【摘要】："三張清單"制度(權(quán)力清單、負(fù)面清單、責(zé)任清單)是深化行政體制改革、轉(zhuǎn)變政府職能,落實簡政放權(quán)任務(wù)和推進(jìn)國家治理現(xiàn)代化的制度性回應(yīng)。清單制度具有深厚的學(xué)理基礎(chǔ)和理論邏輯,三者之間既相互聯(lián)系、相互促進(jìn),又因地位不同而相互區(qū)別。權(quán)力清單是核心,責(zé)任清單是關(guān)鍵,負(fù)面清單是目標(biāo)。清單制度試行以來,面臨缺乏法律文件支撐、思想認(rèn)識誤區(qū)、各地推行進(jìn)度不同步、缺乏人大認(rèn)可和民眾參與等現(xiàn)實困境。為使"三張清單"落到實處,應(yīng)該從制定統(tǒng)一規(guī)范法律文件、發(fā)揮人大決定確認(rèn)機(jī)制、鼓勵社會力量參與、注重事中事后監(jiān)管、織密監(jiān)督之網(wǎng)等方面尋求突破路徑,從而切實發(fā)揮清單制度的功效。
[Abstract]:The system of "three lists" (power list, negative list, responsibility list) is the institutional response to deepen the reform of administrative system, transform the functions of government, implement the task of decentralization and promote the modernization of national governance. The list system has a profound theoretical foundation and theoretical logic. The three systems are interrelated and promote each other, and are different from each other because of their different status. The power list is the core, the responsibility list is the key, and the negative list is the goal. Since the implementation of the list system, it has been faced with such practical difficulties as the lack of legal documents, the misunderstanding of ideology, the synchronization of the implementation of various places, the lack of the approval of the people's Congress and the participation of the people. In order to put the "three lists" into practice, we should seek a breakthrough path in formulating unified and standardized legal documents, giving full play to the confirmation mechanism of the people's Congress decisions, encouraging social forces to participate, paying attention to the supervision in the event after the event, and weaving a network of secret supervision, etc. So that the effectiveness of the list system.
