【摘要】：黨的十八屆三中全會通過的《關(guān)于全面深化改革若干重大問題的決定》指出“完善和發(fā)展中國特色社會主義制度,推進國家治理體系和治理能力的現(xiàn)代化”“鼓勵承包經(jīng)營權(quán)在公開市場上向?qū)I(yè)大戶、家庭農(nóng)場、農(nóng)民合作社、農(nóng)業(yè)企業(yè)流轉(zhuǎn),發(fā)展多種形式規(guī)模經(jīng)營”；解決“三農(nóng)”問題是鄉(xiāng)村治理的重要內(nèi)容,其中土地流轉(zhuǎn)是解決“三農(nóng)”問題的重要一環(huán)。2014年中央1號文件《關(guān)于引導農(nóng)村土地經(jīng)營權(quán)有序流轉(zhuǎn)發(fā)展農(nóng)業(yè)適度規(guī)模經(jīng)營的意見》明確提出,“鼓勵承包農(nóng)戶依法采取轉(zhuǎn)包、出租、互換、轉(zhuǎn)讓及入股等方式流轉(zhuǎn)承包地。鼓勵有條件的地方制定扶持政策,引導農(nóng)戶長期流轉(zhuǎn)承包地并促進其轉(zhuǎn)移就業(yè)”；2015年中央1號文件《關(guān)于加大改革創(chuàng)新力度加快農(nóng)業(yè)現(xiàn)代化建設的若干意見》又進一步提出,“堅持和完善農(nóng)村基本經(jīng)營制度,堅持農(nóng)民家庭經(jīng)營主體地位,引導土地經(jīng)營權(quán)規(guī)范有序流轉(zhuǎn)”。土地流轉(zhuǎn)是指擁有土地承包經(jīng)營權(quán)的農(nóng)戶,將土地的承包經(jīng)營權(quán)(使用權(quán))轉(zhuǎn)讓給其他農(nóng)戶或經(jīng)濟組織,也就是保留承包權(quán),轉(zhuǎn)讓使用權(quán)。土地經(jīng)營權(quán)流轉(zhuǎn)是中國的又一次土地改革,對不斷創(chuàng)新農(nóng)業(yè)生產(chǎn)經(jīng)營方式和提高農(nóng)業(yè)經(jīng)營水平起了很大的引導作用,對實現(xiàn)中國特色的農(nóng)業(yè)現(xiàn)代化具有巨大的推動作用,是新世紀新階段搞好農(nóng)村經(jīng)濟發(fā)展的一種有效途徑。本論文選取甘肅省張家川回族自治縣,來研究該地區(qū)土地流轉(zhuǎn)現(xiàn)狀,出現(xiàn)的問題,并提出了相應的解決辦法,具有特殊意義。本文共分為五個部分,緒論部分介紹了本選題的研究背景及意義以及在國內(nèi)外的研究現(xiàn)狀；第二章介紹了土地流轉(zhuǎn)在我國提出的背景、過程、原則、目標、模式及意義；第三章介紹了張家川回族自治縣土地流轉(zhuǎn)的現(xiàn)狀,首先論述了張家川回族自治縣土地流轉(zhuǎn)的必要性及流轉(zhuǎn)程度,接著選取連五、大陽、馬鹿這三個土地流轉(zhuǎn)比較成功的鄉(xiāng)鎮(zhèn),分別介紹了它們具體的流轉(zhuǎn)程度、模式及成功經(jīng)驗；第四章論述了張家川回族自治縣在土地流轉(zhuǎn)中存在的主要問題,并分析了存在問題的原因；第五章針對張家川回族自治縣土地流轉(zhuǎn)中出現(xiàn)的實際問題,提出了解決這些問題的對策建議。最后,本文的完成,希望能對張家川回族自治縣以后制定適合該縣土地流轉(zhuǎn)方面的制度規(guī)定提供參考,對解決張家川回族自治縣農(nóng)民在土地流轉(zhuǎn)中出現(xiàn)的切身利益問題有所幫助,為今后張家川回族自治區(qū)探索土地流轉(zhuǎn)新模式提供一些思路，，同時希望能對其他地方實行土地流轉(zhuǎn)提供借鑒，為中國特色農(nóng)業(yè)現(xiàn)代化路徑的推進鋪設一些條件，為鄉(xiāng)村治理現(xiàn)代化和城鄉(xiāng)發(fā)展一體化提供一些思路，為建設社會主義新農(nóng)村添磚加瓦。
[Abstract]:The "decision on deepening the Reform in an All-round way" adopted by the third Plenary session of the 18 CPC Central Committee pointed out that "to perfect and develop the socialist system with Chinese characteristics." To promote the modernization of the national governance system and governance capacity "to encourage the transfer of contractual management rights in the open market to professional large households, family farms, farmers' cooperatives, agricultural enterprises, and to develop diversified forms of scale operation"; To solve the "three rural" problem is an important content of rural governance. Among them, land circulation is an important part of solving the problem of "agriculture, rural areas and farmers". The opinions on guiding the orderly circulation of rural land management right to develop agricultural moderate scale management were clearly put forward in 2014. "encouraging contracted farmers to transfer contracted land by means of subcontracting, leasing, exchanging, transferring and acquiring shares in accordance with the law... encouraging localities with conditions to formulate supporting policies to guide farmers to transfer contracted land for a long period of time and to promote their transfer of employment"; The first document of the Central Committee in 2015, "opinions on strengthening Reform and Innovation and speeding up the Construction of Agricultural Modernization" further put forward, "adhere to and improve the basic rural management system." Adhere to the main status of farmers' family management and guide the orderly circulation of land management rights. "Land transfer" refers to the farmers who have the right to contract land management. It is another land reform in China to transfer the contractual management (right of use) of land to other farmers or economic organizations, that is, to retain the right to contract and transfer the right to use. It has played a great guiding role in innovating agricultural production and management mode and improving the level of agricultural management, and has played a great role in promoting the realization of agricultural modernization with Chinese characteristics. This paper selects Zhangjiachuan Hui Autonomous County in Gansu Province to study the current situation and problems of land circulation in this area. The paper is divided into five parts. The introduction part introduces the research background and significance of this topic and the current research situation at home and abroad. The second chapter introduces the background, process, principle, goal, model and significance of land circulation in China. The third chapter introduces the present situation of land circulation in Zhangjiachuan Hui Autonomous County. Firstly, it discusses the necessity and degree of land circulation in Zhangjiachuan Hui Autonomous County, and then selects Lianwu, Dayang. The three successful villages and towns of Wapiti land circulation, respectively, introduced their specific circulation degree, model and successful experience; Chapter 4th discusses the main problems in the land circulation of Zhangjiachuan Hui Autonomous County, and analyzes the reasons for the problems. According to the practical problems in the land circulation of Zhangjiachuan Hui Autonomous County, Chapter 5th puts forward the countermeasures and suggestions to solve these problems. Finally, the completion of this paper. Hope to Zhangjiachuan Hui Autonomous County after the formulation of suitable for the county land transfer system provisions to provide reference to solve Zhangjiachuan Hui Autonomous County farmers in the land circulation of vital interests. For the future Zhangjiachuan Hui Autonomous region to explore a new mode of land transfer to provide some ideas, hope to other places to implement the land transfer to provide reference, for the promotion of agricultural modernization with Chinese characteristics laid some conditions. To provide some ideas for the modernization of rural governance and the integration of urban and rural development, to build a new socialist countryside.
