【摘要】：任何一個產(chǎn)業(yè)的發(fā)展都離不開法律制度的保障作用,沒有法律作為支持和保障的產(chǎn)業(yè)發(fā)展肯定是無以為繼的。在《文化產(chǎn)業(yè)促進法》面臨著諸多困難,短時間內(nèi)無法出臺的背景下,文化產(chǎn)業(yè)的特殊性和多元性決定了幅員遼闊的我國需要各地方制定符合本地區(qū)實際的文化產(chǎn)業(yè)立法。我們可以依據(jù)國內(nèi)率先制定文化產(chǎn)業(yè)立法的深圳和以文化產(chǎn)業(yè)資助制度聞名的法國為借鑒,探尋地方文化產(chǎn)業(yè)立法的原則、立足點和突破口,以實現(xiàn)對文化產(chǎn)業(yè)的強而有力的法律保障。
[Abstract]:The development of any industry can not be separated from the safeguard function of the legal system. The development of the industry without the support and protection of the law is certainly unsustainable. In the Cultural Industry Promotion Law, there are many difficulties. In a context where it is not possible to introduce in a short period of time, The particularity and diversity of the cultural industry determine that our vast territory needs to formulate local legislation on cultural industry in accordance with the actual situation in the region. We can take the lead in making legislation on the cultural industry in Shenzhen and in Shenzhen with cultural products in our country. For reference, France, which is famous for its financial aid system, This paper explores the principle, foothold and breakthrough of local cultural industry legislation in order to realize strong and powerful legal protection for cultural industry.
