博茨瓦納哈市某賓館項(xiàng)目施工合同管理研究

【摘要】:對(duì)外工程承包是我國(guó)對(duì)外經(jīng)濟(jì)中極其重要的組成部分,每年為我國(guó)創(chuàng)造大量外匯收入,同時(shí)起著帶動(dòng)相關(guān)行業(yè)發(fā)展、刺激就業(yè)的作用。位于南部非洲的博茨瓦納工程承包市場(chǎng)是我國(guó)十分重要的對(duì)外工程承包市場(chǎng),中國(guó)建筑企業(yè)上個(gè)世紀(jì)八十年代即進(jìn)入該市場(chǎng),經(jīng)過(guò)超過(guò)三十年的發(fā)展,目前在博茨瓦納工程承包市場(chǎng)上活躍著超過(guò)五十家的中國(guó)建筑企業(yè)。隨著該市場(chǎng)競(jìng)爭(zhēng)的加劇,中國(guó)建筑企業(yè)在施工合同管理上的短板日益凸顯,因此有必要對(duì)博茨瓦納的建設(shè)工程施工合同管理進(jìn)行研究。本文以博茨瓦納哈市某賓館項(xiàng)目為背景,首先通過(guò)緒論對(duì)研究背景和意義、國(guó)內(nèi)外研究現(xiàn)狀、論文內(nèi)容和結(jié)構(gòu)進(jìn)行了闡述。其次,對(duì)建設(shè)工程施工合同管理相關(guān)理論進(jìn)行了梳理,重點(diǎn)對(duì)施工合同、合同管理相關(guān)概念進(jìn)行了界定,并對(duì)賓館項(xiàng)目施工管理特征和國(guó)際工程施工合同管理的特點(diǎn)進(jìn)行了介紹。再次,研究該項(xiàng)目使用的博茨瓦納BIDP合同,通過(guò)對(duì)六大方面的關(guān)鍵點(diǎn)進(jìn)行深入分析并主要與FIDIC紅皮書(shū)進(jìn)行對(duì)比,提出使用博茨瓦納BIDP合同時(shí)應(yīng)予以注意的地方。第四,對(duì)項(xiàng)目情況進(jìn)行介紹和分析,內(nèi)容包括博茨瓦納整體情況、項(xiàng)目概況和承包商實(shí)施合同管理存在的問(wèn)題。第五,結(jié)合上述合同條件分析和項(xiàng)目情況分析,將該項(xiàng)目的施工合同管理分解成不同階段,介紹該項(xiàng)目施工合同管理工作、提出應(yīng)采取的措施。最后,得出本文的結(jié)論和研究展望。通過(guò)本文的研究不難發(fā)現(xiàn),承建該項(xiàng)目的中國(guó)建筑企業(yè)在施工合同管理上仍然存在很多不足,突出體現(xiàn)在合同管理機(jī)構(gòu)人員設(shè)置不完善、項(xiàng)目人員合同意識(shí)不強(qiáng)、對(duì)合同文本研究不深等諸多方面,這些不足之處在中國(guó)建筑企業(yè)中具有一定的代表性和廣泛性,嚴(yán)重影響中國(guó)建筑企業(yè)在博茨瓦納工程承包市場(chǎng)上的生存和發(fā)展,尤其是當(dāng)下博茨瓦納工程承包市場(chǎng)處于低迷的時(shí)期更是如此。本文從合同管理機(jī)構(gòu)、合同管理人員、合同意識(shí)、合同管理的基礎(chǔ)工作等幾方面提出改善施工合同管理工作的建議,這些建議具有較強(qiáng)的實(shí)踐指導(dǎo)作用,有助于提升中國(guó)建筑企業(yè)在博茨瓦納工程承包市場(chǎng)上的施工合同管理水平。
[Abstract]:Foreign project contracting is an extremely important part of China's foreign economy. It creates a large amount of foreign exchange income for our country every year and promotes the development of related industries at the same time. The Botswana project contracting market, located in southern Africa, is a very important external engineering contracting market in China. In -20s, Chinese construction enterprises entered the market, and after more than 30 years of development, At present, there are more than 50 Chinese construction enterprises active in the Botswana project contracting market. As competition intensifies in this market, the short plates in construction contract management of Chinese construction enterprises are becoming increasingly prominent. Therefore, it is necessary to study the construction contract management of the construction project in Botswana. This paper takes a hotel project in Harbin, Botswana as the background, first of all, through the introduction to the research background and significance, domestic and foreign research status, The content and structure of the paper are expounded. Secondly, the related theory of construction contract management is combed, and the related concepts of construction contract and contract management are defined. The characteristics of hotel project construction management and international project construction contract management are introduced. Thirdly, the Botswana BIDP contract used in this project is studied. Through the deep analysis of the key points in six aspects and the comparison with the FIDIC Redbook, the paper puts forward the points that should be paid attention to when using Botswana BIDP contract. 4th, the project situation is introduced and analyzed. The contents include the overall situation of Botswana, the general situation of the project and the problems existing in the implementation of the contract management by the contractor. 5th, combining the analysis of the above contract conditions and the analysis of the project situation, the construction contract management of the project has been decomposed into different stages, This paper introduces the construction contract management of the project, and puts forward the measures to be taken. Finally, the conclusion and research prospect of this paper are drawn. There are still many deficiencies in the construction contract management of the Chinese construction enterprises which are engaged in the construction of the project, which are mainly reflected in the imperfect personnel setting of the contract management organization, the lack of contract consciousness of the project personnel, the lack of deep research on the contract text, and so on. These deficiencies are representative and extensive in Chinese construction enterprises, which seriously affect the survival and development of Chinese construction enterprises in the Botswana project contracting market. This is especially true when the Botswana project contracting market is in the doldrums. Some suggestions on how to improve the construction contract management are put forward in the basic work of contract management. It helps to improve the management level of construction contract in Botswana project contract market.
