【摘要】：PPP項(xiàng)目實(shí)施過程中,政府和社會(huì)資本就未約定風(fēng)險(xiǎn)責(zé)任的風(fēng)險(xiǎn)事件或非預(yù)期風(fēng)險(xiǎn)事件的責(zé)任分擔(dān)進(jìn)行再談判是不可避免的。在細(xì)化項(xiàng)目運(yùn)作流程的基礎(chǔ)上,結(jié)合水利工程PPP項(xiàng)目的專業(yè)特點(diǎn),分析了水利工程PPP項(xiàng)目的合同柔性,構(gòu)建了水利工程PPP項(xiàng)目合同9種柔性調(diào)節(jié)機(jī)制,對合同結(jié)構(gòu)不完備和外部環(huán)境影響造成的風(fēng)險(xiǎn)進(jìn)行再分擔(dān),確保PPP項(xiàng)目的順利實(shí)施。研究成果可為水利工程PPP項(xiàng)目合同執(zhí)行提供理論參考。
[Abstract]:In the process of PPP project implementation, it is inevitable for the government and social capital to renegotiate the responsibility sharing of the risk event or the unexpected risk event, which is not stipulated in the risk responsibility, and on the basis of the refinement of the project operation process. Combined with the specialty characteristics of PPP project of water conservancy project, the contractual flexibility of PPP project of water conservancy project is analyzed, and nine flexible adjustment mechanisms of PPP project contract of water conservancy project are constructed. The risk caused by incomplete contract structure and external environment is reshared to ensure the smooth implementation of PPP project. The research results can provide a theoretical reference for the implementation of PPP project contract in water conservancy project.
