【摘要】：近年來，“三聚氰胺”、“瘦肉精”、“塑化劑”等系列食品安全事件的發(fā)生標示著我國食品安全問題依然嚴峻，而探究西方國家食品安全監(jiān)管體制的經驗，，不難發(fā)現(xiàn)第三方作為重要的參與主體已得到諸多國家的認可。本研究正是基于以上背景對我國食品安全監(jiān)管體制存在的問題進行分析和探索，希冀進一步完善我國食品安全監(jiān)管體制。 本文認為食品安全監(jiān)管體制中第三方參與的缺失或不到位是當前食品安全監(jiān)管問題屢屢發(fā)生的癥結所在。通過對我國當前食品安全監(jiān)管體制運行現(xiàn)狀的分析，揭示其存在的不足，并且通過博弈理論分析和MATLAB7.0模擬實驗，論證第三方參與食品安全監(jiān)管的有效性，進而提出我國食品安全監(jiān)管體制的變革路徑必須包括第三方主體。且對監(jiān)管體制的變革路徑、變革方式指明了方向，提出通過食品安全監(jiān)管體制的漸進性改革，逐步邁向相對單一的第三方充分參與的食品安全監(jiān)管體系，在這一體系變革中必須通過完善制度保障，明確第三方參與的法律地位；通過公共協(xié)商，型構第三方參與的協(xié)商機制；建立第三方參與的信息處理系統(tǒng)，暢通信息渠道；培育第三方主體，塑造其參與能力來完善我國食品安全監(jiān)管體制，提升食品安全監(jiān)管的效果。最后，對新的食品安全監(jiān)管體系運行過程中可能遇到的問題進行了剖析。
[Abstract]:In recent years, the "melamine", "Clenbuterol", "plasticizer" series of food safety incidents happened in China marked the food safety problem is still severe, and explore the western food safety supervision system of experience, it is not difficult to find the third party as an important participant has got many national recognition. This research is based on the above background analysis and exploration of the existing food safety supervision system in our country, hoping to further improve China's food safety regulatory system.
The lack of third party participation in food safety supervision system is not in place or the supervision of food safety problems often occur the crux of the problem. Through the analysis of China's current food safety regulatory system operation status, reveals the existing problems, and through game theory analysis and MATLAB7.0 simulation experiments demonstrate the effectiveness of third party participation the food safety supervision, and puts forward the reform path of China's food safety regulatory system must include third parts. And the change path of the supervision system, pointed out the direction of reform, put forward through the gradual reform of food safety supervision system, food safety supervision system is gradually moving towards relative to a single third party to fully participate in the reform. This system must improve the system security, a clear legal status of the third party; through public consultation, the participation of the third party The negotiation mechanism; establish information system of third party participation, smooth channels of information; cultivate third parties, shaping their participation ability to improve our food safety regulatory system, improve food safety regulatory effects. Finally, analyzes the possible operation of food safety supervision system in the process of new problems.
