【摘要】：為順應(yīng)經(jīng)濟(jì)全球化和區(qū)域經(jīng)濟(jì)一體化的潮流,中韓兩國(guó)于2015年6月1日簽署了《中華人民共和國(guó)政府和大韓民國(guó)政府自由貿(mào)易協(xié)定》,正式建立了東北亞地區(qū)第一個(gè)自由貿(mào)易區(qū),促進(jìn)東北亞區(qū)域經(jīng)濟(jì)一體化,也促進(jìn)產(chǎn)業(yè)鏈的全面融合。它的簽署對(duì)中韓兩國(guó)乃至東北亞的經(jīng)濟(jì)都起到了巨大的推動(dòng)作用。近年來(lái),對(duì)于相關(guān)服務(wù)貿(mào)易規(guī)則的研究層出不窮,本文主要研究中韓自由貿(mào)易協(xié)定中的服務(wù)貿(mào)易規(guī)則。本文共分成三大部分。第一部分是對(duì)國(guó)際服務(wù)貿(mào)易規(guī)則的簡(jiǎn)要梳理。主要分成三大方面,第一方面是多邊服務(wù)貿(mào)易規(guī)則,主要介紹了《服務(wù)貿(mào)易總協(xié)定》和《國(guó)際服務(wù)貿(mào)易協(xié)定》,前者是現(xiàn)行的多邊服務(wù)貿(mào)易規(guī)則,而后者正在談判進(jìn)行中,中國(guó)也申請(qǐng)加入其談判。第二方面是區(qū)域服務(wù)貿(mào)易規(guī)則,該部分主要從數(shù)量、分布以及簽訂的原因三個(gè)方面入手,分析區(qū)域服務(wù)貿(mào)易規(guī)則的現(xiàn)狀。第三方面是中國(guó)締結(jié)的國(guó)際服務(wù)貿(mào)易規(guī)則的概況。第二部分是本文的重點(diǎn)部分,是對(duì)中韓FTA服務(wù)貿(mào)易規(guī)則的分析。研究分析中韓FTA服務(wù)貿(mào)易規(guī)則,并將中韓FTA服務(wù)貿(mào)易規(guī)則與GATS、NAFTA中的服務(wù)貿(mào)易規(guī)則和CETA中的服務(wù)貿(mào)易規(guī)則進(jìn)行比較分析,比較分析主要從適用范圍、市場(chǎng)準(zhǔn)入規(guī)則、國(guó)民待遇規(guī)則和原產(chǎn)地規(guī)則共四個(gè)方面入手,分析出其規(guī)則的差別導(dǎo)致的對(duì)于服務(wù)市場(chǎng)開(kāi)放程度的差別及其反應(yīng)出的問(wèn)題。第三部分是對(duì)中韓FTA服務(wù)貿(mào)易規(guī)則的評(píng)價(jià)。這一部分主要對(duì)市場(chǎng)準(zhǔn)入、國(guó)民待遇及原產(chǎn)地規(guī)則這三個(gè)方面進(jìn)行評(píng)價(jià)。
[Abstract]:In order to comply with the trend of economic globalization and regional economic integration, China and South Korea signed the Free Trade Agreement between the Government of the people's Republic of China and the Government of the Republic of Korea on June 1, 2015, formally establishing the first Free Trade area in Northeast Asia. To promote regional economic integration in Northeast Asia, but also to promote the full integration of the industrial chain. Its signing has played a huge role in promoting the economy of China and South Korea, as well as Northeast Asia. In recent years, there are many researches on the rules of trade in services. This paper mainly studies the rules of trade in services in the free trade agreement between China and Korea. This paper is divided into three parts. The first part is a brief review of the rules of international trade in services. The first is the rules of multilateral trade in services, which mainly introduces the General Agreement on Trade in Services (GATS) and the Agreement on International Trade in Services, which is the current multilateral service trade rule, while the latter is under negotiation. China has also applied to join its negotiations. The second part is the rules of regional trade in services. This part analyzes the current situation of the rules of regional service trade from the aspects of quantity, distribution and reasons of signing. The third aspect is the general situation of the rules of international trade in services concluded by China. The second part is the key part of this paper, which is the analysis of China-Korea FTA service trade rules. The service trade rules of China-Korea FTA are analyzed, and the service trade rules in GATS NAFTA and CETA are compared and analyzed. The comparative analysis is mainly from the scope of application and the rules of market access. Starting with four aspects of the rules of national treatment and rules of origin, this paper analyzes the differences in the degree of openness to the service market caused by the differences in the rules and the problems reflected in them. The third part is the evaluation of China-Korea FTA service trade rules. This part mainly evaluates the three aspects of market access, national treatment and rules of origin.
