【摘要】：毒品犯罪一直是全世界犯罪問題的焦點,它直接危害人民群眾的身心健康,也易引發(fā)其他社會問題,給國家和人民造成巨大的經(jīng)濟損失,嚴重阻礙了社會的穩(wěn)定、和諧發(fā)展。近年來,我國加大對毒品犯罪的打擊力度,整體犯罪形勢雖有所好轉,但毒品犯罪的重大案件仍然突出,形勢不容樂觀。因此,如實反映我國目前毒品犯罪重大案件的具體現(xiàn)狀,并對其進行調查分析,找出相應的遏制對策,具有十分重大的實踐和理論意義。本文主要采取卷宗調查法和訪談調查法進行調查分析,以天津市人民檢察院為調查對象,對2010~2014年其所辦理的毒品犯罪重大案件進行統(tǒng)計和分析,客觀的展現(xiàn)目前天津地區(qū)毒品犯罪重大案件的現(xiàn)狀,并提出針對性較強的解決對策和相關建議。本文內容分為四個部分。第一部分,簡要說明本調查報告的目的和意義,即選取天津市作為樣本地區(qū)的原因以及通過對天津市人民檢察院2010~2014年毒品犯罪重大案件的情況分析,探究該地區(qū)毒品犯罪重大案件的現(xiàn)狀和高發(fā)原因,在實踐中找出相應的預防和遏制對策,有效降低重大毒品犯罪的發(fā)生。第二部分,對本調查報告的調查方法進行介紹,具體包括調查時間,調查地點和調查方式,即在天津市人民檢察院以卷宗調查法和訪談調查法進行為期三個月的實踐調查。第三部分,集中對本調查的結果進行闡釋,并運用圖表的方式更加詳細、客觀地進行分析。其主要內容包括:天津市近五年毒品犯罪重大案件總體情況及分析,主要特點及分析,犯罪人員特征及分析,以及重大案件頻發(fā)的原因及分析。其中,天津市近五年毒品犯罪重大案件呈上升趨勢,涉案數(shù)量和涉案人數(shù)出現(xiàn)快速增長勢態(tài),禁毒形勢相當嚴峻。毒品犯罪重大案件的主要特點表現(xiàn)為出現(xiàn)越來越多隱秘化的犯罪手段,多元化的犯罪類型,多重化的毒品種類,多樣化的犯罪形式等。涉毒犯罪人員多為文化程度較低的中青年男性,外來人口比例較多,青少年和老年人比重呈上升趨勢。毒品犯罪重大案件頻發(fā)原因主要有毒品犯罪市場日益擴大,有吸毒情節(jié)的人員販毒情況嚴重;毒品犯罪打擊力度不足;新型毒品犯罪日趨嚴重;所處地理形勢較為優(yōu)越、交通發(fā)達,毒品流通便捷等。第四部分,主要就懲治重大毒品犯罪提出相應對策和建議。通過對天津市近五年毒品犯罪重大案件的調查及分析,從打擊和預防重大毒品犯罪兩個方面,有針對性地提出解決對策。一方面,加大力度并有針對性地打擊重大毒品犯罪,控制毒品的流入市場,對毒品來源開展強有力地遏制措施,緊密聯(lián)系區(qū)域內部的相互協(xié)作,建立禁毒防線;遏制新型毒品犯罪活動,揭露罪犯隱秘的作案手段,嚴格開展秘密偵查策略,構建毒品純度鑒定程序,加大對財產(chǎn)刑的適用比例和執(zhí)行力度。另一方面,加大對重大毒品犯罪案件的預防建設,組織全民開展禁毒宣傳教育,加大戒毒力度,加強戒毒機構建設,規(guī)范監(jiān)獄管理,嚴格科學進行“分管分押”,實行罪犯個案矯正,全面建設懲治重大毒品犯罪的防控體系。打擊和預防毒品犯罪一向是我國禁毒工作的核心,而懲治重大毒品犯罪更是重中之重。只有組織全社會力量全方位進行查處和整治,才能夠最大程度地遏制毒品犯罪重大案件的發(fā)生,減少犯罪人員數(shù)量,進一步改善人民的生活,促進國家經(jīng)濟的發(fā)展和社會的穩(wěn)定。
[Abstract]:Drug crime has always been the focus of crime in the world. It directly endangers the physical and mental health of the people, causes other social problems, causes great economic losses to the country and the people, and seriously hinders the stability and harmonious development of the society. In recent years, our country has increased the strength of the fight against drug crimes and the overall crime situation is good. However, the major cases of drug crime are still outstanding and the situation is not optimistic. Therefore, it is of great practical and theoretical significance to investigate and analyze the specific situation of the major cases of drug crime in our country at present, and to find out the corresponding countermeasures. This paper mainly adopts the investigation method of the file of files and the investigation method of interview. Analysis, taking the Tianjin people's Procuratorate as the investigation object, statistics and Analysis on the major cases of drug crime in 2010~2014, objectively shows the present situation of the major cases of drug crime in Tianjin, and puts forward the pertinent countermeasures and relevant suggestions.
