【摘要】:隨著市場經(jīng)濟的日益成熟以及用工制度改革的深度推進,我國勞動力市場主體的自主地位日益確立,勞務派遣作為靈活用工形式的代表,已被越來越多的組織所采用。由于勞務派遣市場的不成熟和相關法規(guī)的不健全,勞務派遣在提供靈活、高效、低風險的人力資本的同時,也給組織管理帶來許多新問題。因此,作為用工企業(yè),需要清晰勞務派遣用工模式的優(yōu)劣勢,并揚長避短,規(guī)范勞務派遣用工。本文采用理論與實際相結(jié)合、定性與定量相結(jié)合、訪談調(diào)查等研究方式,對比了勞務派遣用工與傳統(tǒng)用工的區(qū)別,調(diào)查研究了勞務派遣用工的產(chǎn)生背景、發(fā)展現(xiàn)狀及相關法律法規(guī)建設情況,客觀分析了勞務派遣制度的優(yōu)劣勢以及企業(yè)在使用勞務派遣用工過程中存在的問題,提出了規(guī)范勞務派遣的對策,得出規(guī)范勞務派遣,要從完善薪酬制度、完善人才晉升通道、加強企業(yè)文化建設、加強教育培訓等方面著手,同時還要注意合理規(guī)避勞務派遣使用過程中的法律風險,要選擇合適的崗位和員工作為勞務派遣的對象,選擇正規(guī)的勞務派遣單位,完善勞務派遣制度的結(jié)論。
[Abstract]:With the maturity of the market economy and the further promotion of the reform of the employment system, the independent position of the main body of labor market in China is increasingly established. Labor dispatch as a representative of flexible labor form has been adopted by more and more organizations. Due to the immaturity of labor dispatch market and the lack of relevant regulations, labor dispatching provides flexible, efficient and low risk human capital, but also brings new problems to organization management. Therefore, as a labor enterprise, it is necessary to clear the advantages and disadvantages of the mode of labor dispatch and labor, and to avoid the shortcomings and standardize the labor dispatch. This paper adopts the combination of theory and practice, qualitative analysis and quantitative analysis, interviews and other research methods, the comparison between the labor dispatch and traditional employment, investigation and study of the labor dispatching the construction background, development status and relevant laws and regulations, objective analysis of the labor dispatch system, the advantages and disadvantages of the existing labor dispatch enterprises in the process of the problems in the use of labor, and puts forward some countermeasures to regulate labor dispatch, the norms of labor dispatch, to proceed from the perfect salary system, improve the talent promotion channels, strengthen the construction of enterprise culture, strengthen education and training, but also pay attention to avoid the legal risk of labor dispatch in the process of using the object, select the appropriate jobs and employees as labor dispatch, select the regular labor dispatch unit, improving the labor dispatch system conclusion.
