【摘要】：PSC (Production Sharing Contract),指資源國擁有礦產(chǎn)資源的所有權(quán)，外國石油公司通過承擔前期勘探、開發(fā)和生產(chǎn)作業(yè)投資與資源國石油公司進行合作，利用生產(chǎn)出的原油、天然氣進行成本回收和獲得產(chǎn)品分成。 國際石油合作中，產(chǎn)品分成合同模式已成為主流合同模式。中外雙方的分成比已經(jīng)成為合同雙方的核心內(nèi)容。我國煤層氣的對外合作從上世紀90年代發(fā)展至今，同頁巖氣對外合作項目相比，已經(jīng)相對成熟。但是，同常規(guī)油氣的產(chǎn)品分成合同相比，我國非常規(guī)天然氣產(chǎn)品分成合同在收益分配環(huán)節(jié)上有明顯的不足，現(xiàn)行所有的煤層氣PSC合同中的分成比均采用固定比例，并非是隨產(chǎn)量和價格的變動而變動。固定的分成比可能使得外國石油公司在開采本國資源的過程中獲取超額的利潤，而導(dǎo)致我國利益受到傷害，資源流失。 論文主要采用對比分析法，將本國視為資源國，選取煤層氣產(chǎn)品分成合同作為代表，對比國際通行的常規(guī)天然氣產(chǎn)品分成合同和我國非常規(guī)天然氣產(chǎn)品分成合同，總結(jié)我國非常規(guī)天然氣PSC合同模式的特點以及收益分配環(huán)節(jié)的不足，并運用現(xiàn)金流分析法建立煤層氣PSC合同現(xiàn)金流函數(shù)。根據(jù)此現(xiàn)金流函數(shù)，結(jié)合非常規(guī)天然氣PSC模式的主要影響因素，如費用氣回收比例、外方參股比例以及產(chǎn)品分成率，，搭建適用于非常規(guī)天然氣PSC模式的R分成函數(shù)模型。通過實際項目—SJB煤層氣對外合作項目的具體數(shù)據(jù)進行檢驗，比較分析，驗證新模型下采用浮動的分成比例對各方收益分配的影響。 論文新模式是借鑒了常規(guī)天然氣產(chǎn)品分成模式收益分配的優(yōu)點，結(jié)合我國非常規(guī)天然氣產(chǎn)業(yè)的特殊性，以保護資源國和保證外國石油公司的正常收益為目的，避免在資源產(chǎn)量和價格發(fā)生較大波動時，外國石油公司獲得超額利潤，資源國利益受到損失為原則而構(gòu)建的收益分配模型。論文填補了煤層氣產(chǎn)品分成模式下收益分配研究的空白，重點探討我國煤層氣產(chǎn)品分成模式采用R分成因子的收益分配模型時，利益各方收益的變化情況。
[Abstract]:PSC ( Production Sharing Contract ) , which refers to the ownership of the mineral resources owned by the resource state , and the foreign oil company cooperates with the petroleum company of the resource state through the investment in the prior exploration , development and production , and uses the produced crude oil and natural gas for cost recovery and product separation . In the international oil cooperation , the division of products into contract mode has become the mainstream contract mode . The division ratio of coal bed gas in China has become the core content of the contract . Compared with the shale gas foreign cooperative project , China ' s coal bed gas ' s foreign cooperation has been relatively mature . However , compared with conventional oil and gas products , the split ratio of non - conventional natural gas products in China has been relatively mature . However , compared with conventional oil and gas products , the proportion of non - conventional natural gas products in China is not changed with the fluctuation of production and price . In this paper , a comparative analysis method is adopted to divide the national natural gas products into contracts as resource states , and the coal bed gas products are divided into contracts as representatives . The characteristics of PSC contract mode in China are compared with that of non - conventional natural gas products in China , and the cash flow analysis method is used to establish the cash flow function of PSC contract . The new model of this paper is to draw lessons from the advantages of traditional natural gas products into pattern income distribution , and combine the particularity of unconventional gas industry in China to protect the resource countries and guarantee the normal earnings of foreign oil companies .
