【摘要】：當前,隨著我國經(jīng)濟的快速發(fā)展,企業(yè)的技術(shù)創(chuàng)新能力得到了跨越式的提升,企業(yè)通過技術(shù)創(chuàng)新獲得新的知識產(chǎn)權(quán)的能力也在大幅提升。與此同時,企業(yè)對于知識產(chǎn)權(quán)的保護意義也普遍增強,專利的申請數(shù)量逐年增加,體現(xiàn)出我國知識產(chǎn)權(quán)事業(yè)已經(jīng)進入了一個前所未有的高速發(fā)展階段。技術(shù)聯(lián)盟作為一種各合作企業(yè)共同參與,資源、利益共享,風險共同承擔的技術(shù)合作組織,其知識產(chǎn)權(quán)管理問題一直是阻礙技術(shù)聯(lián)盟穩(wěn)定及進一步發(fā)展的重要制約因素之一,尤其是在合作創(chuàng)新中產(chǎn)生的前景知識產(chǎn)權(quán)權(quán)屬分配問題上。前景知識產(chǎn)權(quán)指的是各個合作參與企業(yè)在投入各種資源的前提之下,通過合作研發(fā)而創(chuàng)造出的新的知識產(chǎn)權(quán)；背景知識產(chǎn)權(quán)則指的是各個合作參與企業(yè)在項目合作之前就擁有的自身的知識產(chǎn)權(quán)。前景知識產(chǎn)權(quán)具有很強的公共產(chǎn)權(quán)屬性,其產(chǎn)權(quán)的具體內(nèi)容不容易界定、權(quán)屬分割也比較困難,因此其權(quán)屬的分配更難以公平合理的管理。在這樣的背景下,本文主要研究技術(shù)聯(lián)盟前景知識產(chǎn)權(quán)的創(chuàng)造過程：(1)背景知識共享能力；(2)創(chuàng)新能力。由于知識產(chǎn)權(quán)分配問題通常都是在技術(shù)聯(lián)盟項目合作之前的談判中通過合約的方式制定并實施,談判中的一些非理性因素同樣會影響前景知識產(chǎn)權(quán)分配的公平及合理性。因此,研究還將從對知識產(chǎn)權(quán)經(jīng)濟價值評估方面進行分析,指出經(jīng)濟利益驅(qū)使對前景知識產(chǎn)權(quán)權(quán)屬分配問題的影響。分析當前我國技術(shù)聯(lián)盟的發(fā)展現(xiàn)狀,結(jié)合理論研究,作出假設(shè)和構(gòu)建概念模型,通過問卷調(diào)研收集數(shù)據(jù),運用SPSS20.0和AM0S21.0統(tǒng)計分析軟件,對采集數(shù)據(jù)進行實證分析并檢驗理論模型,驗證理論假設(shè),分析出影響技術(shù)聯(lián)盟合作創(chuàng)新的前景知識產(chǎn)權(quán)權(quán)屬分配的因素。研究發(fā)現(xiàn),技術(shù)聯(lián)盟內(nèi)合作企業(yè)在項目合作研發(fā)中,企業(yè)的背景知識共享能力和創(chuàng)新能力對前景知識產(chǎn)權(quán)的權(quán)屬分配有著積極的影響,促進了前景知識產(chǎn)權(quán)權(quán)屬分配的公平與合理性；而在前景知識產(chǎn)權(quán)權(quán)屬未完成分配之前就對知識產(chǎn)權(quán)進行經(jīng)濟價值方面的評估,會對前景知識產(chǎn)權(quán)的權(quán)屬分配造成消極的影響,利益的驅(qū)使會使得合作企業(yè)在前景知識產(chǎn)權(quán)權(quán)屬分配的合約制定中注入更多不理性的因素,從而影響分配的公平與合理性。
[Abstract]:At present, with the rapid development of China's economy, the technological innovation ability of enterprises has been promoted by leaps and bounds, and the ability of enterprises to obtain new intellectual property through technological innovation is also greatly improved. At the same time, the significance of enterprises' protection of intellectual property has also increased, and the number of special applications is increasing year by year, reflecting the knowledge production of our country. The right enterprise has entered an unprecedented stage of high speed development. As a technical cooperation organization, as a kind of joint venture, resources, benefit sharing and risk sharing, the problem of intellectual property management has always been one of the important constraints that impede the stability and further development of the technical alliance, especially in combination. The prospect of intellectual property rights distribution in the future. Future intellectual property refers to the new intellectual property rights created by cooperation and research and development by the cooperation and participation of enterprises on the premise of investing in various resources. Intellectual property right. The foreground intellectual property has a strong property of public property, the specific content of its property right is not easy to define, the division of ownership is also difficult, so the distribution of its ownership is more difficult to be managed in a fair and reasonable way. In this context, this paper mainly studies the creation process of the prospect of intellectual property of the technical alliance: (1) the sharing of background knowledge Ability; (2) innovation ability. Because the problem of intellectual property distribution is usually formulated and implemented in the way of contract before the cooperation of the technical alliance project, some irrational factors in the negotiation will also affect the fairness and rationality of the distribution of intellectual property right. Therefore, the research will also be evaluated from the economic value of intellectual property. To analyze the influence of economic benefits on the distribution of future intellectual property rights. Analyze the current development status of China's technology alliance, combine theoretical research, make assumptions and construct conceptual models, collect data through questionnaire survey, and use SPSS20.0 and AM0S21.0 statistical analysis software to carry out empirical analysis of collected data. And verify the theoretical model, verify the theoretical hypothesis, analyze the factors that affect the distribution of future intellectual property rights in the cooperation and innovation of the technology alliance. The equity and rationality of the distribution of future intellectual property rights is entered, and the assessment of the economic value of intellectual property right before the allocation of intellectual property rights in the future will have a negative impact on the distribution of the ownership of the future intellectual property rights. More irrational factors should be injected into the formulation, which will affect the fairness and rationality of distribution.
