【摘要】：食品安全規(guī)制是個(gè)復(fù)雜的社會(huì)問(wèn)題,在規(guī)制過(guò)程中涉及政府部門(mén)、生產(chǎn)者和經(jīng)營(yíng)者、行業(yè)組織、消費(fèi)者等多個(gè)主體。不同的主體在食品安全治理目標(biāo)上是一致的,由此可以建立社會(huì)共治體系,發(fā)揮共治主體的合力。鑒于此,本文通過(guò)美國(guó)、歐盟食品安全規(guī)制的社會(huì)共治體系的法律依據(jù)和治理主體的職權(quán),分析兩個(gè)國(guó)家和地區(qū)在食品安全共治體系上的差異和相同點(diǎn)。進(jìn)而得出,中國(guó)需要發(fā)揮政府部門(mén)治理主體的合力、推進(jìn)共治法律體系的規(guī)制效應(yīng)以及引導(dǎo)社會(huì)共治多元主體的合作參與。
[Abstract]:Food safety regulation is a complicated social problem, which involves government departments, producers and operators, industry organizations, consumers and so on. Different subjects have the same goal of food safety governance, so they can set up a social co-governance system and exert the resultant force of co-governing subjects. In view of this, this paper analyzes the differences and similarities between the two countries and regions in the food safety co-governance system through the legal basis of the social co-governance system of food safety regulation in the United States and the European Union and the authority of the governing body. Then it is concluded that China needs to bring into play the joint forces of government governance subjects, promote the regulatory effect of co-governance legal system and guide the cooperative participation of social co-governance multiple subjects.
