我國價格認證的問題與對策研究

【摘要】:價格認證是價格工作的重要組成部分,是在特定領域、特定時間,對特定財產(chǎn)進行的一次性定價行為,是司法、執(zhí)法活動在價格領域的延伸。目前,全國按照國家、省、市、縣四級建立價格認證機構(gòu)2980個,隸屬于各級政府價格主管部門,實行事業(yè)單位管理。2014年,全國價格認證系統(tǒng)共辦理各類刑事、紀檢、行政等案件118萬件,標的總額4274億元,為維護社會正常的經(jīng)濟秩序、有效打擊犯罪、懲治腐敗、構(gòu)建和諧社會做出了重要貢獻。十八大以來,我國的各項事業(yè)都在改革的春風中盎然推進,價格認證工作也處于風口之上。當前,價格認證工作亟需破解諸如缺失“頂層設計”,缺少操作規(guī)范,厘清工作范圍等等問題,順應市場規(guī)律辦事,真正做到市場的歸市場,政府的歸政府,凡是市場主體和社會組織不愿做、做不好、做不了或者是不適宜做、社會強烈需要價格認證機構(gòu)的交叉業(yè)務領域,價格認證機構(gòu)應果斷出擊,充分發(fā)揮政府系統(tǒng)公信、公平、公正的定位,為社會治理補位,克服市場失靈。徹底改變社會上一部分人對價格認證工作的片面認識,充分發(fā)揮好價格行政裁定的職能作用,積極承擔起“元治理”的裁判角色,把主要精力投入到涉案、涉紀、涉稅財物價格認定和對社會中介價格評估機構(gòu)的管理上來。本文嘗試從研究的角度,在宏觀政策的背景下,運用公共服務理論等相關知識,充分借鑒國內(nèi)的研究成果,批判繼承國外的工作經(jīng)驗,嘗試對價格認證路徑進行優(yōu)化提升,在理念上牢固樹立公共服務思維,在路徑中引入價格調(diào)查、價格認證聽證和檔案文書電子備案制度,在機制上進一步豐富完善價格糾紛調(diào)解制度,在模式上嘗試價格認證公共服務購買方式,試從職能定位、法制建設、清單管理、模式創(chuàng)新、機制建立等方面對價格認證進行補充和完善,期望價格認證能夠更加貼近實務工作,更加契合價格宏觀調(diào)控的需要,能夠為司法和執(zhí)法機關提供更加有力的證據(jù)支持,能夠在社會大調(diào)解中發(fā)揮更加積極有效的作用。
[Abstract]:Price authentication is an important part of price work. It is the one-off pricing behavior of a particular property in a specific field, a specific time, and an extension of judicial and law enforcement activities in the field of price. At present, 2,980 price certification institutions have been established in the whole country according to the national, provincial, municipal and county levels, which are subordinate to the price authorities at all levels and are managed by public institutions. In 2014, the national price certification system handled all kinds of criminal and disciplinary inspections. The total amount of administrative cases is 427.4 billion yuan, which has made an important contribution to maintaining social normal economic order, effectively cracking down on crime, punishing corruption and building a harmonious society. Since the 18th National Congress, China's various undertakings in the spring wind of reform, price certification work is also in the tuyere. At present, the work of price certification urgently needs to solve such problems as missing "top-level design", lack of operational norms, clarification of the scope of work, and so on, so as to comply with the laws of the market, and truly achieve the return of the market to the market, and the government to the government. All market bodies and social organizations are unwilling to do it, can't do it well, cannot do it or are unfit to do it. The society strongly needs cross-business fields of price certification bodies. Price certification agencies should resolutely attack and give full play to the public trust and fairness of the government system. Fair positioning, for social governance, overcome market failure. Thoroughly changing the one-sided understanding of price certification among some people in society, giving full play to the function of price administrative adjudication, actively taking on the role of "meta-governance" and devoting major energy to the involvement in the period, Tax-related property price determination and social intermediary price evaluation organization management. In this paper, from the perspective of research, under the background of macro policy, using public service theory and other relevant knowledge, fully learn from domestic research results, critically inherit the work experience of foreign countries, try to optimize the path of price certification. Firmly establish the public service thinking in concept, introduce price investigation, price authentication hearing and electronic filing system in the path, further enrich and perfect the price dispute mediation system in the mechanism, In the model, we try to supply and perfect the price certification from the aspects of function orientation, legal system construction, list management, model innovation, mechanism establishment, etc. It is expected that the price certification can be more close to the practical work, more in line with the needs of price macro-control, can provide more effective evidence for the judiciary and law enforcement agencies, and can play a more active and effective role in social mediation.
