【摘要】：我國煤層氣儲量極為豐富,產(chǎn)業(yè)化發(fā)展水平卻較低,這與產(chǎn)業(yè)發(fā)展的法治環(huán)境有直接關(guān)系。產(chǎn)業(yè)法治環(huán)境主要包括立法法治環(huán)境、金融法治環(huán)境、財政法治環(huán)境、市場管理法治環(huán)境。本文對美國、加拿大、澳大利亞、德國發(fā)達(dá)國家煤層氣產(chǎn)業(yè)法治環(huán)境考察之后,發(fā)現(xiàn)上述國家煤層氣產(chǎn)業(yè)法治環(huán)境具有立法完備、投融資渠道暢通、財稅支持積極、市場化運作成熟的特點。我國煤層氣產(chǎn)業(yè)需要汲取域外國家經(jīng)驗,填補產(chǎn)業(yè)立法空白、提升立法層級;建立獎勵(或補貼)機制、搭建多元化投融資平臺;簡化財稅優(yōu)惠實施程序、提升政策激勵度;打破管道壟斷、鼓勵市場競爭、氣價實行市場調(diào)節(jié),從立法、金融、財稅、市場管理多角度完善產(chǎn)業(yè)法治環(huán)境。
[Abstract]:The reserves of coal bed methane in our country are extremely rich, but the level of industrialization development is low, which is directly related to the legal environment of industrial development, which mainly includes the legal environment of legislation, the environment of financial rule of law, the environment of financial rule of law, and the environment of financial rule of law. Based on the investigation of the legal environment of coalbed methane industry in the developed countries of the United States, Canada, Australia and Germany, it is found that the legal environment of the coal bed methane industry in the above countries has complete legislation and smooth channels of investment and financing. China's coalbed methane industry needs to draw on the experience of foreign countries, fill in the blank of industry legislation, promote the legislative level, establish a mechanism of reward (or subsidy), and build a diversified investment and financing platform. To simplify the procedure of preferential implementation of fiscal and taxation, to promote policy incentives, to break the monopoly of pipelines, to encourage market competition, to regulate gas prices in the market, and to perfect the legal environment of industry from the aspects of legislation, finance, finance, taxation and market management.
