【摘要】：高新技術(shù)產(chǎn)業(yè)是近年來新興的產(chǎn)業(yè)，，和以此技術(shù)為支撐生產(chǎn)出來的產(chǎn)品銷售和相應(yīng)服務(wù)的相關(guān)綜合企業(yè)的集合。高新技術(shù)產(chǎn)業(yè)的發(fā)展中最核心也是最辛苦的就是對技術(shù)的開發(fā)研究，如果能夠順利開發(fā)出對社會發(fā)展有益的高新技術(shù)，那么之后帶來的社會和經(jīng)濟效益是非�？捎^的。沈陽作為遼寧省的省會，以重工業(yè)裝備制造著名，它的發(fā)展能夠帶動其他周邊城市的發(fā)展。而高新技術(shù)產(chǎn)業(yè)作為一種新興產(chǎn)業(yè)，它的發(fā)展對一座城市的發(fā)展有著至關(guān)重要的作用。高新技術(shù)產(chǎn)業(yè)是推動社會經(jīng)濟發(fā)展的主要引擎，它的發(fā)展水平高與低是衡量一個城市進步的重要標(biāo)志。 沈陽在發(fā)展高新技術(shù)產(chǎn)業(yè)的過程中，雖然已經(jīng)形成了一定規(guī)模的高新技術(shù)產(chǎn)業(yè)化群體，高技術(shù)、高投入也給企業(yè)帶來了很多的回報，但是我市高新技術(shù)行業(yè)尖端產(chǎn)品開發(fā)力量相對薄弱，產(chǎn)品附加值較低，缺乏市場競爭力；高比例的機械產(chǎn)品、電子信息類和生物科技類技術(shù)產(chǎn)品所占產(chǎn)值相對較小，需要對其內(nèi)部結(jié)構(gòu)進行更加合理的改善。因此，運用法律的手段使其更好的發(fā)展，已經(jīng)成為我們必須研究思考的問題。 為了更好的保障高新技術(shù)產(chǎn)業(yè)的快速健康發(fā)展，我們應(yīng)該從法律方便給予保障。如何更好的推動高新技術(shù)產(chǎn)業(yè)健康有序的發(fā)展并為其提供法律制度支撐，已成為當(dāng)前亟待解決的社會問題。文章的第一部分從高新技術(shù)產(chǎn)業(yè)的內(nèi)涵以及發(fā)展?fàn)顩r入手，對高新技術(shù)產(chǎn)業(yè)的立法進行理論研究。第二部分對沈陽市高新技術(shù)產(chǎn)業(yè)的現(xiàn)狀及存在問題進行具體分析，闡明建立法律制度的必要性和緊迫性。第三部分運用比較分析的方法，對國內(nèi)外關(guān)于發(fā)展高新技術(shù)產(chǎn)業(yè)立法實踐進行對比，從中歸納出可借鑒的立法經(jīng)驗和啟示。第四部分，也是文章的最重要的部分，從制度建設(shè)入手，構(gòu)建沈陽市發(fā)展高新技術(shù)產(chǎn)業(yè)的民事法律體系，提出沈陽市發(fā)展高新技術(shù)產(chǎn)業(yè)的各種民事法律制度。筆者希望通過本文的研究，針對當(dāng)前沈陽市高新技術(shù)產(chǎn)業(yè)在發(fā)展過程中暴露的民事法律問題，提出促進和完善沈陽市高新技術(shù)產(chǎn)業(yè)發(fā)展的建議和實施方法，使其能夠健康，穩(wěn)定的發(fā)展并最終實現(xiàn)整個沈陽市經(jīng)濟的全面提高。同時對高新技術(shù)產(chǎn)業(yè)的推動還有助于提升我市在全國高新技術(shù)產(chǎn)業(yè)發(fā)展上的地位，促進社會經(jīng)濟的快速發(fā)展。
[Abstract]:High-tech industry is a newly emerging industry in recent years. And a collection of related comprehensive enterprises that support the product sales and corresponding services produced by this technology. The core and hardest part of the development of the high-tech industry is the development and research of the technology. If high and new technologies that are beneficial to social development can be successfully developed, then the social and economic benefits will be very considerable. Shenyang, as the capital of Liaoning Province, is famous for manufacturing heavy industrial equipment. Its development can promote the development of other neighboring cities. As a new industry, the development of high-tech industry plays a vital role in the development of a city. High-tech industry is the main engine to promote social and economic development. Its development level is high and low is an important symbol to measure the progress of a city. In the process of developing high and new technology industries, although Shenyang has already formed a certain scale of high and new technology industrialization groups, high technology and high investment have also brought a lot of returns to the enterprises. However, the development power of advanced products in our high-tech industry is relatively weak, the added value of products is relatively low, and the market competitiveness is lacking, and the output value of high proportion of mechanical products, electronic information products and biological technology products is relatively small. Therefore, the use of legal means to make its better development, has become a problem that we must study and think about. In order to better ensure the rapid and healthy development of high-tech industry, we should guarantee it from the legal convenience. How to better promote the healthy and orderly development of high-tech industry and provide legal system support for it, The first part of the article begins with the connotation and development of high-tech industry. The second part makes a concrete analysis of the present situation and existing problems of high-tech industry in Shenyang, and expounds the necessity and urgency of establishing the legal system. The third part uses the method of comparative analysis. By comparing the legislative practice of developing high-tech industries at home and abroad, the author concludes the legislative experience and enlightenment that can be used for reference. Part 4th, which is also the most important part of the article, starts with the construction of the system. To construct a civil legal system for the development of high-tech industries in Shenyang, and to put forward various civil legal systems for the development of high-tech industries in Shenyang. In view of the civil and legal problems exposed during the development of high and new technology industries in Shenyang, suggestions and implementation methods for promoting and perfecting the development of high and new technology industries in Shenyang are put forward, so that they can be healthy. At the same time, the promotion of high-tech industry will help to promote the status of our city in the development of national high-tech industry and promote the rapid development of social economy.
