【摘要】：信貸資產(chǎn)轉(zhuǎn)讓的監(jiān)管問題應(yīng)歸屬于對影子銀行監(jiān)管的命題范疇。針對我國信貸資產(chǎn)轉(zhuǎn)讓業(yè)務(wù)的發(fā)展,央行和銀監(jiān)會采取了"疏、堵"不同的監(jiān)管路徑。通過對信貸資產(chǎn)轉(zhuǎn)讓和影子銀行的主體、客體和內(nèi)容三個要素特征的比較分析,可以發(fā)現(xiàn)現(xiàn)存的監(jiān)管制度還存有缺失,信貸資產(chǎn)轉(zhuǎn)讓監(jiān)管可以借鑒對影子銀行的監(jiān)管,在其中跨行業(yè)風險、制度變遷和金融消費者權(quán)益保護等問題仍需要進一步的立法規(guī)制。
[Abstract]:The supervision of the transfer of credit assets should belong to the subject of shadow banking supervision. In view of the development of credit asset transfer business in China, the central bank and the CBRC have adopted different ways of supervision and control. Through the comparative analysis of the characteristics of the subject, object and content of the transfer of credit assets and the shadow bank, we can find that the existing regulatory system is still lacking, and the supervision of the transfer of credit assets can draw lessons from the supervision of the shadow bank. Among them, cross-industry risks, institutional changes and financial consumer rights and interests protection and other issues still need further legislative regulation.
