestead exit, operability is not strong, poor operating results. Therefore, the existing rural land management system reform, the construction of rural homestead exit mechanism to guide the rural homestead, orderly exit has important significance. This paper analyzes the current land management system level homestead exit mechanism and the lack of performance; and then through the questionnaire And the discussion on rural residential land use in Guizhou province and the exit status of field research, from the actual operation level analysis because of many problems caused by the lack of exit mechanism of homestead use and exit; from the development of industrialization and urbanization, the rural homestead exit platform, homestead management demand, protect farmers homestead property rights and other aspects of the necessity of constructing the rural homestead exit mechanism. Based on the above research, this paper clear the rural land property rights, clear homestead exit conditions, mode and procedure of the premise, to build a Guizhou Province Rural Homestead exit mechanism. Including a reasonable compensation standard from farmers the homestead exit after the distribution of benefits and rewards savings targets take the initiative to give up the legal homestead for farmers, including compensation for the use of incentive measures; rural homestead. We should use the right to collect the constraint measures of building new and old performance bonds, and include supporting measures to build the rural household land transfer market, and to manage the replacement and renovation of homestead after the exit.
