基于“三權(quán)分立”思想的風(fēng)景名勝區(qū)管理體制創(chuàng)新研究

【摘要】:隨著我國(guó)從計(jì)劃經(jīng)濟(jì)體制向市場(chǎng)經(jīng)濟(jì)體制的轉(zhuǎn)變,風(fēng)景名勝區(qū)的管理體制經(jīng)歷了從純公益性管理到政府專營(yíng)、企業(yè)經(jīng)營(yíng),再到現(xiàn)代企業(yè)制度經(jīng)營(yíng)的種種變革。在改革過(guò)程中,,所有權(quán)主體缺位、多頭管理、政企不分等問(wèn)題始終伴隨著風(fēng)景名勝區(qū)的發(fā)展或多或少地呈現(xiàn)出來(lái),資源保護(hù)讓位于經(jīng)濟(jì)開(kāi)發(fā),對(duì)風(fēng)景名勝資源造成了極大的破壞和影響。產(chǎn)生上述問(wèn)題的根本原因是制度安排不合理,缺乏有效的權(quán)力制約和利益協(xié)調(diào)機(jī)制,導(dǎo)致的風(fēng)景名勝資源所有、經(jīng)營(yíng)、管理之間關(guān)系混亂,各權(quán)力主體間職、權(quán)、責(zé)界定不明。 “三權(quán)分立”思想來(lái)源于政治學(xué)領(lǐng)域,它被廣泛應(yīng)用于社會(huì)生活的各個(gè)領(lǐng)域,蘊(yùn)含了“分權(quán)制衡”的原則,是關(guān)于權(quán)力制約與利益分配的一般規(guī)律。將“三權(quán)分立”思想引入風(fēng)景名勝區(qū)管理體制,恰好可以有效的解決風(fēng)景名勝區(qū)經(jīng)營(yíng)管理過(guò)程中權(quán)力約束機(jī)制和利益協(xié)調(diào)機(jī)制不足的問(wèn)題,進(jìn)而改變風(fēng)景名勝區(qū)管理體制不順的局面。 本文從“三權(quán)分立”的思想內(nèi)核出發(fā),將“分權(quán)制衡”的原則運(yùn)用于風(fēng)景名勝區(qū)管理體制,根據(jù)風(fēng)景名勝區(qū)所有、經(jīng)營(yíng)、管理關(guān)系的現(xiàn)狀提出所有權(quán)、經(jīng)營(yíng)權(quán)、管理權(quán)的“三權(quán)分立”的管理模式,并明確界定了三權(quán)主體的權(quán)利和職能,為風(fēng)景名勝區(qū)管理體制改革提供了全新的思路和解決的對(duì)策。 最后,本文就“三權(quán)分立”管理模式實(shí)現(xiàn)的內(nèi)外部保障進(jìn)行了詳細(xì)的闡述,意在新思想引領(lǐng)下構(gòu)建新的風(fēng)景名勝區(qū)管理體系,提高新的風(fēng)景名勝區(qū)管理模式實(shí)施的可操作性,使其具有理論和實(shí)踐的雙重意義。
[Abstract]:With the transition from planned economy system to market economy system, the management system of scenic spots has experienced various changes from pure public welfare management to government monopoly, enterprise management, and then to modern enterprise system management. In the process of reform, problems such as the absence of the main body of ownership, the management of multiple heads, the non-separation of government and enterprises, and so on, have always been accompanied by the development of scenic spots more or less, and the protection of resources has given way to economic development. It has caused great damage and influence to scenic spots. The root causes of the above problems are unreasonable system arrangement, lack of effective power restriction and interest coordination mechanism, resulting in confusion of the relationship between the resources of scenic spots, management and management, and the unclear definition of duty, power and responsibility among the various power subjects. The idea of "separation of powers" originates from the field of political science. It is widely used in various fields of social life and contains the principle of "separation of powers and checks and balances", which is a general law of power restriction and benefit distribution. Introducing the idea of "separation of powers" into the management system of scenic spots can effectively solve the problem of insufficient power constraint mechanism and interest coordination mechanism in the process of management and management of scenic spots. Starting from the core of the "separation of powers", this paper applies the principle of "separation of powers and checks and balances" to the management system of scenic spots. According to the present situation of the relationship between ownership, management and management of scenic spots, the author puts forward the ownership and management rights. The management mode of "separation of three powers" of the management power, and clearly define the rights and functions of the three power subjects, provide a new way of thinking and countermeasures for the reform of the management system of scenic spots. Finally, this paper elaborates the internal and external guarantee of the "separation of powers" management mode in order to construct a new management system of scenic spots under the guidance of new ideas, and to improve the operability of the implementation of the new management mode of scenic spots. Make it have the double meaning of theory and practice.
