【摘要】：從經(jīng)濟(jì)學(xué)視角看,法律條款的明確性和模糊性直接與立法成本、法律適用過程中的成本和法律所產(chǎn)生的效用直接相關(guān)。不同的法律體系對法律條款明確性的要求有所不同。在我國的法律傳統(tǒng)中,以往的立法往往是采用較為模糊和寬松的立法,法律條款的設(shè)置和表述都較為寬泛,多以原則性的規(guī)定為主。實際上,法律條款明確性水平的確定是決定立法效益的重要因素,也是反映立法質(zhì)量良莠的重要標(biāo)志。黨的十八屆四中全會明確提出"推進(jìn)立法精細(xì)化",這是依法治國戰(zhàn)略下對法律明確性的進(jìn)一步要求。在這一新的形勢下,《體育法》的修改也應(yīng)該遵循國家對立法所做出的新要求,使得修改后的《體育法》的法律明確性水平實現(xiàn)優(yōu)化,讓《體育法》真正能夠為我國體育事業(yè)的發(fā)展保駕護(hù)航。那么,如何確定《體育法》的明確性是本文試圖探討的問題。文章運用文獻(xiàn)資料法、比較法等方法,基于Francesco Parisi和VincyFon的立法經(jīng)濟(jì)學(xué)理論,對我國《體育法》的明確性進(jìn)行了初步的探討,試圖為我國當(dāng)前的《體育法》修改工作提供理論參考。
[Abstract]:From the perspective of economics, the clarity and vagueness of legal provisions are directly related to the costs of legislation, the costs in the process of application of laws and the effectiveness of laws. Different legal systems have different requirements for the clarity of legal provisions. In the legal tradition of our country, the legislation in the past often adopts the relatively vague and loose legislation, the setting and the expression of the legal provisions are all relatively broad, and most of them are based on the rules of principle. In fact, the determination of the level of clarity of legal provisions is an important factor that determines the effectiveness of legislation, and also an important symbol of reflecting the good and bad quality of legislation. The fourth Plenary session of the 18th CPC Central Committee explicitly put forward "promoting the refinement of legislation", which is a further requirement for the clarity of law under the strategy of governing the country according to law. Under this new situation, the revision of the Sports Law should also conform to the new requirements of the state to legislate, so that the level of legal clarity of the amended Sports Law can be optimized. Let the Sports Law really be able to protect the development of our country's sports. Therefore, how to determine the clarity of the Sports Law is the problem this paper attempts to explore. Based on the legislative economics theory of Francesco Parisi and VincyFon, this paper makes a preliminary discussion on the clarity of Sports Law in China by using the methods of literature and comparison, and attempts to provide a theoretical reference for the current revision of Sports Law in China.
