【摘要】：一般來說,由政府作為主導(dǎo)地位而進(jìn)行投資的項目基本上是為普通百姓改善生活質(zhì)量而建設(shè)的。政府投資項目的順利進(jìn)行、有效完成,有利于提高國民經(jīng)濟(jì)的發(fā)展,緩解經(jīng)濟(jì)收入差異造成的社會矛盾同時可以改善人民的生活水平,對于國家和社會的發(fā)展具有不可替代的作用。一個項目從工程項目立項一直到工程竣工驗收投入使用,其過程十分復(fù)雜,需要各方面協(xié)調(diào)責(zé)任,做好權(quán)利與義務(wù)的劃分,同時也需要各部門之間的相互合作。項目的劃分其協(xié)調(diào)過程中,需要規(guī)范各方的權(quán)利、義務(wù)以及責(zé)任的劃分,為了使得該工程更具有公信力,合同成為規(guī)范項目管理過程的載體。從項目的立項到項目竣工驗收以及后續(xù)的使用過程合同無處不在,因此,合同管理本身就是一個復(fù)雜系統(tǒng)工程。一個項目能夠順利實(shí)施,按時完成,合同的制定是很重要的一個環(huán)節(jié),在一定程度上來說,合同是對項目工程的質(zhì)量、投資以及進(jìn)度控制的規(guī)定。建筑合同管理的規(guī)范化將大大提高項目管理的效率。我國目前對于工程項目建設(shè)合同的管理體系不斷完善,合同的管理水平相較于以前有了很大的提升,但是合同管理過程中依然存在很多問題。本文在對政府投資項目以及工程合同管理現(xiàn)狀進(jìn)行分析的基礎(chǔ)上,提出合同管理過程中存在的問題,并對其中的"陰陽"合同、招投標(biāo)不規(guī)范以及施工掛靠等問題存在的原因進(jìn)行分析,通過分析合同管理在技術(shù)上存在這些問題的原因,針對相應(yīng)問題提出解決辦法,幫助解決政府投資項目存在的問題,從技術(shù)上規(guī)范合同管理,避免在日后的合同管理中出現(xiàn)類似問題,提高政府投資項目合同管理的有效性和合理性。
[Abstract]:In general, government-led projects are built to improve the quality of life for ordinary people. The smooth progress and effective completion of government investment projects will help to improve the development of the national economy, ease the social contradictions caused by economic income differences, and improve the living standards of the people. For the development of the country and society has an irreplaceable role. The process of a project from the project establishment to the completion and acceptance of the project is very complicated. It requires all aspects to coordinate their responsibilities, make a good division of rights and obligations, and also need the mutual cooperation among different departments. In order to make the project more credible, the contract becomes the carrier of standardizing the process of project management, it is necessary to regulate the division of rights, obligations and responsibilities of the parties in the process of coordinating the division of the project. From project establishment to project completion acceptance and subsequent use process contracts are everywhere. Therefore, contract management itself is a complex system engineering. To a certain extent, the contract is the regulation of the quality, investment and schedule control of the project. The standardization of construction contract management will greatly improve the efficiency of project management. At present, the management system of the project construction contract in our country has been improved continuously, and the management level of the contract has been greatly improved compared with before, but there are still many problems in the process of contract management. Based on the analysis of the current situation of government investment projects and project contract management, this paper puts forward the problems existing in the process of contract management, and discusses the "yin and yang" contract among them. Through analyzing the reasons of these problems in contract management, the author puts forward some solutions to the problems, and helps to solve the problems existing in government investment projects, by analyzing the reasons for the problems existing in the non-standard bidding and construction links, and by analyzing the causes of these problems in the contract management, the author puts forward some solutions to the corresponding problems. In order to improve the effectiveness and rationality of government investment project contract management, the contract management should be regulated technically to avoid similar problems in the future contract management.
