【摘要】：伴隨著互聯(lián)網(wǎng)絡(luò)的發(fā)展,一種新的監(jiān)督方式應(yīng)運而生。兼容現(xiàn)代科技與現(xiàn)代民主特質(zhì)的網(wǎng)絡(luò)監(jiān)督,不僅是現(xiàn)代政治文明的體現(xiàn),還為我國改革開放的深化和人民權(quán)益的實現(xiàn)提供了有力的支持。遺憾的是,在網(wǎng)絡(luò)監(jiān)督正面社會效應(yīng)發(fā)揮的同時,網(wǎng)絡(luò)監(jiān)督的負面社會效應(yīng)也日益凸顯。由于我國網(wǎng)絡(luò)監(jiān)督正處于一個起步階段,還沒有建立起一套獨立、完善的監(jiān)督管理體系。因此,出現(xiàn)了諸如網(wǎng)絡(luò)監(jiān)督主體的缺失、合法性不明確,監(jiān)督手段缺乏或受限,監(jiān)督對象和監(jiān)督信息覆蓋范圍呈碎片化和片面性等問題,極大地制約了網(wǎng)絡(luò)監(jiān)督的效果。因此,進一步發(fā)揚具有中國特色的社會主義民主,實現(xiàn)社會主義政治文明,要求我們重視對網(wǎng)絡(luò)監(jiān)督功能的研究,充分發(fā)揮網(wǎng)絡(luò)監(jiān)督的作用。在此基礎(chǔ)上,積極引導(dǎo)大眾理性對待自己的互聯(lián)網(wǎng)權(quán)力,認真遵守網(wǎng)絡(luò)監(jiān)督的規(guī)范,這不僅是時代進步和民主進步的要求,也是社會發(fā)展的必然要求。更重要的是,加強網(wǎng)絡(luò)監(jiān)督的社會調(diào)控功能,對我國的穩(wěn)定和社會和諧有重大的意義。本文共分為五個部分。第一部分,筆者對本文研究目的、研究意義以及國內(nèi)外研究現(xiàn)狀展開論述;第二部分:主要論述了網(wǎng)絡(luò)監(jiān)督的主要內(nèi)容,包括對網(wǎng)絡(luò)監(jiān)督概念的界定、網(wǎng)絡(luò)監(jiān)督的構(gòu)成以及網(wǎng)絡(luò)監(jiān)督的特點;第三部分:從社會和政府兩個角度對網(wǎng)絡(luò)監(jiān)督的功能展開了詳細論述;第四部分:著重分析了網(wǎng)絡(luò)監(jiān)督功能發(fā)揮過程中出現(xiàn)的主要問題,并揭示了產(chǎn)生這些問題的原因,從而為解決問題奠定基礎(chǔ);第五部分:在前文的基礎(chǔ)上,有針對性地提出了解決網(wǎng)絡(luò)監(jiān)督功能發(fā)揮過程中出現(xiàn)的問題的建議,以期對我國網(wǎng)絡(luò)監(jiān)督的健康發(fā)展起到一定的促進作用。
[Abstract]:With the development of Internet, a new way of supervision came into being. The network supervision, which is compatible with modern science and technology and modern democracy, is not only the embodiment of modern political civilization, but also provides a powerful support for the deepening of reform and opening up and the realization of people's rights and interests. Unfortunately, while the positive social effects of network supervision are brought into play, the negative social effects of network supervision become increasingly prominent. As China's network supervision is in its infancy, a set of independent and perfect supervision and management system has not been established. Therefore, problems such as the lack of the main body of network supervision, the unclear legitimacy, the lack or limitation of the means of supervision, the fragmentation and one-sidedness of the object of supervision and the coverage of supervision information greatly restrict the effect of network supervision. Therefore, the further development of socialist democracy with Chinese characteristics and the realization of socialist political civilization require us to attach importance to the study of the function of network supervision and give full play to the role of network supervision. On this basis, we should actively guide the public to treat their Internet power rationally and abide by the norms of network supervision, which is not only the requirement of the progress of the times and democratic progress, but also the inevitable requirement of social development. More importantly, strengthening the social control function of network supervision is of great significance to the stability and social harmony of our country. This paper is divided into five parts. In the first part, the author discusses the purpose of the research, the significance of the research and the current situation of the research at home and abroad. The second part: mainly discusses the main contents of network supervision, including the definition of the concept of network supervision, the composition of network supervision and the characteristics of network supervision; The third part: the function of network supervision is discussed in detail from two angles of society and government. The fourth part analyzes the main problems in the process of exerting the network supervision function, and reveals the causes of these problems, thus laying the foundation for solving the problems. The fifth part: on the basis of the above, the author puts forward some suggestions to solve the problems in the process of network supervision, in order to promote the healthy development of network supervision in our country.
