【摘要】：近些年來,我國經(jīng)濟快速發(fā)展,城市建設(shè)日新月異,城市居民生產(chǎn)生活條件不斷改善。但與之不和諧的是,城郊結(jié)合部、城市主干道兩側(cè)、城市出入口等地違法建設(shè)現(xiàn)象屢禁不止。這些現(xiàn)象不僅影響到城市整體形象和市容市貌,破壞人民群眾生產(chǎn)生活環(huán)境;而且嚴重危害社會公平,褻瀆法律尊嚴,甚至存在嚴重的安全隱患,影響到群眾生命財產(chǎn)安全,阻礙了經(jīng)濟社會和城市建設(shè)的健康有序發(fā)展。本文共六部分。第一部分為緒論,主要介紹了本文的選題背景和意義、研究目的、國內(nèi)外研究現(xiàn)狀、創(chuàng)新點以及研究方法等內(nèi)容。第二部分重點對違法建設(shè)等概念進行了明確界定并對多中心治理理論進行了系統(tǒng)闡述。第三部分結(jié)合P市城市違法建設(shè)治理的現(xiàn)狀,分析了違法建設(shè)的形成原因和當前主要治理措施。第四部分運用多中心理論,從政府、社會組織、公眾等三方面探討了違法建設(shè)存在問題的主要原因。第五部分針對P市違法建設(shè)治理的問題提出了相應(yīng)的解決對策,包括構(gòu)建政府主導(dǎo)違法建設(shè)治理長效機制、完善社會組織監(jiān)督運行機制以及增強公眾參與治理違法建設(shè)力度等。第六部分為本文的結(jié)論部分。本文運用了實地調(diào)研、查閱資料、理論和實踐相結(jié)合的方法,以所在的P市為例,在對城市違法建設(shè)現(xiàn)狀和所面臨的困境進行分析的基礎(chǔ)上,運用奧斯特羅姆夫婦提出的“多中心治理理論”進行綜合分析,通過政府、社會組織和公眾的多方參與,構(gòu)建以政府為主導(dǎo)的治理長效機制、完善以社會組織為主的監(jiān)督運行機制以及不斷增強公眾參與違法建設(shè)治理的意識。力圖探求解決違法建設(shè)治理的新途徑,為我國各地違法建設(shè)治理提供一些有益的思路和可參考的建議。
[Abstract]:In recent years, China's economy has developed rapidly, urban construction has been changing with each passing day, and the production and living conditions of urban residents have been continuously improved. The phenomenon of illegal construction in places such as urban entrances and exits is not only prohibited. These phenomena not only affect the overall image of the city and the appearance of the city, destroy the production and living environment of the people, but also seriously endanger social justice and violate the dignity of the law. There are even serious security risks, which affect the safety of life and property of the masses and hinder the healthy and orderly development of economic, social and urban construction. The first part is the introduction, which mainly introduces the background and significance of the topic. Research purpose, domestic and foreign research status, The second part focuses on defining the concept of illegal construction and systematically expounding the theory of multi-center governance. The third part combines with the current situation of illegal construction in P city. This paper analyzes the reasons for the formation of illegal construction and the main measures to govern it at present. Part 4th uses the multi-center theory from the government and social organizations. This paper discusses the main reasons for the problems in illegal construction from three aspects, such as the public. Part 5th puts forward the corresponding solutions to the problem of illegal construction governance in P city, including the establishment of a long-term mechanism for the governance of illegal construction led by the government. The 6th part is the conclusion part of this paper. This paper uses the method of field investigation, consulting information, theory and practice. Taking the city of P as an example, on the basis of analyzing the current situation of the illegal construction of the city and the difficulties it faces, the author makes a comprehensive analysis by using the "multi-center governance theory" put forward by the Ostrom and his wife, and through the government, The participation of social organizations and the public, and the establishment of a long-term governance mechanism led by the government, To improve the supervision and operation mechanism, which is based on social organizations, and to continuously enhance the public's awareness of participating in illegal construction and governance, and to seek new ways to solve the problem of illegal construction governance, To provide some useful ideas and suggestions for illegal construction in various parts of our country.
