【摘要】：PPP公共體育服務(wù)項(xiàng)目從制度安排視角看,可理解為在國家治理下公共體育服務(wù)領(lǐng)域的項(xiàng)目投融資概念,也是政府部門和社會資本通過構(gòu)建基于投融資主體責(zé)任、投融資收益分享和風(fēng)險(xiǎn)分擔(dān)的合作伙伴關(guān)系的模式。從實(shí)踐中出現(xiàn)的投融資政策與風(fēng)險(xiǎn)問題可知,項(xiàng)目投融資牽涉到公共體育服務(wù)的供給、規(guī)劃、監(jiān)督、問責(zé)等,政府部門和社會資本形成了行政法律關(guān)系,同時(shí)在特許經(jīng)營協(xié)議下的所有權(quán)配置、剩余控制權(quán)、履約職責(zé)等形成了民事法律關(guān)系。因此,基于行政和民事法律關(guān)系,需要從國家治理的投融資政策和風(fēng)險(xiǎn)視角考察地方政府與國家投融資政策的博弈、主體角色轉(zhuǎn)換、風(fēng)險(xiǎn)監(jiān)管、投融資結(jié)構(gòu)設(shè)計(jì)與合同結(jié)構(gòu)設(shè)計(jì)及構(gòu)建投融資的風(fēng)險(xiǎn)評估體系CFA模型等。最后,提出了相關(guān)實(shí)施路徑,如嚴(yán)格貫徹中央推出的各項(xiàng)頂層設(shè)計(jì)政策、構(gòu)建PPP制度安排總體框架、完善PPP項(xiàng)目法律體系、金融市場體制機(jī)制創(chuàng)新、地方政府積極參股、完善政策性融資擔(dān)保及設(shè)立PPP基金等。
[Abstract]:From the perspective of institutional arrangement, PPP public sports service project can be understood as the concept of project investment and financing in the field of public sports service under the governance of the country, and it is also the responsibility of government departments and social capital through the construction of the subject based on investment and financing. Investment and financing income sharing and risk sharing partnership model. From the problems of investment and financing policies and risks in practice, we can see that project investment and financing involve the supply, planning, supervision and accountability of public sports services, and government departments and social capital form an administrative legal relationship. At the same time, the allocation of ownership, residual control right and performance duty under franchise agreement form the civil legal relationship. Therefore, based on the relationship between administration and civil law, it is necessary to examine the game between local government and national investment and financing policy, the transformation of main role, risk supervision from the perspective of investment and financing policy and risk perspective of national governance. Investment and financing structure design and contract structure design and construction of investment and financing risk assessment system CFA model. Finally, it puts forward the relevant implementation paths, such as strictly implementing the top-level design policies of the central government, constructing the overall framework of the PPP system arrangement, perfecting the legal system of the PPP project, innovating the financial market system and mechanism, and the local government actively participating in the stock market. Perfect policy financing guarantee and set up PPP fund.
