醫(yī)療器械廣告法律規(guī)制研究

【摘要】:在現(xiàn)代社會(huì),隨著物質(zhì)的極大豐富,精神需求的不斷提高,人們對(duì)身體健康的重視比以往任何時(shí)候都高。醫(yī)療器械已不是醫(yī)院里的專用,現(xiàn)在很多便攜的、小型的醫(yī)療器械正在走進(jìn)千家萬戶,比如血壓計(jì)、血糖儀、制氧機(jī)、按摩器等等。隨著人們對(duì)醫(yī)療器械的需求增多,醫(yī)療器械廣告的數(shù)量呈現(xiàn)不斷上升的趨勢(shì)。而且越來越激烈的競(jìng)爭(zhēng),使得現(xiàn)在的醫(yī)療器械廣告種類繁多,方法多樣。這其中就不乏一些違法者通過不正當(dāng)手段來進(jìn)行市場(chǎng)競(jìng)爭(zhēng),獲取利益。 由于醫(yī)療器械是與人的生命和健康息息相關(guān)的特殊商品,對(duì)醫(yī)療器械廣告的法律規(guī)制就應(yīng)該非常嚴(yán)格。醫(yī)療器械廣告的內(nèi)容應(yīng)該符合法律法規(guī)的規(guī)定,必須真實(shí)、準(zhǔn)確、科學(xué),不能以任何形式欺騙或誤導(dǎo)消費(fèi)者。也正是由于醫(yī)療器械的特殊性,醫(yī)療器械廣告主體間的信息不對(duì)稱,使得消費(fèi)者處于弱勢(shì)地位。雖然我國的《廣告法》和《醫(yī)療器械監(jiān)督管理?xiàng)l例》等法律法規(guī)對(duì)醫(yī)療器械廣告有所規(guī)制,但是由于在立法上的不夠完善,執(zhí)法上的監(jiān)管不到位和相關(guān)制度的不健全,使得現(xiàn)在違法醫(yī)療器械廣告的現(xiàn)象比較嚴(yán)重。 本文從法律規(guī)制的角度,對(duì)醫(yī)療器械廣告進(jìn)行研究,主要由導(dǎo)論和四章內(nèi)容構(gòu)成。導(dǎo)論部分主要介紹本選題的緣由、研究的意義、現(xiàn)狀、創(chuàng)新點(diǎn)和存在的不足等內(nèi)容。在第一章著重介紹了醫(yī)療器械廣告和醫(yī)療器械廣告市場(chǎng)規(guī)則。第二章詳細(xì)地總結(jié)了我國醫(yī)療器械廣告法律規(guī)制的現(xiàn)狀和存在的不足。第三章是對(duì)域外醫(yī)療器械廣告法律規(guī)制的比較,找出美國、歐盟和日本等發(fā)達(dá)國家在醫(yī)療器械廣告法律規(guī)制方面的做法和特殊舉措,并結(jié)合我國的實(shí)際情況,提出能夠?yàn)槲覈M(jìn)的醫(yī)療器械廣告規(guī)制的方法。最后一章在完善和改進(jìn)我國立法、執(zhí)法以及其他配套制度方面提出了自己的建議。希望我國的醫(yī)療器械廣告市場(chǎng)能夠依法、健康、有序地發(fā)展。
[Abstract]:In modern society, people pay more attention to physical health than ever. Medical devices are no longer the exclusive use in hospitals. Now many portable, small medical devices are entering thousands of households, such as sphygmomanometers, blood sugar meters, oxygen machines, massager and so on. With the increasing demand for medical devices, the number of advertisements for medical devices is on the rise. And more fierce competition, make now the medical device advertisement kind is various, the method is diverse. Among them, there are some lawbreakers through improper means to compete in the market to obtain benefits. Because medical device is a special commodity closely related to human life and health, the legal regulation of medical device advertisement should be very strict. The content of medical device advertisement should be in accordance with the laws and regulations, must be true, accurate, scientific, can not deceive or mislead consumers in any way. Because of the particularity of medical device, the information asymmetry between the main body of medical device advertisement makes consumers in a weak position. Although some laws and regulations, such as the Advertising Law and the Regulation on Supervision and Administration of Medical Devices, regulate the advertising of medical devices, the legislation is not perfect enough, the law enforcement is not in place and the relevant systems are not perfect. So that the phenomenon of illegal advertising of medical devices is more serious. From the angle of legal regulation, this paper studies the advertisement of medical device, which is mainly composed of introduction and four chapters. The introduction part mainly introduces the reason of this topic, the significance of the research, the present situation, the innovation point and the deficiency and so on. Chapter one focuses on the introduction of medical device advertising and medical device advertising market rules. The second chapter summarizes the current situation and shortcomings of the legal regulation of medical device advertising in China. The third chapter is to compare the legal regulation of medical device advertising, find out the United States, the European Union and Japan and other developed countries in the legal regulation of medical device advertising practices and special measures, and combined with the actual situation in China. This paper puts forward the method of advertisement regulation of medical device which can be introduced for our country. The last chapter puts forward some suggestions on how to perfect and improve our legislation, law enforcement and other supporting systems. Hope our country's medical device advertisement market can legally, healthily, orderly development.
