【摘要】：隨著國內(nèi)外形勢的變化和市場競爭的日益加劇,勝利油田作為國有特大型企業(yè),內(nèi)外部經(jīng)營環(huán)境日新月異,面臨的風(fēng)險和內(nèi)外部經(jīng)營環(huán)境都發(fā)生著巨大的變化,給企業(yè)帶來了難得的發(fā)展機遇,也帶來了嚴(yán)峻的挑戰(zhàn),面臨著諸多的風(fēng)險。勝利油田生產(chǎn)經(jīng)營中存在業(yè)務(wù)環(huán)節(jié)多、勘探開發(fā)地域廣、人員分布零散、風(fēng)險源分布廣泛等特點,法律風(fēng)險高、防控難度大,法律風(fēng)險防控工作必須結(jié)合油田自身特點,打造具有實用價值、能為油田自身提供準(zhǔn)確預(yù)警信號的法律風(fēng)險管理體系。首先,本文從風(fēng)險管理的基本理論入手,吸納國際通用的風(fēng)險管理經(jīng)驗,借鑒國內(nèi)法律風(fēng)險管理的優(yōu)秀做法,在對企業(yè)法律風(fēng)險的內(nèi)涵、特點、分類等進行深入研究的基礎(chǔ)上,總結(jié)了法律風(fēng)險防控源點的分布狀況及應(yīng)對策略的選擇,探索研究確定適用于勝利油田法律風(fēng)險防控管理工作的思路和方法。其次,立足于勝利油田生產(chǎn)經(jīng)營的實際需求和客觀現(xiàn)實,在分析油田法律風(fēng)險管理現(xiàn)狀的基礎(chǔ)上,針對目前法律風(fēng)險管理工作中存在的不足,從總體思路、基本原則、管理目標(biāo)、組織體系和流程設(shè)計等方面全面搭建,提出了一套滲透勝利油田生產(chǎn)經(jīng)營各領(lǐng)域和業(yè)務(wù)環(huán)節(jié)、縱橫結(jié)合、全員動態(tài)實施的法律風(fēng)險管理體系架構(gòu)。最后,從勝利油田角度出發(fā),以培養(yǎng)全員風(fēng)險意識為先導(dǎo),與油田內(nèi)部內(nèi)控體系相對接,在強化法律風(fēng)險管理基礎(chǔ)支持體系,培育法律風(fēng)險管理文化,注重法律風(fēng)險預(yù)警信息發(fā)布等方面提出落實全面法律風(fēng)險管理的保障措施和建議,以此進一步推動勝利油田法律風(fēng)險管理水平的整體提高,為勝利油田科學(xué)、和諧、可持續(xù)發(fā)展提供有力的法律支撐和保障。
[Abstract]:With the change of domestic and international situation and the increasingly fierce market competition, Shengli Oilfield, as a large state-owned enterprise, is facing great changes in its internal and external business environment. To the enterprise has brought rare development opportunity, also has brought the stern challenge, faces many risks. There are many business links in the production and management of Shengli Oilfield, wide exploration and development area, scattered distribution of personnel, wide distribution of risk sources, high legal risk, great difficulty in prevention and control, and the legal risk prevention and control work must be combined with the characteristics of the oil field itself. To create a legal risk management system with practical value, which can provide accurate warning signal for oil field itself. First of all, this paper starts with the basic theory of risk management, absorbs the international common experience of risk management, draws lessons from the excellent practice of domestic legal risk management, and makes a thorough study on the connotation, characteristics and classification of the enterprise legal risk. This paper summarizes the distribution of legal risk prevention and control source points and the selection of countermeasures, and explores the ideas and methods suitable for the legal risk prevention and control work in Shengli Oilfield. Secondly, based on the actual demand and objective reality of production and management in Shengli Oilfield, on the basis of analyzing the present situation of legal risk management in oilfields, aiming at the shortcomings of the current legal risk management, the general thinking and basic principles are discussed. The management goal, organization system and process design are set up in an all-round way, and a set of legal risk management system architecture is put forward, which integrates the production and operation fields and business links of Shengli Oilfield, integrates the vertical and horizontal, and implements the whole staff dynamically. Finally, from the point of view of Shengli Oilfield, taking cultivating the risk consciousness of all staff as the forerunner, docking with the internal control system of oil field, strengthening the basic support system of legal risk management and cultivating the culture of legal risk management, Pay attention to the legal risk early warning information release and put forward the safeguard measures and suggestions to implement the comprehensive legal risk management, so as to further promote the overall improvement of the level of legal risk management in Shengli Oilfield, in order to promote the science and harmony of Shengli Oilfield, Sustainable development provides strong legal support and protection.
