【摘要】:一項(xiàng)工程項(xiàng)目從開始到結(jié)束,可以分為若干階段,這些緊密聯(lián)系的階段構(gòu)成一項(xiàng)工程的生命期。從大體上看,可以分為四個(gè)階段,分別是啟動階段,規(guī)劃階段,實(shí)施階段和收尾階段。對項(xiàng)目的管理需要開展一系列的活動,包括項(xiàng)目計(jì)劃、決策、溝通、協(xié)調(diào)和控制等等。合同貫穿在工程項(xiàng)目建設(shè)的始終,并逐漸成為工程開發(fā)商和承包商進(jìn)行工程施工的主要依據(jù)。在工程項(xiàng)目施工合同的內(nèi)容變得更為復(fù)雜、詳盡的同時(shí),合同風(fēng)險(xiǎn)問題也越來越突出。風(fēng)險(xiǎn)是客觀存在的,而且是一把雙刃劍,它會給我們帶來一定的機(jī)遇,同時(shí)也會帶來一定的損失。特別是隨著我國由社會主義計(jì)劃經(jīng)濟(jì)體制向社會主義市場經(jīng)濟(jì)體制的不斷深化,人們的風(fēng)險(xiǎn)意識逐漸增強(qiáng),如何能夠更好地利用風(fēng)險(xiǎn)、降低風(fēng)險(xiǎn)系數(shù)、用最小的投入控制風(fēng)險(xiǎn)獲取依然是我們必須要面臨的重大課題。合同是工程項(xiàng)目實(shí)施和管理的重要手段和工具,工程在建設(shè)過程中需要簽訂一系列的工程施工合同,并在施工過程中要遵守合同的約定,按照合同要求履行合同內(nèi)容。隨著我國法制體系建設(shè)的不斷完善,按合同的約定來判斷權(quán)責(zé)是非已成為社會發(fā)展的必然趨勢。工程施工合同存在著諸多問題,這不僅會造成工程的嚴(yán)重拖期、進(jìn)度的滯后,最為重要的是會導(dǎo)致本來盈利的工程盈利水平會降低,甚至出現(xiàn)虧損。工程項(xiàng)目的合同主要包括標(biāo)的合同,總包合同,專業(yè)分包合同,采購合同,設(shè)計(jì)合同等等。在這些合同中,建設(shè)單位能夠如何把握風(fēng)險(xiǎn),并及時(shí)進(jìn)行風(fēng)險(xiǎn)管理,保證工程建設(shè)的進(jìn)度,是本文所要解決的重要問題。S醫(yī)院工程建設(shè)項(xiàng)目建成后將成為盤錦遼濱沿海經(jīng)濟(jì)區(qū)標(biāo)志性建筑之一,努力打造具有國際一流水平的健康中心,其投資規(guī)模大、建設(shè)周期較長、涉及的合同主體也較為復(fù)雜。所以在項(xiàng)目施工建設(shè)的過程中加強(qiáng)對合同及其風(fēng)險(xiǎn)的管理,是S醫(yī)院項(xiàng)目建設(shè)的的一項(xiàng)重要工作。根據(jù)項(xiàng)目合同風(fēng)險(xiǎn)控制和管理的相關(guān)理論、方法,與S醫(yī)院項(xiàng)目建設(shè)的合同風(fēng)險(xiǎn)管理實(shí)際相結(jié)合,針對存在的問題以期對風(fēng)險(xiǎn)管理進(jìn)行改善。本篇論文共分為五個(gè)部分。緒論部分是對本篇論文的研究背景的介紹,包括工程項(xiàng)目建設(shè)合同風(fēng)險(xiǎn)管理問題的研究意義、本文的研究背景以及當(dāng)前國內(nèi)外研究現(xiàn)狀的總體概括。第二部分工程項(xiàng)目合同風(fēng)險(xiǎn)管理的相關(guān)理論,主要包括工程項(xiàng)目合同的種類、主要內(nèi)容以及風(fēng)險(xiǎn)的產(chǎn)生和特征,項(xiàng)目工程合同與風(fēng)險(xiǎn)之間的等。第三部分是對S醫(yī)院工程項(xiàng)目的概述并對合同管理存在的問題及成因進(jìn)行了分析。第四部分是對S醫(yī)院工程項(xiàng)目風(fēng)險(xiǎn)因素的識別和評價(jià)。第五部分是S醫(yī)院工程項(xiàng)目合同風(fēng)險(xiǎn)管理的改善方案,包括對合同風(fēng)險(xiǎn)控制措施、規(guī)避措施以及應(yīng)對措施。最后是對S醫(yī)院工程項(xiàng)目合同風(fēng)險(xiǎn)管理的總結(jié)以及對合同風(fēng)險(xiǎn)管理的展望。

In these contracts, the construction unit how to grasp the risks, risk management and timely, ensure the construction progress, is an important problem to be solved in the paper.S hospital construction project will be completed in Panjin, Liaoning in the coastal economic zone one of the landmark buildings, to create a health center with the international first-class level, the large scale of investment, long construction period, involving the subject of contract is more complicated. So the strengthening of contract and risk management in the process of project construction, is an important work of S hospital construction projects. According to the theory, control and management of project contract risk method, combined with the contract risk management of S hospital project construction practice, aiming at the existing problems in order to improve risk management. This paper is divided into five parts. The introduction part is the research background of this thesis introduces the significance of the research, including the project construction contract risk management problems, the research background of this paper and the overall current study at home and abroad are summarized. The second part of the project with the relevant theory of risk management, the main types include the project contract, and the main contents and characteristics of risk, between the project contract and risk. The third part is the S hospital project overview and analysis of contract management problems and causes. The fourth part is the identification and evaluation of S hospital project risk factors. The fifth part is the improvement scheme of S hospital project contract risk management, including the contract risk control measures, circumvention measures and measures.
