【摘要】：毒品犯罪一直是全世界犯罪問題的焦點(diǎn),它直接危害人民群眾的身心健康,也易引發(fā)其他社會(huì)問題,給國家和人民造成巨大的經(jīng)濟(jì)損失,嚴(yán)重阻礙了社會(huì)的穩(wěn)定、和諧發(fā)展。近年來,我國加大對(duì)毒品犯罪的打擊力度,整體犯罪形勢(shì)雖有所好轉(zhuǎn),但毒品犯罪的重大案件仍然突出,形勢(shì)不容樂觀。因此,如實(shí)反映我國目前毒品犯罪重大案件的具體現(xiàn)狀,并對(duì)其進(jìn)行調(diào)查分析,找出相應(yīng)的遏制對(duì)策,具有十分重大的實(shí)踐和理論意義。本文主要采取卷宗調(diào)查法和訪談?wù){(diào)查法進(jìn)行調(diào)查分析,以天津市人民檢察院為調(diào)查對(duì)象,對(duì)2010~2014年其所辦理的毒品犯罪重大案件進(jìn)行統(tǒng)計(jì)和分析,客觀的展現(xiàn)目前天津地區(qū)毒品犯罪重大案件的現(xiàn)狀,并提出針對(duì)性較強(qiáng)的解決對(duì)策和相關(guān)建議。本文內(nèi)容分為四個(gè)部分。第一部分,簡(jiǎn)要說明本調(diào)查報(bào)告的目的和意義,即選取天津市作為樣本地區(qū)的原因以及通過對(duì)天津市人民檢察院2010~2014年毒品犯罪重大案件的情況分析,探究該地區(qū)毒品犯罪重大案件的現(xiàn)狀和高發(fā)原因,在實(shí)踐中找出相應(yīng)的預(yù)防和遏制對(duì)策,有效降低重大毒品犯罪的發(fā)生。第二部分,對(duì)本調(diào)查報(bào)告的調(diào)查方法進(jìn)行介紹,具體包括調(diào)查時(shí)間,調(diào)查地點(diǎn)和調(diào)查方式,即在天津市人民檢察院以卷宗調(diào)查法和訪談?wù){(diào)查法進(jìn)行為期三個(gè)月的實(shí)踐調(diào)查。第三部分,集中對(duì)本調(diào)查的結(jié)果進(jìn)行闡釋,并運(yùn)用圖表的方式更加詳細(xì)、客觀地進(jìn)行分析。其主要內(nèi)容包括:天津市近五年毒品犯罪重大案件總體情況及分析,主要特點(diǎn)及分析,犯罪人員特征及分析,以及重大案件頻發(fā)的原因及分析。其中,天津市近五年毒品犯罪重大案件呈上升趨勢(shì),涉案數(shù)量和涉案人數(shù)出現(xiàn)快速增長勢(shì)態(tài),禁毒形勢(shì)相當(dāng)嚴(yán)峻。毒品犯罪重大案件的主要特點(diǎn)表現(xiàn)為出現(xiàn)越來越多隱秘化的犯罪手段,多元化的犯罪類型,多重化的毒品種類,多樣化的犯罪形式等。涉毒犯罪人員多為文化程度較低的中青年男性,外來人口比例較多,青少年和老年人比重呈上升趨勢(shì)。毒品犯罪重大案件頻發(fā)原因主要有毒品犯罪市場(chǎng)日益擴(kuò)大,有吸毒情節(jié)的人員販毒情況嚴(yán)重;毒品犯罪打擊力度不足;新型毒品犯罪日趨嚴(yán)重;所處地理形勢(shì)較為優(yōu)越、交通發(fā)達(dá),毒品流通便捷等。第四部分,主要就懲治重大毒品犯罪提出相應(yīng)對(duì)策和建議。通過對(duì)天津市近五年毒品犯罪重大案件的調(diào)查及分析,從打擊和預(yù)防重大毒品犯罪兩個(gè)方面,有針對(duì)性地提出解決對(duì)策。一方面,加大力度并有針對(duì)性地打擊重大毒品犯罪,控制毒品的流入市場(chǎng),對(duì)毒品來源開展強(qiáng)有力地遏制措施,緊密聯(lián)系區(qū)域內(nèi)部的相互協(xié)作,建立禁毒防線;遏制新型毒品犯罪活動(dòng),揭露罪犯隱秘的作案手段,嚴(yán)格開展秘密偵查策略,構(gòu)建毒品純度鑒定程序,加大對(duì)財(cái)產(chǎn)刑的適用比例和執(zhí)行力度。另一方面,加大對(duì)重大毒品犯罪案件的預(yù)防建設(shè),組織全民開展禁毒宣傳教育,加大戒毒力度,加強(qiáng)戒毒機(jī)構(gòu)建設(shè),規(guī)范監(jiān)獄管理,嚴(yán)格科學(xué)進(jìn)行“分管分押”,實(shí)行罪犯?jìng)�(gè)案矯正,全面建設(shè)懲治重大毒品犯罪的防控體系。打擊和預(yù)防毒品犯罪一向是我國禁毒工作的核心,而懲治重大毒品犯罪更是重中之重。只有組織全社會(huì)力量全方位進(jìn)行查處和整治,才能夠最大程度地遏制毒品犯罪重大案件的發(fā)生,減少犯罪人員數(shù)量,進(jìn)一步改善人民的生活,促進(jìn)國家經(jīng)濟(jì)的發(fā)展和社會(huì)的穩(wěn)定。
[Abstract]:Drug crime has always been the focus of crime in the world. It directly endangers the physical and mental health of the people, causes other social problems, causes great economic losses to the country and the people, and seriously hinders the stability and harmonious development of the society. In recent years, our country has increased the strength of the fight against drug crimes and the overall crime situation is good. However, the major cases of drug crime are still outstanding and the situation is not optimistic. Therefore, it is of great practical and theoretical significance to investigate and analyze the specific situation of the major cases of drug crime in our country at present, and to find out the corresponding countermeasures. This paper mainly adopts the investigation method of the file of files and the investigation method of interview. Analysis, taking the Tianjin people's Procuratorate as the investigation object, statistics and Analysis on the major cases of drug crime in 2010~2014, objectively shows the present situation of the major cases of drug crime in Tianjin, and puts forward the pertinent countermeasures and relevant suggestions.
