【摘要】：不作為是一種較常見的公務(wù)違法現(xiàn)象,需要針對(duì)其產(chǎn)生的主客觀因素進(jìn)行系統(tǒng)治理。不作為的生成除了公務(wù)人員自身的主觀因素之外,相關(guān)制度的缺陷也是不容忽視的重要客觀因素。如重事后問責(zé)輕防范監(jiān)督的制度缺陷、原初責(zé)任配置的科學(xué)性欠缺、責(zé)任追究制度的非公平合理性等,都可能誘發(fā)公務(wù)人員不作為。對(duì)此必須進(jìn)行系統(tǒng)性的制度改進(jìn),主要包括:建立重在事前防范和事中監(jiān)督的專門制度、科學(xué)配置公務(wù)崗位職責(zé)、構(gòu)建公平合理的責(zé)任追究機(jī)制等。
[Abstract]:Omission is a common phenomenon of official violation, which needs to be dealt with systematically according to its subjective and objective factors. Besides the subjective factors of the public servants, the defect of the relevant system is also an important objective factor that can not be ignored. Such as the system defect of emphasizing accountability after the event, the lack of scientific allocation of the original responsibility, the unfairness and rationality of the accountability investigation system, all these may lead to the inaction of the public servants. It is necessary to carry out systematic system improvement, including: establishing a special system focusing on pre-prevention and supervision, scientific allocation of duties and responsibilities of official posts, establishment of a fair and reasonable mechanism of accountability, and so on.
