【摘要】：食品是人類生存和發(fā)展的前提保障,一個(gè)國(guó)家的食品消費(fèi)水平顯示一個(gè)國(guó)家的文明程度和綜合實(shí)力。中國(guó)自改革開放以來在食品行業(yè)取得了飛速發(fā)展，行業(yè)板塊的整合、國(guó)家政策的推進(jìn)、外資企業(yè)的注入共同為食品市場(chǎng)的多元化發(fā)展提供強(qiáng)有力的保障，使食品市場(chǎng)已經(jīng)從基本的生存需求向更高的生活質(zhì)量需求轉(zhuǎn)變。在食品產(chǎn)業(yè)飛速發(fā)展的同時(shí)，食品安全問題日益突出，近年來不斷爆出“一滴香”、“毒牛奶”、“毒韭菜”、“瘦肉精”、“地溝油”、“避孕藥黃瓜”以及濫用食品添加劑，，轉(zhuǎn)基因食品等一系列食品安全問題，對(duì)食品市場(chǎng)造成破壞性的沖擊，給人民群眾的生命健康帶來巨大的威脅。在政府決心整治食品市場(chǎng)的同時(shí)，傳統(tǒng)食品市場(chǎng)又轉(zhuǎn)向一個(gè)新的市場(chǎng)領(lǐng)域—互聯(lián)網(wǎng)市場(chǎng)。由于互聯(lián)網(wǎng)的虛擬性和廣域性，使食品在交易過程中更加隱蔽，導(dǎo)致食品質(zhì)量監(jiān)督不到位、食品安全監(jiān)管體系落后、網(wǎng)絡(luò)市場(chǎng)規(guī)范化經(jīng)營(yíng)管理不細(xì)致，同時(shí)部分網(wǎng)店食品經(jīng)營(yíng)者誠(chéng)信缺失，道德素質(zhì)參差不齊，行業(yè)自律性差，造成大部分不良商家和企業(yè)利用互聯(lián)網(wǎng)的虛擬性隱匿在網(wǎng)絡(luò)環(huán)境中攫取利益最大化不斷危害食品安全市場(chǎng)，給原本嚴(yán)峻的食品安全問題提出了更高的挑戰(zhàn)。在面對(duì)新形勢(shì)下的食品行業(yè)發(fā)展環(huán)境下，如何在促進(jìn)多元化食品經(jīng)濟(jì)市場(chǎng)健康發(fā)展的同時(shí)做好切實(shí)維護(hù)食品市場(chǎng)的安全監(jiān)管成為我國(guó)目前急待解決的民生問題。我國(guó)目前對(duì)食品安全監(jiān)管主要通過工商、質(zhì)檢等部門實(shí)施有形監(jiān)管，對(duì)虛擬的網(wǎng)絡(luò)食品交易市場(chǎng)監(jiān)管不僅從監(jiān)管體系還是技術(shù)層面都缺乏有效的監(jiān)管手段來應(yīng)對(duì)，在法律層面上我國(guó)現(xiàn)行法律法規(guī)也還沒有針對(duì)網(wǎng)絡(luò)食品交易的專項(xiàng)法律，由于缺乏專門的法律約束，給網(wǎng)絡(luò)食品交易的監(jiān)管執(zhí)法帶來許多困難與不確定因素。綜合來看，如何有效監(jiān)管網(wǎng)購(gòu)食品安全問題成為當(dāng)下完善和保障網(wǎng)絡(luò)市場(chǎng)健康持續(xù)發(fā)展急待解決的任務(wù)。本文將從網(wǎng)購(gòu)食品安全監(jiān)管這一角度進(jìn)行分析，對(duì)比國(guó)外對(duì)網(wǎng)絡(luò)食品交易安全監(jiān)管對(duì)策，尋找我國(guó)監(jiān)管過程中存在的問題，從完善監(jiān)管體制和建設(shè)道德誠(chéng)信體系兩方面入手，探索完善網(wǎng)絡(luò)食品安全監(jiān)管途徑以促進(jìn)網(wǎng)絡(luò)食品交易的合法健康發(fā)展。
[Abstract]:Food is the premise of human survival and development, a country's food consumption level shows a country's civilization and comprehensive strength. China has made rapid development in the food industry since the reform and opening up. The integration of the industry sector, the promotion of national policies, and the injection of foreign-funded enterprises together provide a strong guarantee for the diversified development of the food market. The food market has changed from the basic living demand to the higher quality of life demand. With the rapid development of the food industry, food safety problems have become increasingly prominent, in recent years, "a drop of incense" has been constantly burst out. "poisonous milk", "poisonous leek", "lean meat essence", "gutter oil", "contraceptive pill cucumber" and misuse of food additives, genetically modified food and a series of food safety issues. At the same time, the government is determined to regulate the food market while the government is determined to clean up the food market while bringing a great threat to the lives and health of the people. The traditional food market has turned to a new market field, the Internet market. Because of the virtual and wide area of the Internet, food is more hidden in the course of trade, resulting in food quality supervision is not in place. The food safety supervision system is backward, the network market standardized management is not meticulous, at the same time some online store food operators lack of integrity, the moral quality is not uniform, the industry self-discipline is poor. As a result, most of the bad businesses and enterprises use the virtual nature of the Internet to hide in the network environment to maximize the benefits of the harm to food safety market. To the original severe food safety problems put forward a higher challenge. In the face of the new situation in the food industry development environment. How to promote the healthy development of the diversified food economy market at the same time to do a good job in maintaining the food market safety supervision has become an urgent livelihood issue to be solved in our country at present, the food safety supervision in China is mainly through industry and commerce. Quality inspection and other departments to implement tangible supervision, the virtual network of food trading market supervision not only from the regulatory system or technical aspects of the lack of effective regulatory means to deal with. At the legal level, China's current laws and regulations have not been targeted at the network of food trading special laws, due to the lack of special legal constraints. It brings a lot of difficulties and uncertainties to the supervision and enforcement of online food transactions. How to effectively supervise online food safety has become an urgent task to improve and ensure the healthy and sustainable development of online market. This paper will analyze the problem from the perspective of online food safety supervision. Compared with the foreign regulatory measures for online food trading safety, looking for the problems in the process of supervision in China, from the improvement of the regulatory system and the construction of moral integrity system two aspects. In order to promote the legal and healthy development of online food trade, we should explore the ways to improve the supervision of online food safety.
