【摘要】：交易存在于我們生活的方方面面，現(xiàn)代交易以合約為載體，所以合約就成為現(xiàn)代經(jīng)濟(jì)生活中的一個(gè)重要細(xì)胞。合約的執(zhí)行問題是當(dāng)前合約理論研究的前沿領(lǐng)域。而現(xiàn)有的關(guān)于合約執(zhí)行方面的理論大都著重研究合約的執(zhí)行與合約的不完全性之間的關(guān)系、合約的不完全性的原因，以及合約與企業(yè)理論等方面。本文將對(duì)現(xiàn)有的合約執(zhí)行方面的理論做一概要總結(jié)，重點(diǎn)探討合約履行成本的概念，通過對(duì)合約履行成本的博弈分析，對(duì)合約履行成本在合約的執(zhí)行過程中的作用機(jī)制進(jìn)行專項(xiàng)研究。 本文首先從商品房頻頻出現(xiàn)質(zhì)量問題的現(xiàn)狀入手，深入分析其成因，發(fā)現(xiàn)這其中有很大程度上和消費(fèi)者的維權(quán)成本過高，開發(fā)商違約成本太低有關(guān)，即商品房交易合約的履約成本過高。并在此基礎(chǔ)上結(jié)合現(xiàn)有交易成本理論和合約理論，給出本文對(duì)合約履行成本的定義，并分析其特性與決定因素，然后通過對(duì)更為一般的合約的履行成本進(jìn)行博弈分析，對(duì)合約的履行成本在合約的執(zhí)行過程中的作用機(jī)制進(jìn)行深入探討，得出關(guān)于交易合約的執(zhí)行問題更為一般的結(jié)論：合約的履行成本是一項(xiàng)長期的交易成本，它對(duì)交易合約的執(zhí)行效率和經(jīng)濟(jì)運(yùn)行效率都有重要的影響。同時(shí)，，從合約的履行成本角度，分析委托代理關(guān)系，提出一種解決委托代理問題的新思路。最后，總結(jié)全文并結(jié)合上文的論述，闡述我國的一些經(jīng)濟(jì)現(xiàn)狀與合約履行成本之間的關(guān)系及相關(guān)對(duì)策。
[Abstract]:Trade exists in every aspect of our life. Modern trade takes contract as the carrier, so contract becomes an important cell in modern economic life.The issue of contract execution is the frontier of current contract theory research.However, the existing theories on contract execution mainly focus on the relationship between contract execution and contract incompleteness, the causes of contract incompleteness, and the relationship between contract and firm theory.In this paper, we will make a summary of the existing theory of contract execution, focus on the concept of contract performance cost, through the game analysis of contract performance cost,This paper makes a special study on the function mechanism of contract performance cost in the process of contract execution.This paper begins with the current situation of the frequent quality problems of commercial housing, and deeply analyzes its causes. It is found that these problems are largely related to the excessive cost of safeguarding the rights of consumers and the low cost of breach of contract by developers.That is, commercial housing transaction contract performance costs are too high.On this basis, combining the existing transaction cost theory and contract theory, this paper gives the definition of contract performance cost, analyzes its characteristics and determinants, and then analyzes the more general contract performance cost by game analysis.This paper probes into the function mechanism of contract performance cost in the process of contract execution, and draws a more general conclusion that the contract performance cost is a long-term transaction cost.It has an important effect on the execution efficiency and economic efficiency of the transaction contract.At the same time, from the angle of contract performance cost, this paper analyzes the principal-agent relationship and puts forward a new way to solve the principal-agent problem.Finally, the paper summarizes the relationship between some economic status quo and contract performance cost and the relevant countermeasures.
