【摘要】：保障房制度是我國(guó)社會(huì)保障制度的重要組成部分,其運(yùn)行的成功與否關(guān)系著社會(huì)保障體系的完善程度。自2013年12月住建部《關(guān)于公共租賃住房和廉租住房并軌運(yùn)行的通知》要求將廉租房納入公共租賃住房體系,“公共租賃住房”作為住房保障體系的全新形式進(jìn)入人們的視野,并對(duì)我國(guó)的住房保障體系建設(shè)帶來(lái)的深遠(yuǎn)的影響。目前我國(guó)的保障房制度依然存在著諸多問(wèn)題,特別是公共租賃住房的退出機(jī)制問(wèn)題,一直沒(méi)能得到很好的解決。在住房制度并軌的背景下,這一問(wèn)題將更加復(fù)雜。鄭州市是我國(guó)實(shí)行公共租賃住房并軌改革較早的城市之一,也是實(shí)行三合一改革為數(shù)不多的城市。該研究以鄭州市為例,對(duì)退出機(jī)制現(xiàn)狀以及退出機(jī)制本身及運(yùn)行過(guò)程進(jìn)行了深入分析,認(rèn)為鄭州市的公共租賃住房退出機(jī)制及運(yùn)行中存在立法滯后、虛假信息以及缺乏社會(huì)監(jiān)督和公民意識(shí)等一系列有待解決的問(wèn)題。接下來(lái)文章對(duì)這些問(wèn)題背后的深層原因進(jìn)行了分析,并根據(jù)分析結(jié)果給出了相應(yīng)的解決對(duì)策。鑒于鄭州市公共租賃住房改革較早,這一樣本在我國(guó)城市特別是大中城市公共租賃住房退出領(lǐng)域具有較為普遍的代表性,因此文章在鄭州市改革樣本的基礎(chǔ)上,對(duì)我國(guó)公共租賃住房退出機(jī)制的完善方面進(jìn)行了進(jìn)一步探索,并在法律制定、保障對(duì)象、制度建設(shè)等方面提出了改革建議,這些建議不僅對(duì)其他城市的公共租賃住房退出機(jī)制的完善具有一定的借鑒價(jià)值,同時(shí)也提高了論文結(jié)論的適用性和理論價(jià)值。
[Abstract]:Indemnificatory apartment system is an important part of social security system in our country. The success of its operation is related to the perfection of social security system. Since December 2013, the Circular of the Ministry of Housing and Construction on the Integrated Operation of Public Rental Housing and Low-Rent Housing requires the integration of low-rent housing into the public rental housing system, and "public rental housing" has entered people's view as a completely new form of housing security system, And to our country housing security system construction brings the profound influence. At present, there are still many problems in indemnificatory apartment system, especially the exit mechanism of public rental housing, which has not been solved well. In the housing system of the background, this issue will be more complex. Zhengzhou is one of the early cities to carry out the reform of public rental housing, and it is also one of the few cities to implement the three-in-one reform. Taking Zhengzhou as an example, this paper makes a deep analysis of the current situation of the exit mechanism, the exit mechanism itself and the operation process, and concludes that there is a lag in legislation in the exit mechanism and operation of public rental housing in Zhengzhou. False information and lack of social supervision and civic awareness are a series of problems to be solved. Then the paper analyzes the underlying causes of these problems, and gives the corresponding solutions according to the analysis results. In view of the relatively early reform of public rental housing in Zhengzhou, this sample is generally representative in the field of public rental housing withdrawal in Chinese cities, especially in large and medium-sized cities. This paper makes further exploration on the perfection of the withdrawal mechanism of public rental housing in China, and puts forward some reform suggestions in the aspects of making laws, protecting objects and building systems, etc. These suggestions not only have some reference value for the improvement of the withdrawal mechanism of public rental housing in other cities, but also improve the applicability and theoretical value of the conclusions of the paper.
