【摘要】： 水權(quán)交易在我國還是一個新生事物。本文用經(jīng)濟(jì)學(xué)方法特別是法與經(jīng)濟(jì)學(xué)的分析方法研究水權(quán)交易，運(yùn)用現(xiàn)代產(chǎn)權(quán)理論、交易成本理論、博弈論等，從制度影響人的行為的角度，分析制度對水資源配置的影響。 論文共分六部分。 第一部分，簡要回顧和評述國內(nèi)外學(xué)者關(guān)于水權(quán)制度及水權(quán)交易的相關(guān)理論觀點(diǎn)。 第二部分，我國水權(quán)交易的背景分析。我國水資源分布總體上呈南多北少、西多東少，且總體缺水、污染嚴(yán)重。在傳統(tǒng)公共水權(quán)條件下，政策原因、制度原因和市場原因三方面因素導(dǎo)致水資源配置扭曲。 第三部分，水權(quán)交易的制度前提分析。從國外水權(quán)制度及水權(quán)交易運(yùn)作經(jīng)驗(yàn)看，，水權(quán)交易是市場手段在水資源配置領(lǐng)域應(yīng)用的產(chǎn)物，其有效運(yùn)作的制度前提是水權(quán)的清晰界定。 第四部分，設(shè)計了一個水權(quán)交易的基本框架。根據(jù)水權(quán)分配原則、方式與對象不同，將水權(quán)市場分為一級和二級市場，并建立博弈模型，用博弈論的方法分析說明了水權(quán)交易是如何實(shí)現(xiàn)水資源的最佳配置的。 第五部分，分析了水權(quán)交易的外部效應(yīng)，著重分析了水權(quán)交易導(dǎo)致水資源時空分布改變后，對環(huán)境、農(nóng)業(yè)用水等方面的影響。 第六部分，在分析了我國水權(quán)交易制度環(huán)境的基礎(chǔ)上，得出在我國進(jìn)行水權(quán)交易的有利條件與制度障礙。
[Abstract]:Water right trade is still a new thing in our country.In this paper, we use the economic method, especially the analysis method of law and economics, to study the water right transaction. By using modern property right theory, transaction cost theory and game theory, this paper analyzes the influence of institution on water resources allocation from the point of view of institutional influence on human behavior.The thesis is divided into six parts.In the first part, the author briefly reviews and comments on the theory of water right system and water right trade at home and abroad.The second part, the background analysis of water right trade in China.The distribution of water resources in our country is generally more than north and north, west and east, and water shortage and serious pollution.Under the condition of traditional public water right, the policy reason, the system reason and the market reason lead to the distortion of water resources allocation.The third part, the system premise analysis of water right transaction.From the experience of foreign countries' water right system and water right trade operation, water right transaction is the product of the application of market means in the field of water resources allocation, and the premise of its effective operation is the clear definition of water right.In the fourth part, a basic framework of water right trade is designed.According to the principle of water rights distribution, the water rights market is divided into primary and secondary markets in different ways, and a game model is established. The method of game theory is used to analyze how water rights trade realizes the optimal allocation of water resources.In the fifth part, the external effect of water right trade is analyzed, and the influence of water right trade on environment, agricultural water use and so on after the change of water resources spatial and temporal distribution is analyzed.In the sixth part, on the basis of analyzing the institutional environment of water right trading in China, the author draws the conclusion that the favorable conditions and institutional obstacles for water right trading in China.
