【摘要】：本文以校園足球傷害事故治理為研究對(duì)象,采用文獻(xiàn)資料法、專(zhuān)家訪談法、邏輯分析法和系統(tǒng)分析法等研究方法,對(duì)校園足球傷害事故特點(diǎn)、成因、及治理現(xiàn)狀進(jìn)行研究,挖掘目前校園足球傷害事故治理過(guò)程中存在的困境,引入?yún)f(xié)同治理理論并結(jié)合我國(guó)國(guó)情,構(gòu)建校園足球傷害事故協(xié)同治理體系,以期為高效合理處理校園足球傷害事故提供理論參考,減小校園足球發(fā)展過(guò)程中的阻力,促進(jìn)校園足球活動(dòng)健康發(fā)展與和諧校園建設(shè),最終促進(jìn)廣大青少年身心健康、體魄強(qiáng)健、全面發(fā)展。本研究結(jié)論體現(xiàn)在以下四個(gè)方面:(1)校園足球傷害事故與學(xué)校體育傷害事故是個(gè)性與共性的關(guān)系,校園足球傷害事故是校園足球活動(dòng)中體育傷害事故的具體化,當(dāng)前校園足球傷害事故的處理可歸納為:處于治理初級(jí)階段,單兵作戰(zhàn)、效率低下是常態(tài)。(2)校園足球傷害事故的治理分為事故前的風(fēng)險(xiǎn)預(yù)防與事故后的處理。事故前的預(yù)防主要采用風(fēng)險(xiǎn)回避原則與風(fēng)險(xiǎn)控制原則。存在的困境主要表現(xiàn)為部分學(xué)校采用簡(jiǎn)單風(fēng)險(xiǎn)回避方式進(jìn)行消極風(fēng)險(xiǎn)處理,以不踢球或減少踢球回避風(fēng)險(xiǎn);風(fēng)險(xiǎn)控制力量單一,缺少多部門(mén)協(xié)作。事故發(fā)生后的處理困境主要表現(xiàn)在:協(xié)商、調(diào)解普遍使用但解決能力有限;仲裁、訴訟普遍存在但時(shí)間長(zhǎng)、效率低下;歸責(zé)原則適用時(shí),公平責(zé)任原則適用中存在混亂與不公。校園足球事故發(fā)生后的賠償困境主要體現(xiàn)在:資金短缺、賠償能力有限;與事故賠償相關(guān)的法律體系不完善;失真輿論的錯(cuò)誤導(dǎo)向;保險(xiǎn)機(jī)制不夠完善,保險(xiǎn)險(xiǎn)種單一,覆蓋面不廣,民眾的保險(xiǎn)意識(shí)淡薄等。(3)當(dāng)前校園足球傷害事故治理中的困境和需求正是協(xié)同治理理論存在的價(jià)值,表現(xiàn)出較好的契合性。協(xié)同治理理論為校園足球開(kāi)展過(guò)程中的傷害事故治理提供理論支持、價(jià)值路徑和實(shí)踐指導(dǎo),協(xié)同治理理論應(yīng)用于校園足球傷害事故治理體系具有可行性。(4)基于協(xié)同治理模型構(gòu)建了校園足球傷害事故治理體系,并從組織架構(gòu)、模型元素、運(yùn)行機(jī)制、外部環(huán)境等論證模型在“治理”中的“協(xié)同性”。
[Abstract]:This article takes the campus soccer injury accident management as the research object, uses the literature material method, the expert interview method, the logic analysis method and the system analysis method and so on research method, carries on the research to the campus soccer injury accident characteristic, the cause of formation, and the management present situation. This paper excavates the difficulties existing in the process of campus football injury accident management, introduces the theory of cooperative management and combines with the national conditions of our country, and constructs the cooperative management system of campus football injury accident. In order to provide a theoretical reference for the efficient and reasonable handling of campus football injury accidents, reduce the resistance in the development of campus football, promote the healthy development of campus football activities and the construction of harmonious campus, and finally promote the physical and mental health of the majority of young people. Strong physique and all-round development. The conclusion of this study is embodied in the following four aspects: 1) the relationship between campus football injury accident and school sports injury accident is the relationship between individuality and commonness, and campus football injury accident is the embodiment of sports injury accident in campus football activity. At present, the treatment of campus football injury accident can be summarized as: in the primary stage of management, fighting alone, low efficiency is the normal. 2) the management of campus football injury accident can be divided into pre-accident risk prevention and post-accident treatment. The principle of risk avoidance and risk control are mainly used in the prevention of accidents. The main predicaments are that some schools adopt simple risk avoidance to deal with negative risks in order not to play football or to reduce the risk of kickball avoidance; the risk control force is single and lack of multi-sector cooperation. The difficulties of dealing with the accident mainly lie in: negotiation, mediation is widely used but limited ability to resolve; arbitration, litigation is widespread but long time, low efficiency; when the principle of imputation applies, there is confusion and injustice in the application of fair liability principle. After the campus football accident, the compensation dilemma is mainly reflected in: shortage of funds, limited compensation capacity; imperfect legal system related to accident compensation; erroneous guidance of distorted public opinion; imperfect insurance mechanism, single type of insurance coverage. The difficulties and demands in the management of campus football injury accident are the value of the cooperative governance theory and show a good agreement. The theory of cooperative governance provides theoretical support, value path and practical guidance for the management of injury accidents in the course of campus football development. It is feasible to apply the cooperative governance theory to the campus soccer injury accident management system. (4) based on the cooperative governance model, the paper constructs the campus soccer injury accident management system, and from the organizational structure, model elements, operation mechanism, The external environment demonstrates the "synergy" of the model in "governance".
