【摘要】：“國之以民為本,民之以食為天”,在物質(zhì)生活資料極具貧乏的封建時(shí)代,解決食物問題固然被奉到至高無上的位置。然而,即便是在物質(zhì)生活資料高度發(fā)達(dá)的現(xiàn)當(dāng)代,食物問題依然值得我們每個(gè)人的高度重視。伴隨人類社會的不斷發(fā)展,供于人類享用的食品品種琳瑯滿目。然而,相對于舊時(shí)代而言,如今涉及到食品的問題更是不計(jì)其數(shù),甚至關(guān)乎民生國計(jì),之中涉及到食品衛(wèi)生與食品健康的問題尤為突出。因此,綠色食品這一食物領(lǐng)域的新鮮事物便于上世紀(jì)三四十年代應(yīng)運(yùn)而生。綠色食品的出現(xiàn),不僅順應(yīng)了時(shí)代呼聲,符合大眾的生活需要,而且在某種程度上緩解了當(dāng)前嚴(yán)峻的生態(tài)和環(huán)境問題,以及生態(tài)與環(huán)境污染的整治等。如讓該新生食物市場得以健康有序發(fā)展,必然要建立相應(yīng)的機(jī)制。本文順應(yīng)時(shí)代潮流,秉持可持續(xù)發(fā)展及生態(tài)文明理念,旨在構(gòu)建一部符合我國基本國情,并有利于西藏自治區(qū)綠色食品產(chǎn)業(yè)發(fā)展的綠色食品法律制度。整篇文章分為五大部分,第一部分是緒論,在該部分介紹了選題的由來,選題的目的與意義,關(guān)于該選題的國內(nèi)外研究現(xiàn)狀,以及論文的寫方法和創(chuàng)新點(diǎn)等內(nèi)容。第二部分是西藏自治區(qū)綠色食品產(chǎn)業(yè)發(fā)展及其保護(hù)的現(xiàn)狀,主要闡釋了綠色食品名稱的由來,綠色食品的的界定、特征與分類。用簡單概括的語言,介紹國內(nèi)外關(guān)于該名詞的不同稱謂,外延內(nèi)涵等,旨在為本文確立一個(gè)研究核心對象,防止讀者對研究內(nèi)容產(chǎn)生偏差。第三部分重點(diǎn)介紹了西藏自治區(qū)綠色食品產(chǎn)業(yè)立法現(xiàn)狀。目前我國及我區(qū)綠色食品相關(guān)的法律法規(guī),主要包括《綠色產(chǎn)品認(rèn)證實(shí)施規(guī)則》、《綠色產(chǎn)品認(rèn)證管理辦法》、《食品安全法》、《中華人民共和國認(rèn)證認(rèn)可條例》、《西藏自治區(qū)實(shí)施中華人民共和國食品衛(wèi)生法辦法》等,并指出西藏綠色食品存在的不足與問題,西藏地區(qū)缺乏一部統(tǒng)一指導(dǎo)綠色食品產(chǎn)業(yè)的法律以及綠色食品標(biāo)準(zhǔn)體系規(guī)范等。第四部分介紹國外綠色食品立法經(jīng)驗(yàn)與借鑒。大致從歐盟綠色食品立法原則、審批制度、綠色食品標(biāo)識、綠色食品溯源等角度,對歐盟綠色食品相關(guān)法律制度進(jìn)行介紹和評議,尤其重點(diǎn)是歐盟地區(qū)的《新綠色農(nóng)業(yè)法》,分析出歐盟綠色食品立法的利弊之處,以致為西藏綠色食品立法提供參考與借鑒。(1)第五部分是建立西藏綠色食品立法的建議,文章從立法思想與原則、許可認(rèn)證體系、標(biāo)識體系、質(zhì)量安全、追溯體系及互聯(lián)網(wǎng)共享的安全信息平臺、邊境貿(mào)易口岸準(zhǔn)則及價(jià)格體系、公眾參與制度、責(zé)任制度等七個(gè)方面著手,具體論述了對西藏自治區(qū)建立綠色食品產(chǎn)業(yè)立法構(gòu)想。綠色食品產(chǎn)業(yè)立法不是一蹴而就的,它是一個(gè)長期的工程,需要社會的各個(gè)方面齊心協(xié)力,共同獻(xiàn)計(jì)獻(xiàn)策才能完成。本文作者試圖以我國當(dāng)前現(xiàn)行法律法規(guī)為出發(fā)點(diǎn),積極大膽吸納和借鑒他國先進(jìn)立法經(jīng)驗(yàn),在此基礎(chǔ)上,總結(jié)分析出建立西藏自治區(qū)綠色食品產(chǎn)業(yè)立法的理論基礎(chǔ)與框架結(jié)構(gòu),期望能為推動西藏綠色食品產(chǎn)業(yè)立法做出自己的微小貢獻(xiàn)。
[Abstract]:"The country to the people, the people to eat", in the feudal era, material life very poor, solve the food problem is regarded to the supreme position. However, even in the highly developed material life at the present time, the food problem is still worthy of our attention each individual. With the continuous development of human beings in the human society, and enjoy the food varieties. However, compared to the old age of a superb collection of beautiful things, and now involves the food problem is too many to count, even for the national welfare and the people's livelihood is involved in food hygiene, food and health issues are particularly prominent. Therefore, this field of green food food fresh things to appear century 30s and 40s came into being. Green food, not only conforms to the call of the times, in line with the public's needs, but also alleviate the current severe ecological and to some extent Environmental problem and ecological and environmental pollution remediation. As the new food market to make healthy and orderly development, must establish corresponding mechanism. In this paper, the trend of the times, adhere to sustainable development and the concept of ecological civilization, to build a line with China's basic national conditions, and is conducive to the development of the legal system of green food green food industry the Tibet autonomous region. The whole article is divided into five parts. The first part is the introduction, this part introduces the origin of the topic, the purpose and significance of the topic, the topic about the research status at home and abroad, as well as the writing methods and innovation. The second part is the current situation of the development and protection of the green food industry in Tibet the autonomous region, mainly explains the origin of the name of the green food, green food and the definition, characteristics and classification. Using simple language, introduced at home and abroad on the different terms Appellation, connotation, aims to establish a core research object for this paper to prevent the deviation of readers research content. The third part focuses on the legislative status of green food industry in Tibet autonomous region. At present our country and the region of green food related laws and regulations, including the implementation of Green Product Certification Rules > < < Management. To the certification of green products >, < > < People's Republic of China food safety law, certification and accreditation Ordinance, "the Tibet autonomous region People's Republic of China implementation measures on the food hygiene law, and points out the deficiencies and problems of green food in Tibet Tibet area, the lack of a unified guidance law of green food industry and green food standard system specification fourth. (1) the fifth part is the establishment of the Tibet green food legislation, article from the legislative idea and principle, licensing system, identification system, quality and safety traceability, safety information system and Internet sharing, border trade port standards and price system, public participation system, responsibility system and other seven aspects, discusses the establishment of green food industry legislation of the Tibet autonomous region of green food industry. The legislation is not easy, it is a long-term project, need to work together in all aspects of society, common brainstorming to complete. The author attempts to our country The current laws and regulations as the starting point, and actively absorb bold to learn foreign advanced legislative experience, on this basis, summarizes the theoretical basis and framework of green food industry in Tibet autonomous region legislation, is expected to make a small contribution to promote their Tibet green food industry legislation.
