【摘要】：市場監(jiān)管是政府的重要職能,也是我國以簡政放權(quán)、放管結(jié)合、提升服務(wù)為主線的商事制度改革的重要內(nèi)容。黨的十八屆三中全會提出改革市場監(jiān)管體系,實行統(tǒng)一的市場監(jiān)管,同時要深化行政執(zhí)法體制改革,整合執(zhí)法主體,相對集中執(zhí)法權(quán),推進綜合執(zhí)法,其目的在于解決市場監(jiān)管權(quán)責交叉、多頭執(zhí)法問題。在東北地區(qū)經(jīng)濟增速放緩,市場缺乏活力的背景下,結(jié)合大連市場監(jiān)管現(xiàn)狀,探討如何以市場綜合監(jiān)管體制改革為契機,激發(fā)市場發(fā)展活力、鼓勵市場主體創(chuàng)新、規(guī)范市場秩序,推動經(jīng)濟社會快速發(fā)展,具有重要的理論和實踐意義。首先,本文依據(jù)政府與市場關(guān)系、政府規(guī)制等相關(guān)理論以及國家、省、市關(guān)于市場監(jiān)管的相關(guān)政策,運用文獻分析法、訪談?wù){(diào)查法、問卷調(diào)查法,對大連市市場綜合監(jiān)管體制改革進行訪談提綱設(shè)計和問卷設(shè)計,對大連市市場綜合監(jiān)管體制改革現(xiàn)狀及滿意度進行調(diào)查。其次,通過訪談結(jié)果的總結(jié)以及調(diào)查問卷數(shù)據(jù)的統(tǒng)計分析,發(fā)現(xiàn)大連市市場綜合監(jiān)管改革在區(qū)級層面建立大監(jiān)管體制;市場監(jiān)管機制得到了優(yōu)化;市場主體獲得了發(fā)展生機,但在目前的市場綜合監(jiān)管改革中仍然存在不完全適應(yīng)市場經(jīng)濟發(fā)展形勢、監(jiān)管職能配置不夠合理、上下監(jiān)管體制不一致、監(jiān)管力量不足、監(jiān)管人員專業(yè)化不夠等問題。最后,從市場綜合監(jiān)管體制設(shè)計、運行機制、及改革保障措施等方面對提升市場綜合監(jiān)管成效提出對策建議。本文在大連市市場綜合監(jiān)管改革滿意度調(diào)查中,分別向監(jiān)管者、經(jīng)營者和消費者發(fā)放了調(diào)查問卷,同時結(jié)合問卷調(diào)查開展了大連市市場綜合監(jiān)管改革效果的深度訪談,從多維視角剖析了大連市市場綜合監(jiān)管改革的現(xiàn)狀,從而提出有針對性的相關(guān)對策建議。
[Abstract]:Market supervision is not only an important function of government, but also an important content of commercial system reform in our country. The third Plenary session of the 18th CPC Central Committee proposed to reform the market supervision system and implement unified market supervision. At the same time, it is necessary to deepen the reform of the administrative law enforcement system, integrate the main body of law enforcement, relatively centralize the power of law enforcement, and promote comprehensive law enforcement. Its purpose is to solve the market regulatory power and responsibility crossover, long law enforcement problems. Under the background of economic growth slowing and market lack of vitality in Northeast China, combined with the present situation of market supervision in Dalian, this paper discusses how to take the reform of market comprehensive supervision system as an opportunity to stimulate the vitality of market development and encourage the innovation of market main body. Standardizing market order and promoting rapid economic and social development have important theoretical and practical significance. First of all, according to the relationship between the government and the market, government regulation and other relevant theories, as well as the national, provincial and municipal policies on market regulation, the use of literature analysis, interview survey, questionnaire survey method, An interview outline design and questionnaire design are carried out on the reform of the market comprehensive supervision system in Dalian, and a survey on the present situation and satisfaction degree of the reform of the market comprehensive supervision system in Dalian is carried out. Secondly, through the summary of the interview results and the statistical analysis of the questionnaire data, it is found that the market comprehensive supervision reform in Dalian has established a large regulatory system at the district level, and the market supervision mechanism has been optimized. The main body of the market has gained the vitality of development, but in the current comprehensive supervision reform of the market, there are still not fully adapted to the situation of the development of the market economy, the allocation of supervision functions is not reasonable, the supervision system is not consistent, and the supervision power is insufficient. Supervision staff specialization is not enough and so on. Finally, suggestions are put forward to improve the effectiveness of market comprehensive supervision from the aspects of market comprehensive supervision system design, operation mechanism, and reform and safeguard measures. In the satisfaction survey of market comprehensive supervision reform in Dalian City, this paper issues questionnaires to regulators, operators and consumers, and carries out in-depth interviews on the effect of market comprehensive supervision reform in Dalian City. This paper analyzes the present situation of market comprehensive supervision reform in Dalian from multidimensional perspective, and puts forward relevant countermeasures and suggestions.
